the court of learned C.J.M . Madhepura vide
Case no 442/2A22 under section 498 A ,323,354,506

marked as annexure l- to this

6. That the'complainant examined on the solemn

affirmation and in course of enquiry two witnesses have

been examined .

7.That the learned S.D.J.M. vide order dated 1,6.12.2A22

found the prima facie case against the accused persons

of the l.P.C.

8,That the petitioner is quite innocent he has committed

no offences and falsely been implicated in this case

10. That there is general and omnibus allegation of

demand of dowry and due to non fulfillment of the

demand of dowry they have committed tortured

11-. That the petitioner submits that he never demanded

dowry and committed torture on the complainant .

12. That the petitioner submits that this case has been

lodged by her after 7 years of his marriage .

13. That the petitioner submits that she made pressure

to live with her in her matrimonial home "When he

finally refused to live in her matrimonial home then she

lodged thls case .

14. That the petitioner submits that always she visited

her matrimonial home and living there.

1-5. That the petitioner submits that when all the

family members were working in the field , she along

with other relatives loaded the two she got, one calf

and house hold articles in a pick up tempo and took

her to her maternal home

16. That it is not specifically mentioned in the

complaint petition that the accused persons

demanded dowry .

17 That it appears from the F.l.R. itself that in the

entire complaint there is specific allegation against

the father-in-law and brother in law under section 354

of the l.P.C. for the outrage of the modesty .

18. That the father-in law and brother in law granted

bail from the court of the learned session judge .

19. That both the witnesses are the relative witness ,

Non of the independent witness examined by the

complainant .

20 . That as per the fact and circumstances of the case

no case is made out against the petitioner .
