COMPROMISE AGREEMENT

KNOW ALL MEN BY THESE PRESENTS:

SHAHEEN, of legal age, married, with residence at Brgy. Masukal, Legazpi City, and
hereinafter referred to as the FIRST PARTY; and

TEKKEN FOR GRANTED, a duly registered business with address at Brgy. Masukal,
Legazpi City, herein represented by its General Manager by virtue of a Special Power of
Attorney executed on May 28, 2023, and hereinafter referred to as the SECOND PARTY.

WITNESSETH: THAT
WHEREAS, the FIRST PARTY is the complainant in the Alternative Dispute Resolution
Case No. 0005, titled Complaint on the nuisance caused by loud noise from Tekken for
Grated Bar, pending before the Office of the ADR Officer of Legazpi City;

WHEREAS, the SECOND PARTY is the respondent in the said case;

WHEREAS, the parties voluntarily submitted themselves for Alternative Dispute


Resolution, docketed as ADR Case No. 0005 which sessions were held on February 14, 2023,
March 17, 2023, and May 4, 2023;

WHEREAS, the parties agreed to settle the case amicably, instead of going through the
regular procedure under existing ADR laws, rules and regulations;

NOW THEREFORE, in consideration of the foregoing premises, the parties hereby


undertake as follows:
1. The First Party shall not anymore file any complaint against the noise coming from
the Tekken for Granted Business establishment and the Second Party shall continue
with its business operation without unnecessary interference from the First Party;

2. The Second Party shall pay the First Party of the amount of Five Hundred Pesos (Php
500.00) on a daily basis as a compensation in relation to the noise it endures during
the operation of the business;

3. This Compromise Agreement shall have the force and effect of a final and executory
Decision;

4. That whatever is discussed during the alternative dispute proceedings is considered


Confidential and subject to Non-Disclosure;

5. The Parties agree to the fullest extent applicable, waives and concedes each other’s
claim and let this agreement govern their rights and obligations over the matter
subject of the discussion;

6. The Compromise Agreement is not contrary to law, public order, public policy and
public morals;

7. The Parties bind themselves to faithfully comply with the terms and conditions of this
Compromise Agreement and shall constitute an agreement between parties and
supersedes all prior understandings, agreements and discussions between parties, if
any;

8. The parties executed this Compromise Agreement on their own volition and free will
and the signatories therein hereby represent and warrant that they are duly authorized
to concede and compromise their rights, claims and interests over the subject matter;
IN WITNESS WHEREOF, the parties have hereunto set their hand this June 2, 2023 here at
the Office of the ADR Officer – Legazpi City.

This is to certify that:

1. There has been a personal confrontation between the parties before the Punong
Barangay / Pangkat Tagapagkasundo during the period January 2 to February
2, 2023;

2. There has been no settlement reached by the parties;

3. Therefore, the corresponding complaint may now be filed in court / concerned


government office.
