CASE BRIEF:
The first Madrasi Education Association School was established in Simla on
Vijyadasami Day in 1923 with one teacher and one pupil by Shri. P.H. Sundaresa Iyer
the founder teacher. In 75 years, the one teacher-pupil position has gone to 7 Senior
Sec. Schools and over 7000 students and 500 teachers.
In 1972, the name of the Association was changed from Madrasi Education
Association to Delhi Tamil Education Association (DTEA). Today, the DTEA runs 7
Senior Secondary Schools renamed as DTEA Schools at Mandir Marg, Lodi Estate,
Lakshmi Bai Nagar, Mati Bagh, Karol Bagh, R.K. Puram and Janakpuri. On
22.10.2020, the former CM of Tamil Nadu, Sh. Edappadi K. Palaniswami, inaugurated
DTEA’s 8th branch at Mayur Vihar Phase-III, East-Delhi.
Now, the petitioner in person filed an application under RTI Act on 14.09.2022 to
the DOE seeking the MOA and AOA for the DTEA aided schools. The chairman, DTEA
sent a show cause notice to the former Joint Secretary, Sh. R. Murugan, regarding
irregularities in Science Club Account and its misuse during FY 2014-2015 to 2020-
2021 in respect of DTEA Senior Secondary School, Lodhi Estate.
Therefore, the petitioner in person sent a representation letter dated 27.09.2022 to the
Hon'ble CM of Delhi, Hon'ble Education Minister of Delhi, the DOE Govt. of NCT Delhi
and forwarded to Schools Principal, DTEA to constitute a committee headed by the
Retd. Hon'ble HC Judge to investigate the issues raising by the
parents/staffs/teachers against the management of the DTEA. The Chairman, DTEA
again sent a show cause notice to the former Joint Secretary, DTEA Lodhi Estate on
10.10.2022. The Public Information Officer, Zone-19, sent an intimation letter dated
11.10.2022.
Hence, the present W.P. was filed under Art. 226 praying for issuance of a Writ of
mandamus or any other appropriate writ/order(s) or direction(s) directing R1 to
constitute a committee headed by a retired Judge of this Hon'ble High Court to
investigate the financial irregularity and malpractices committed by the managing
committee of DTEA. Also, issuance of appropriate writ/order(s) or direction(s)
restricting the Respondents R2 to R9 from amending the MOA and AOA of DTEA
during the pendency of the present W.P. and to audit the accounts of the DTEA
Schools with the admissions taken and donations made to the DTEA Schools for the
last 12 years.
