Delegated Act to Article 27 Renewable Energy Directive II (RED II) sets out detailed requirements for
sourcing renewable electricity used in production of Renewable Fuels of Non-Biological Origin
International PtX Hub

(RFNBOs), including renewable hydrogen

Determines when electricity used for production of RFNBO/ H2 is considered as “fully
renewable” or not

Delegated Act to Article 28 RED II specifies the methodology for assessing GHG emissions savings
from RFNBOs.
Determines amount of GHG emissions savings from RFNBO / H2 (min. 70%)

Applicable to EU-internal and outside. To be translated by voluntary schemes into their systems.

the sustainability and greenhouse gas saving criteria and the CO2 capture did not receive credits for emission
savings from CO2 capture and replacement, set out in Annex V and VI of Directive (EU) 2018/2001, or;
• The captured CO2 stems from the combustion of renewable liquid and gaseous transport fuels of non-biological origin

Chapter summary
22/05/2023

• Several hydrogen certification schemes exist at different levels: regional, national, sub-
national
International PtX Hub

• Certification schemes, standards (e.g., carbon intensitity threshold) and methodologies

differ
• The framework in the EU is the most established and comprehensive
• Some countries with existing or planned hydrogen/PtX standards and certification schemes
include Australia, Canada, China, Japan, UK and USA
• There are also non-country-specific schemes for hydrogen/PtX certification, such as The
Green Hydrogen Standard and the IPHE methodology for determining the GHG emissions
associated with the production of hydrogen
• Harmonization efforts are ongoing

Snap shot: Land rights
22.05.2023

The producer should be able to prove

that the land is being used legitimately
and that traditional and customary
International PtX Hub

land rights or tenure have been

secured. Documents must show legal
ownership or lease, history of land
tenure and the actual legal use of the
land. The producer must identify and
respect existing land rights (see ISCC
Principle 1). The rights of indigenous
people must be respected. Within this
context, the use of the land by
pastoralists,
indigenous people, artisanal fishers and
other comparable users is allowed,
excluding any illegal hunting, illegal
fishing and illegal collection of products.
The process of Free Prior and Informed
Consent (FPIC) is applied in the case of
new land acquisitions.

12a. Existing land rights and land-use rights, both formal and informal, shall be assessed,
documented, and established. The right to use land for the operations shall be established only
International PtX Hub

when these rights are determined

12b. Free, Prior, and Informed Consent shall form the basis for all negotiated agreements for
any compensation, acquisition, or voluntary relinquishment of rights by land users or owners
or operations.

The environmental impacts of new cultivation areas, new buildings, restructuring rural
landholdings, drainage systems and other constructions or systems, for the use of
International PtX Hub

uncultivated land or semi-natural areas for intensive agricultural purposes and intensive
livestock installations, are assessed in an environmental impact assessment and are
minimised where possible. The impact assessment considers the following aspects:

• land and soil characteristics

• rare and endangered species
• potential off-site contaminants
• neighbouring human settlements
• water management projects (including water pollution and water availability)

9b. Operations shall include a water management plan which aims to use water efficiently and
to maintain or enhance the quality of the water resources that are used for the operations.

9c.Operations shall not contribute to the depletion of surface or groundwater resources

beyond replenishment capacities.

9d. Operations shall contribute to the enhancement or maintaining of the quality of the
surface and ground-water resources.

Chapter summary
22/05/2023

• Voluntary schemes can include sustainability criteria which consider several factors,
including:
International PtX Hub

• Land rights
• GHG emissions
• Local food security
• Water
• Labour rights
• Sustainability criteria for biomass in voluntary schemes such as RSB and ISCC are likely to be
applicable in hydrogen/PtX certification – in what detail remains to be seen
• Through certification, additional requirements can be added that go beyond the regulatory
framework – reputation for the certifiers and the consumers

• Chain of custody describes the way how certain attributes are connected to the actual
physical product.

option.
