Subject: Sale of Immovable Property of Nirala Dairy (pvt) Ltd in Execution

Application-22-B/12 titled Bank of Punjab Vs Nirala Dairy etc situated at
Village Jhok Jhala, Chak No. 409/GB, Tehsil Tandianwala, District Faisalabad

Dear Sir,

The above property was auctioned under Section 19 (3) of Financial

Institution (Recovery of Finances) Ordinance, 2001. We have pursued the complete
file of the execution proceedings pending adjudication in the Honourable Lahore
High Court, Lahore. As of today, there is no injunctive order issued by the
Honourable Lahore High Court as to the transfer of immovable property in favour of
successful bidder nor any Objection Petition is pending on behalf of the judgment
debtors.

In light of the above given information that the objections filed by Mr. Jawad Hassan Munj and
Mr. Naveed Butt assailing the auction proceedings on the date fixed which is 15-06-2022 owing to the
arrangement interse them and the successful bidder, hence, in the forgoing, it seems there is no legal
hindrance in delivering possession of immovable property to successful bidder as well as transfer of
the same into its favour. Unnecessary delay would encourage the Judgment Debtors to thwart the
process. This opinion is being rendered in the best interest of the Bank so the legal action taken by
Bank u/s 19(3) could be concluded and save the parties from hanging in balance for an indefinite
period.
