Legal Aid Policies, 2001

SRO No.130-Act/2001- For the purpose of providing legal aid to the litigants who
are incapable of seeking justice due to financial insolvency, destitution,
helplessness and for various socio-economic conditions, the following policies are
hereby published by the National Legal Aid Services Organization under the
provision of section 7(a) of Legal Aid Services Act, 2000 ( Act No. VI of 2000),
namely:-

1. Short title.- These policies may be called the Legal Aid Policies, 2001.
2. The eligibility for receiving legal aid.- Among others the following
individuals shall be considered to be eligible for receiving legal aid, namely:-

(a) freedom fighters disabled, partially disabled, unemployed or unable to


make a yearly income above 75000 Taka;

(b) an individual receiving old age allowance;

(c) a distressed mother holding a VGD card;

(d) women and children victim of trafficking;

(e) women and children victim of acid throwing by the miscreants;

(f) the allotee of a house or land in a model village;

(g) an insolvent widow, a distress woman and a woman abandoned by


husband;

(i) unable to earn and destitute disabled person;

(j) a person unable to protect his/her right in court or to defend him/herself


for financial insolvency;

(k) a person detained without trial and unable to take proper steps in self
defense due to financially insolvency;
(l) a person considered by the court as financially helpless and insolvent;
(m) The person recommended or considered by the Jail Authority as
financially helpless and insolvent;
(n) the persons who are-

(i) for the purpose of the Legal Aid Service Act. 2000, identified from
time to time by the Organization as financially insolvent, destitute
and suffered losses due to various socio-economic and natural
calamities, and

(ii) unable to conduct a case to protect his/her right.

Explanation.- For the purpose of these policies, " insolvent or financially


insolvent person" means the person whose annual average income is not above
Taka 50,000 (fifty thousand).
