4 The following are details of the covenants


contained in the Conveyance dated 8 August 1902
referred to in the Charges Register:-

"The Purchaser doth hereby for himself and his


assigns to the intent and so that the covenants
hereinafter contained shall be binding on the
hereditaments hereby assured into whomsoever
hands the same may come and not so as to be
personally liable in damages for any breach thereof
after he the Purchaser shall have parted with the
premises covenant with the Vendors their heirs and
assigns in manner following namely (a) That he the
Purchaser will well and sufficiently fence off the
land hereby assured from the adjoining property of
the Vendors if and so far as the same is not already
fenced off (b) And will form a width of not less than
45 feet except the road coloured yellow on the said
plan which shall be of a width of not less than 50
feet and hereafter maintain and repair to the
satisfaction of the Surveyors for the time being of
the Vendors and of the Urban District Council all
the roads coloured brown and purple and yellow in
the said plan (except Brownlow Road) with all
neacessary sewers and drains in connection
therewith (c) And will not erect any messuage or
dwellinghouse upon any part of the said land which
shall be of less value exclusive of the price of the
land than £300 nor except in accordance with
plans and elevations which shall be first approved
by the Surveyors for the time being of the Vendors
in writing but no fee shall be payable by the
Purchaser for obtaining any such approval (d) And
that every such messuage or dwellinghouse with
the site thereof shall have a frontgage of not less
than 17 feet and a depth of not less than 110 feet
(with the exception of the messuages or
dwellinghouses to be erected on the ground
coloured Green on the said plan such last
mentioned Messuages or dwellinghouses having a
depth of 100 feet only) and all such messuages or
dwellinghouses shall be so that the general line of
frontages shall not approach nearer to the road
that 15 feet that being the distance indicated on
the said plan by the dotted line thereon marked
"Building Line" (e)

And will not dig or get for the purpose of sale or


otherwise than as may be necessary to form cellars
drains basements or foundations of the buildings to
be erected or for use or removal in the erection or
execution of any messuage or dwellinghouse or
works any earth sand clay or gravel from the said
land (f) And that wherever the said land shall abut
on other land of the Vendors the erection in
pursuance of this covenant of any wall fence or
other structure so far as relates to the side abutting
on the said land adjoining whether a party wall
party fence or otherwise shall be treated as such in
accordance with the Metropolitan Building Act but
so that the three months notice required by such
Act shall in no case be considered necessary (g)
And will not carry on or suffer to be carried on upon
any part of the said premises any trade or business
whatsoever or allow the same to be used otherwise
than for the purpose of a private dwellinghouse or
of any profession (h) And will not do or suffer to be
done on any part of the premises anything which
may be or grow to be a public or private nuisance or
a damage disturbance annoyance or grievance to
the Tenants or occupiers of property in the
neighbourhood of the said premises."

NOTE: York Road is coloured yellow on the


Conveyance Plan. It is believed that the green land
included 26, 28 and 50 York Road.
