HENDERSON LIEUTENANT GOVERNOR Dear Aaron Davidson: Tam writing to follow up on our reconciliation conversation from yesterday on the clerk call as well as the follow-up call with Mark Mitchell and myself, Ballot reconciliation was a key finding of the legislative audit and is a crucial component of election integrity. Reconciliations ensure that the number of people who voted matches the number of votes that were counted. This prevents ballots from being scanned twice, unverified ballots from being scanned, and ensures that every ballot was scanned. Failure to reconcile ballots is hazardous and a violation of the law. Utah Code 20A-4-109 requires the clerk to conduct a ballot reconciliation every time ballots are tabulated and publicly release the results of each reconciliation. Ifthe numbers do not match then the difference needs to be explained. Our office has provided extensive information and training on ballot reconciliation. Here is a sampling of some of the information that has been provided to you: © Chapter 3 of the Legislative Audit ~ A physical copy was given to each county as well as an electronic copy by email January 13, 2023, an email was sent with a draft of standardized canvass statistics, including ballot reconciliation I provided training on reconciliation as part of an HB448 presentation at the UAC Spring Management Conference which you attended at the Salt Palace in April ‘An email was sent to the LGO Notifications on May 2 with slides from the UAC presentation A reconciliation clarification email was sent to the LGO Notifications email list on August 18 and was resent to ‘your staff on August 31" It is my understanding from our conversations that at no point during this election have you performed a reconciliation between the number of ballots tabulated, the number of vote histories, and the number of ballots that were prepared (processed) for tabulation. I asked for those reports in an email yesterday and you told me on the phone you could never reconcile the ballots so you did not do the reconciliation ‘Our conversation yesterday was a good step forward in correcting this issue, and it sounds like you are making progress ‘on getting things reconciled. Moving forward, the law requires you to reconcile ballots in accordance with 20A-4-109. For the remainder of this election, I would like to receive a copy of each reconciliation that you perform every time ballots are tabulated Thank you for your attention to this very important matter.
