BOARD RESOLUTION NO.

___ SERIES OF 2022


PROPOSED REGULATIONS, FINES AND OTHER FEES

WHEREAS, ARTICLE IV, Section 3 of the STA. MONICA HOMES HOA, INC. provides
that the association may raise funds for its programs and activities, through
contributions, donations and/or other forms.

WHEREAS, ARTICLE IV, Section 4 of the STA. MONICA HOMES HOA, INC. provides
that the Board of Directors or Trustees may from time to time, assess collect from
each member reasonable amounts as may be necessary to fund a special
community project for the common good and benefit of the association as
approved by the majority of the members of the board and members of the
association.

WHEREAS, a special meeting was held with the Board of Directors last November
_, 2022, wherein a discussion was made on the probable ways and means to
collect
additional funds that could meet the increasing cost and operational expenses of
the Association, additional regulations and regulations to force delinquent
members to pay their association dues.

WHEREAS, in the said meeting, the proposed REGULATIONS, FINES AND OTHER
FEES, are as follows:

REGULATIONS, FINES and OTHER FEES
I. MEMBERS NOT IN GOOD STANDING. In addition to the rules stated in the by-
Laws,
when a bona fide member is considered as a Member not in good standing, the
Board of directors shall post the name/s of these members near at the
entrance of the Subdivision for notice purposes.
Members not in good standing who would want to be reverted to good standing
status can only be done upon full settlement of all the outstanding balance plus
20% (twenty percent) of the overall total as penalty charges.

II. CAR STICKERS. Each member is required to have a car sticker placed in
their car to enter the subdivision. The sticker will serve as an identification
that the car belongs to a bona fide member of the Association.
a. car sticker fee P500.00
b. motorcycle sticker fee P200.00
c. Validity of the sticker - The sticker has a term for one (1) year.

c. Renewal - Upon expiration of the car sticker, a bona fide member can
renew for another term upon payment of the required fee above-stated.
d. Revocation – If a bona fide member is eventually reverted as a
member not in good standing, as provided in the By-laws, the sticker shall be
automatically revoked, and the car be denied entry in the subdivision premises
unless there is an order from the Board that such member is reinstated as a bona
fide member.

RESOLVED, The vehicles of members declared not in good standing shall not be
allowed access to the subdivisions common areas. Only the family members of
the resident declared not in good standing are allowed to enter SMH. Their
respective visitors/guest are not allowed access in the subdivision.

III. DELIVERY FEES. To strengthen the security of the subdivision and to


minimize the ingress and egress of strangers. A bona fide member shall pay
an entrance fee for every entry of the following vehicle:
a. Tricycle – A fee of P50.00.
b. Multicab – A fee of P100.00.
c. Six (6) wheeler – A fee of P150.00
Only food, drinks and medical related deliveries are free of delivery fees.
Any delivery for a delinquent member, as provided by the By-laws, shall not
be allowed to benefit, and should be denied entry to the Subdivision.
Deliveries will be met at the gate. Deliveries made to delinquent members
may be made under extreme circumstances with express consent from the
President of the Association or his OIC for that matter.
Furthermore, any officers or directors elected will be exempted from delivery
fees during their term of office.

IV. PARKING FEES. A bona fide member who uses the parking facility of the
subdivision shall pay a monthly parking fee of P200.00. parking fee shall go to the
Association’s common fund and will be used for
the maintenance of the common area of the subdivision.
Any delinquent member, as provided by the By-laws, shall not be allowed or
to benefit any parking facility of the subdivision.
Provided that any officers and directors duly elected to the association shall
only pay 50% of the parking fees during their term.
Provided further, that parking in the common area is strictly prohibited. Non
residents with car or motorcycle stickers may park in the designated parking areas
for free on the first 24 hours. Subsequent hours will be charged as follows:
a. 1-3 hours – P30.00
b. Succeeding hours is at P10.00 per hour
This rate also applies to vehicles of visitors/guests of members in good
standing immediately upon entry to SMH

V. CONSTRUCTION/WORK PERMIT. To ensure the monitoring of ingress and


egress of strangers, a work permit is needed for every member for any
improvement, maintenance, and the other activities to be done at their
respective home.
a. work permit fee - a fee of P50.00 is hereby imposed for every bona
fide member, provided that if a member is a delinquent member and the repair is
urgent and approved by the board, the fee shall be doubled to the fee of a bona
fide member.
b. Construction workers entrance fee - a fee of P25.00 per head/day is
hereby imposed to members not in good standing if the work is approved by the
board.
c. Validity of the Work permit – the work permit shall only be valid for a week or
less. Work permits shall expire every Saturday of the work week, regardless
whether they are issued midweek. It can be renewed for another week upon
expiration of the permit
VI. NEW OCCUPANTS/RENTERS/NEW OWNERS. To ensure the peace within
the Subdivision, the following documents shall be submitted before any
occupant can reside within the subdivision:
a. RENTRERS
i. NBI or Police Clearance
ii. Notarized copy of lease contract
iii. Recommendation letter from the owner allowing access
to the subdivision.
iv. Settlement of all monetary obligation to the association.
v. Submission of brgy clearance of his/her previous place of residence
vi. Letter of endorsement from owner assuring support to SMH HOA INC. rules
and regulations duly concurred by the renter

b. NEW OWNERS
i. Submit deed of absolute sale
ii. Settlement of all monetary obligation to the association
iii. Letter of endorsement from owner assuring support to SMH HOA INC. rules
and regulations duly concurred by the new owner

VII. Monthly Dues. Whereas, The delivery of basic services such as garbage
collection, maintenance of common areas like street lightings, roads, playground
and the supply of water and the corresponding maintenance and laboratory
examination of the same to ensure consistency of supply and to determine the
potability of the subdivision water supply is of paramount importance. Delays in
the payment of these dues certainly have a profound effect on these basic
services.

RESOLVED, It shall be the obligation of each member to pay or deliver these


payments to our SMHA Treasurer/assigned collector for SMH/HOA monthly dues
and to the subdivision developer’s collection agent for the water and security
dues respectively on or before the cutoff date which is every 5 th day of each
month. A penalty of 2 % shall be imposed on late payments.

VIIIPETS. WHERREAS, the excessive keeping of dog’s results to uncontrollable


barking, disturbing the peace and tranquility of Sta. Monica Homes area as well as
obnoxious odor and other nuisances.

WHEREAS, There is a need to limit the number of dogs in each household to


control and contain the problems associated with too many dogs which are
primarily noise, health and safety connected issues.
WHEREAS, dog waste/excrement is a common problem of pet friendly
subdivisions. If left unattended in common areas, this waste can actually be toxic
or hazardous.
RESOLVED to limit the number of dogs in each household inside SMH to a
maximum of four (4) dogs.

WHEREAS, when walking with dogs, dogs must be kept on short leash when
walking in the neighborhood. Not only is an unleashed dog a danger to itself with
the risk of running into traffic, it can also be dangerous for those present in the
community. Several dog attacks and bites have been reported and experienced
by the residents in the past.

RESOLVED further, that violators will be reported to the Lupon ng Barangay and
the City Veterinary Office for appropriate action. A fine of Php 500.00 will be
imposed to violators per incident.

Resolved further, to encourage to abide and to instill discipline among the SMH
HOA members, the SMH youth is enjoined to enforce this resolution. A 50% of the
penalty to this effect shall be given to the one who can capture/cage these dogs
as a reward money. Captured dogs shall be confined in the subdivision provided
cage for stray animals awaiting proper disposal.

IX Operation of Hostel/Pension Houses.


Whereas, to minimize criminality, ingress, egress of strangers inside the
subdivision premises, the operation of Hostel and pension house like businesses
offering hourly, daily, weekly and monthly rooms for rent is strictly prohibited.

NOW THEREFORE, upon due deliberation and severally moved and seconded, it
was RESOLVED AS IT IS HEREBY RESOLVED that the board
hereby APPROVES the proposed Regulations, Fines and Other Fees.
RESOLVED FURTHER that a GENERAL ASSEMBLY for all bona fide members of the
Association is called for in order to approve the proposed regulations, fines, and
other fees.
RESOLVED FINALLY that a notice on the date of the special general assembly for
purposes of approval on the proposed regulations, fines, and other fees be given
to all bona fide member.
