INTRODUCTION

Intertek has produced this Market Update to provide an overview of the impacts to trade, the
regulatory conformity approach and the protocols to be undertaken to enable access to all
markets of Great Britain, Northern Ireland and the European Union from 1 January 2021.
Fundamentally, this document aims to remove the complexity surrounding Brexit for importers,
exporters, and all businesses requiring UK Approved Body services for supplying goods to the
United Kingdom (UK).

Impact to Trade:
The UK market will continue to recognise the CE Mark in the Great Britain (GB) market (England,
Scotland and Wales) until 1 January 2023. After this date, CE Marking will not be accepted and
the UKCA (UK Conformity Assessed) mark, the new UK product marking, will be used for goods
being placed on the market in Great Britain. The new mark covers most goods that previously
required the CE Mark. For the Northern Ireland (NI) market, special marking rules (CE or CE

UKCA MARKING

THE NEW UKCA MARK


The UK Conformity Assessed (UKCA) mark is a new United Kingdom (UK) product mark that
will be used for certain goods being placed on the market in Great Britain (GB) - England,
Wales and Scotland - following the UK’s exit from the European Union (EU). It will replace the
CE mark from 01 January 2023, with the exception of medical products which has a different
transition date of 30 June 2023.
The UKCA mark will be required if you are placing a product in accordance with specific UK
regulations on the GB market (see table below - EU/UK legislation comparison). The new
UKCA mark is to be applied immediately to products after 1 January 2021 if the following
applies:
• It is to be placed onto the market in Great Britain
• It is covered by legislation that requires the UKCA marking
• It requires mandatory third-party conformity assessment
• The conformity assessment has been carried out by a UK Notified Body who has not
transferred the conformity assessment files to an EU recognised Notified Body before 1
January 2021
UKCA marking will be in effect from 1 January 2021. However, to allow businesses time to
adjust to the new requirements, CE marking of product until 1 January 2023 will be accepted
by the GB market. Before 1 January 2021, the CE mark, or other appropriate mark such as the INTERTEK UK
wheel mark or Pi mark, can be applied. In the case of fully manufactured products ready to APPROVED BODY

place on the market before 1 January 2021, these can still be sold in Great Britain with a CE
mark until 1 January 2023.
In certain circumstances the UKCA marking of goods being sold onto the GB market will need
to be applied immediately from 1 January 2021. This is relevant for newly designed product

When placing goods on the UK market, in most cases you will still be able to use the CE mark

IMPLICATIONS FOR CE MARKING & MARKET ACCESS TO BOTH GB & EU


MARKETS
CE Marking for the GB Market
CE marking of a product will be accepted until 31 December 2022 if any of the following
apply:
• Application of the CE mark to a product on a self-declaration basis
• The mandatory third-party conformity assessment was carried out by an EU-27 recognized
Notified Body (including a body in a country with which the EU has a relevant mutual
recognition agreement)
• The certificate of conformity previously held by a UK approved body has been transferred
to an EU-27 recognized Notified Body
A CE marked product can only be placed on the GB market if it meets EU requirements, while
UK and EU requirements are the same. This will be the case from 1 January 2021 as the UK
have no plans to diverge at this time.
Businesses are encouraged to prepare as soon as possible and by 1 January 2023 at the latest.
If the EU changes their legislation and the product is CE marked, and the change differs from
UK legislation, the CE mark product will no longer be accepted by the UK. This will be the case
even if the change happens before 1 January 2023.

CE Marking for both the GB and EU Market


The UKCA marking will not be recognized in the EU or Northern Ireland markets. Products
currently requiring CE marking for sale in the EU will continue to need a CE mark. No action
will be necessary from 1 January 2021 if either of the following apply:
• You self-declare the conformity of your good against the regulations
• You voluntarily use a testing or Notified Body to test against European or international
standards
You will need to take immediate action if your products required mandatory third-party
conformity assessment by engagement with conformity assessment body. If not, you will
need apply for a new certificate from an EU-27 Notified Body.

Using both CE and UKCA Marking


Products can be marked with both CE and UKCA markings providing they are fully compliant
with both UK and EU Directives and Regulations. From 1 January 2021 the essential
requirements and standards that can be used to demonstrate conformity for UKCA marked
products will be the same as they are now. That means that if a product is currently
manufactured to the technical requirements necessary for CE marking, then it will be made
to the same technical requirements that will exist for UKCA marking from 1 January 2021.
However, the conformity assessment bodies that issue Third Party Certificates will be
different.

Selling Goods in the EU


The UKCA mark will not be recognised on the EU market. Products currently requiring CE
marking will still need a CE marking for sale in the EU from 1 January 2021. The CE marking is
required for many products. The CE mark:
• Shows that the manufacturer has checked that these products meet EU safety, health, or
environmental requirements
• Is an indicator of a product’s compliance with EU legislation
• Allows the free movement of products within the European market
By affixing the CE mark on a product, the manufacturer is declaring, on their sole
responsibility, conformity with the legal requirements to achieve CE marking. The
manufacturer is thus ensuring validity for that product to be sold throughout the EEA. This
also applies to products made in third countries which are sold in the EEA and Turkey. For

IMPLICATIONS FOR CONFORMITY ASSESSMENT BODIES STATUS


Changes from 1 January 2021
The new legal framework from 1 January 2021 will enable continuation of market access for
products placed on the market in Great Britain (England, Wales, and Scotland). There are
specific rules which apply for Northern Ireland. Under this new framework:
• Conformity assessment bodies will automatically have their status converted under the
new framework (UK Approved Bodies)
• Existing issued EU identification numbers to UK Notified Bodies on changeover will remain
the same
• A new UK database has been established and replaces the EU’s New Approach Notified
and Designated Organisations (NANDO) database.
The United Kingdom Accreditation Service (UKAS) will continue as the National Accreditation
Body (where relevant).

Conformity Assessment for the EU Market


From 1 January 2021 any mandatory third-party conformity assessment for the EU market
will need to be carried out by an EU recognised conformity assessment body. This includes
both EU based bodies and bodies in countries with which the EU has concluded a mutual
recognition agreement.
From 31 December 2020, UK conformity assessment bodies will no longer be able to conduct
mandatory conformity assessment for products being placed on the EU market.

TRANSITIONAL MEASURES RELATING TO UKCA MARKING


For products that fall under UK regulations and UKCA marking, the following transitional
measures apply:
• From 1 January 2023, goods must affix (other than those subject to special rules) the UKCA
mark on a label, to the product and accompanying documents.
• Products that require the UKCA marking cannot be placed onto the market if the UKCA
mark is not affixed (other than where the CE marking is being used before 1 January 2023,
after which CE marking cannot be used on the GB market).
• From 1 January 2023, UKCA marking shall be affixed directly to all products and
accompanying documents.
Construction products, medical devices, interoperability of the rail system, and transportable
pressure equipment are covered by the UKCA marking; however, the above transitional
measures are not applicable.

TRANSITIONAL MEASURES RELATING TO PRODUCT UKCA MARKING WITH


SPECIAL RULES
Regulating Medical Devices from 1 January 2021
UKCA marking of medical devices is required from 1 January 2021. A route to market and
product marking will be available for UK and non-UK manufacturers wishing to place a device
on the GB and NI markets from 1 January 2021. CE marking will continue to be used and

USING THE UKCA MARK


Affixing the UKCA Mark
UKCA marking is applied to the product and the packaging. It can be applied to the manuals
or other supporting literature, pending which regulations apply. The following general rules
apply:
• UKCA markings must only be placed on a product by the manufacturer or your authorised
representative where specified by a relevant legislation
• The manufacturer takes full responsibility for the product’s conformity with the
requirements of the relevant legislation
• Only use the UKCA marking to show product conformity with the relevant UK legislation
• Do not affix other marking or sign that may misconstrue the meaning or form of the UKCA
marking to third parties
• The UKCA mark cannot be placed on products unless there is a specific requirement to do
so in the legislation.

Rules for Using the UKCA Image


Manufacturers must ensure that:
• If the UKCA mark is reduced or enlarged, the size of your marking, the letters forming the
UKCA marking must be in proportion to the version set out below.
• The UKCA marking is at least 5mm in height – unless a different minimum dimension is
specified in the relevant legislation.
• The UKCA marking is easily visible, legible (from 1 January 2023 it must be permanently
attached)

Technical Documentation
The manufacturer or the authorised representative must keep documentation to
demonstrate that the product conforms with the regulatory requirements in the form of a
technical file, which must be retained for up to 10 years after the product is placed on the
market. The technical file can be requested at any time by UK market surveillance authorities.
In general, the technical file must contain:
• How the product is designed and manufactured
• How the product has been shown to conform to the relevant requirements
• The addresses of the manufacturer and any storage facilities

UK Declaration of Conformity
The UK Declaration of Conformity is a document that must be drawn up for products lawfully
bearing a UKCA marking. The document shall state the manufacturer, or your authorised
representative, and should provide:
• Declaration that the product complies with the relevant UK statutory requirements
• A statement of the name and address of the manufacturer or your authorised
representative
• Information about the product and the conformity assessment body (where relevant)
• A product serial number, model, or type identification
• A statement, stating full responsibility for the product’s compliance
• Details of the UK Approved Body that carried out the conformity assessment procedure (if
applicable)
• Relevant legislation with which the product complies to
• Authorised name and signature
• A date the declaration was issued
• Any supplementary information (if applicable)
• Relevant UK rather than EU legislation
• UK designated standards rather than standards cited in the Official Journal of the European
Union (International or BS EN standards are to be used)

On 1 January 2021, the UK standards will be the same in substance and with the same
reference as the standards used in the EU. However, they will use the prefix ‘BS’ to indicate
that they are standards adopted by the British Standards Institution as the UK’s national
