SUPPLEMENT TO THE INDEPENDENT CONTRACTOR GENERAL HEALTH, SAFETY, AND

ENVIRONMENTAL CONTRACT REQUIREMENTS

1.0 Purpose & Interpretation

This Supplement to the Independent Contractor General Health, Safety, and Environmental
Contract Requirements (the “HES Supplement”) outlines the COVID-19 prevention and control
measures in the various offices, facilities, and locations (collectively, the “Sites”) of Energy
Development Corporation and its subsidiaries (each, a “Company”). As supplement, the HES
Supplement shall be read together and harmoniously with the existing health and safety
requirements of the Company, as the same may be amended or further supplemented, and other
infection prevention and control guidelines issued by regulatory agencies or the relevant local
government units.

In case of conflict between the provisions of this HES Supplement and the provisions of the
original Independent Contractor General Health, Safety, and Environmental Contract
Requirements, the more stringent requirement shall apply. The term “Contractor” as used in this
HES Supplement shall also refer to “Supplier” where a document referencing this HES
Supplement uses the term “Supplier”.

2.0 Scope

This HES Supplement shall apply to the Contractor, its employees, personnel, agents, workers,
and representatives (collectively, the “Contractor”) and their respective personnel (the
“Contractor’s Personnel”) assigned to work at the Sites.

3.0 Health and Safety Plan

3.1. Project Health and Safety (H&S) Plan

3.1.1. The Contractor shall prepare, review and/or update its Project H&S Plan. The
update shall include, at the minimum, the following additional information:

3.1.1.1. Control measures to reduce transmission of COVID-19; and


3.1.1.2. Medical Emergency Response Plan and Pandemic Plan detailing the
steps to be undertaken to mitigate risks, including medical emergencies
related to COVID-19.

3.1.2. The contents of the Contractor’s Project H&S Plan should be aligned with this HES
Supplement and applicable laws, rules and regulations issued by the national and
local government authorities.

3.1.3. The Contractor’s updated Project H&S Plan shall be submitted to the Company
Representative for review if the same is aligned with this HES Supplement.

3.2. Contractor Personnel Requirements and Fitness for Duty (FFD)

3.2.1. The Contractor shall submit to the Company Fit-To-Work medical certificates of its
assigned Contractor’s Personnel.

3.2.2. The Contractor shall preferably source Contractor’s Personnel from and within the
same geographical area as the Site and/or adjacent geographical areas with no
active community transmission.

3.2.3. If needed, the Contractor shall provide nearby lodging and transportation for
Contractor’s Personnel, who, as part of health, safety, and precautionary measures,
should not be taking public transportation.

3.2.4. The Contractor shall only assign personnel who are physically fit to perform the
works at the Sites. Contractor’s Personnel falling under the following criteria and/or
manifesting any of the following health conditions shall not be allowed to work at
the Sites due to risk of severe COVID-19 outcome:

3.2.4.1. Older than 60 years old,


3.2.4.2. Poorly Controlled Diabetes,
3.2.4.3. Cancers,
3.2.4.4. Neurologic diseases (e.g. post-stroke, etc.),
3.2.4.5. Heart diseases and coronary artery disease, including poorly controlled
hypertension,
3.2.4.6. Renal failure,
3.2.4.7. Chronic lung disease such as COPD,
3.2.4.8. Chronic liver disease, and
3.2.4.9. Organ Transplant.

3.2.5. Once available, Contractor’s Personnel shall undergo antibody testing prior to start
of work. The Company reserves the right to require Contractor’s Personnel to
undergo subsequent antibody testing depending on the type of work to be
performed by the Contractor. Fees associated with the testing shall be for the
account of the Contractor.

3.2.6. Contractor shall provide the following competent Contractor’s Personnel at the
Sites to monitor emergence of any influenza-like illness (ILI) among its workers and
implement the COVID-19-related requirements:

3.2.6.1. One (1) First Aider for every 50 workers; and


3.2.6.2. Minimum number of Safety Officers which shall be proportional to the
total number of workers and equipment, size of Assigned Workplace (as
defined below), classification of the workplace, as required by the DOLE-
OSH Standards.

3.3. Work Arrangement

3.3.1. The Contractor shall prepare a suitable work arrangement wherein Contractor’s
Personnel per Assigned Workplace (as defined below) are kept to a minimum in
accordance with this HES Supplement. The Company will prescribe the maximum
number of personnel that the Contractor can assign to perform the works per shift
provided that the total number of personnel who will perform the works, irrespective
of whether the works will be performed by one or more contractors, shall not
exceed twenty (20) individuals per shift. These personnel shall be permanently
assigned to their respective shift for the duration of the performance of the works
(the “Team”) and shall not transfer to a different Team.

3.3.2. The Contractor shall request in writing and obtain a prior written approval from the
Company where the Contractor determines that its own personnel and/or the total
members of the Team will exceed the maximum number of personnel allowed for
the Contractor per shift and/or twenty (20) individuals per shift.

3.3.3. Members of each Team shall not interact with any other person outside of their
Team for the duration of the performance of the works, whether onsite or offsite.

3.3.4. Each Team will be geographically spaced out while working within the Sites.

3.4. Ingress and Egress

3.4.1. Only authorized Contractor’s Personnel shall be allowed to enter the Sites.

3.4.2. Contractor’s Personnel shall undergo Entry Screening Procedure from an external
location and accomplish the daily Health Declaration Form.

3.4.3. The following Contractor’s Personnel will be allowed to enter the Sites:
i. Declared fit-to-work by the Contractor (in accordance with the
Supplier’s Acknowledgment, Undertaking, and Agreement);
ii. Cleared from (i) travel history from high risk territories, (ii) exposure
to COVID-19, and (iii) COVID-19 symptoms
Contractor’s Personnel who fall under any of the following criteria (Sub-Sections
3.4.3.1 to 3.4.3.4) shall not be allowed to enter the Sites, and shall be referred to
the Company’s doctor remotely for further evaluation:

3.4.3.1. Those with close contact with any of the following persons in the last 14
days:
i. Confirmed positive with COVID-19;
ii. Persons under investigation or those suspected with COVID-
19; or
iii. Persons under monitoring or those probable with COVID-19.

3.4.3.2. Those who have visited a healthcare facility that is designated to manage
COVID-19 cases,
3.4.3.3. Those with household members with ILI, and
o
3.4.3.4. Those with body temperature of > or = 37.5 C

3.4.4. Contractor’s Personnel who manifests ILI and diarrhea shall be advised to go home
and call the COVID-19 Hotline Number.

3.4.5. Contractor’s Personnel shall be required to wash/sanitize their hands and to use
footbath stations, if available, prior to entering the Sites.

3.4.6. “No Temperature Check, No Alcohol Disinfection, No Mask = No Entry Policy” shall
be strictly implemented in the Sites.

3.4.7. Equipment and vehicle entering the Sites shall go through a disinfection process in
an identified area assigned by the Company.

3.4.8. Contractor shall follow other Ingress and Egress protocols of the Company, as
applicable.

3.5. Personal Protective Equipment (PPE)

3.5.1. On top of the basic and special PPEs required to be worn prior to this HES
Supplement, wearing of face masks for all Contractor’s Personnel is required at all
times while inside the Sites. Should cloth masks be used, the washable type shall
be worn but additional filter material such as tissue papers inside the masks must
be added.

3.5.2. PPEs (basic & special) required for the performance of the works at the Sites shall
be properly disinfected before and after use. Contractor’s Personnel shall use their
own PPE. Borrowing of PPE is not allowed.

3.5.3. Single use PPE should be disposed of properly so that it cannot be reused.

3.5.4. Removal of masks is allowed only when eating or drinking.

3.6. Physical Distancing

3.6.1. Subject to Section 3.3, Contractor’s Personnel shall always maintain a physical
distance of at least two (2) meters from each other.

3.6.2. Prolonged face-to-face interaction between Contractor’s Personnel and the
Company shall be discouraged. Meetings needing physical presence (e.g., toolbox)
shall be kept to a minimum number of participants, with short duration, and to be
conducted in a well-ventilated area.

3.7. Vehicle Requirement

3.7.1. Contractor shall limit the number of passengers in a vehicle to comply with the
required physical distancing (1 meter). If the vehicle of the Contractor will not allow
the required physical distancing, Contractor shall provide either a (i) bigger vehicle
or (ii) additional vehicle(s) to ensure that the required physical distancing is
complied with. All passengers shall wear masks while inside the vehicles.

3.7.2. Subject to Section 3.7.1., if the Contractor needs to have multiple people in a
vehicle, the passengers shall be split into teams or groups. The same group of
passengers must travel together in the same assigned vehicle for the duration of
the performance of the works.

3.7.3. A vehicle already assigned to a team or group cannot be assigned to or shared with
a different team or group. When sharing of vehicles is required, disinfection of the
said vehicle shall be done by the Contractor after each team or group uses it.

3.7.4. A dedicated driver shall be assigned to each of the vehicles when multiple vehicles
are used by the Contractor.

3.8. Common Areas inside the Company Site

3.8.1. The Contractor’s Personnel shall not loiter inside the Sites, or go beyond their
Assigned Workplace (as defined below).

3.8.2. The Contractor’s Personnel shall only use Company-designated washrooms.

3.8.3. The canteen shall be open but only for take-out or delivery. It is advisable for
Contractor’s Personnel to bring their own food, drinks, and cutleries.

3.9. Inside Assigned Workplaces

The “Assigned Workplace” shall refer to the area within the Sites where the Contractor’s
Personnel are allowed to perform their works. The Contractor shall install or practice the
following control measures in their Assigned Workplace, in addition to the requirements set
out in Sections 3.5 to 3.7. The Safety Officer of the Contractor shall be responsible for
ensuring that these controls and practices are properly implemented.

3.9.1. General Workplace Management

3.9.1.1. A daily log containing the names of the Contractor’s Personnel shall be
prepared.

3.9.1.2. All work is to be undertaken in such a way as to reduce any physical


contact between personnel and maintain physical distancing at all times
(refer to Section 3.6).

3.9.1.3. Workstations shall be arranged in a manner that will maintain proper


physical distancing. Barriers may be provided between working areas or
designated pathways. Markings shall be installed to direct a one-way
movement within corridors or walkways.

Note: When arranging workstations, consider other hazards (physical,


chemical, biological) that are present in the workplace.

3.9.1.4. All work areas within the Assigned Workplace shall be provided with
adequate ventilation.

3.9.1.5. Wherever possible, signages containing information on Infectious


Disease Management shall be installed in conspicuous locations within
the Assigned Workplace.

3.9.2. General Hygiene for Contractor’s Personnel

3.9.2.1. Always observe proper respiratory etiquette.

● Cough and sneeze into tissue or into sleeve, if tissue is not


available.
● Disinfect hands immediately through proper washing with soap and
water or alcohol-based sanitizer after a cough or sneeze.

3.9.2.2. Wash areas shall be installed, preferably near the entrance of the
Assigned Workplace and in strategic areas, and will be supplied with
sufficient clean water and soap. If not, alcohols and alcohol-based
sanitizers (with 70% concentration of isopropyl or ethanol) shall be made
available to all Contractor’s Personnel.

3.9.2.3. All Contractor’s Personnel are encouraged to wash their hands more
frequently and avoid touching their eyes, nose, and mouth.

3.9.2.4. Any personal items not required for the performance of the works that are
brought to the Assigned Workplace shall be segregated or kept separate
from other personal items of other Contractor’s Personnel.

3.9.3. Eating Arrangements

3.9.3.1. Contractor’s Personnel are advised to bring in pre-prepared and wrapped


meals.

3.9.3.2. Eating shall be allowed in individual workstations or in other designated


areas. Areas used for eating shall be thoroughly cleaned and disinfected
at the end of each break or shift, including chairs and tables.

3.9.3.3. Bringing of personal tumblers, spoons and forks and plates shall be
required. Cleaning and washing shall be done individually.

3.9.3.4. Break time shall be staggered to reduce congestion and contact among
workers.

3.9.3.5. Practice “Clean As You Go.”

3.9.4. Housekeeping

3.9.4.1. Proper housekeeping shall be maintained at all times through regular


cleaning and disinfection of surfaces within work areas, common areas,
machines, and equipment.

3.9.4.2. Cleaning shall be done using soap and water. This shall be followed by
disinfection using antimicrobial agents such as sodium hypochlorite
(contained in household bleach), 70 % ethyl alcohol or isopropyl alcohol.
Other appropriate cleaning and disinfecting agents may be used for
machines and equipment.

3.9.4.3. All work areas and frequently handled objects such as doorknobs,
handles, faucets, and tools shall be cleaned and disinfected regularly, at
least once every two (2) hours.

3.9.4.4. Assigned Workplace shall be cleaned and sanitized at the end of the
working day or at the end of each shift.

3.9.4.5. Non-contact trash bins shall be provided in strategic locations within the
assigned workplace. All used face masks shall be disposed of properly.
These wastes shall be removed from the workplace after each shift.

4.0 Medical Surveillance of the Contractor’s Personnel

The following controls and measures shall be implemented by the Contractor while performing
works inside the Sites.

4.1. The Safety Officer and/or First Aider shall monitor the health symptoms (ILI, diarrhea) of all
of the Contractor’s personnel working inside the Assigned Workplace.

4.2. In the event a Contractor’s Personnel is suspected of having COVD-19 (“Affected


Contractor’s Personnel”), the following actions shall be implemented:

4.2.1. The Affected Contractor’s Personnel shall immediately proceed to the designated
isolation area in the assigned workplace, and shall continue to wear his/her mask.

4.2.2. The Safety Office shall immediately order “STOP WORK”.

4.2.3. The Safety Officer shall inform the Company Representative of the situation.

4.2.4. If needed, the Affected Contractor’s Personnel shall be transported to the nearest
hospital.

4.2.5. The Assigned Workplace and other areas where the Affected Contractor’s
Personnel worked and stayed for a considerable amount of time shall be
decontaminated with an appropriate disinfectant.

4.2.6. The other Contractor’s Personnel present in the area with the Affected Contractor’s
Personnel shall be advised to go home for a 14-day quarantine with specific
instructions on monitoring of symptoms and possible next steps. If the Affected
Contractor’s Personnel has a negative result, the said personnel, together with the
rest of Contractor’s Personnel who went on quarantine may be allowed to return to
work upon the approval of the Company.

5.0 Contact with Company Representatives

5.1. Regardless of the purpose, the Contractor shall only be allowed to engage Company
Representative/s remotely. Should there be a need for a face-to-face interaction, the
Contractor shall first inform the Company Representative remotely, then arrange to meet at
a specified location. Both parties shall comply with all applicable Company protocols on
physical distancing and hygiene controls.

5.2. As a default, documents shall be submitted to the Company through electronic mail. If
unavoidable, one (1) personnel of the Contractor shall go to designated drop boxes to drop
off the document.
