Subject: Brief: Irish Sugar plc v Commission (1999)

This memorandum covers detailed information of the Irish Sugar case, which are stated
below.
Irish Sugar and its subsidiary SDL practice (facts - neutral):
1. In the late 1980s, Irish Sugar and its subsidiary SDL offered low prices and
provided selective 'border' rebates.
2. Since 1985, Irish Sugar has been providing rebates on bulk sugar purchases, which
variation in sugar tonnage between customers and over time was not consistent
with sales volumes or currency change, to industrial customers who export part of
their final product to other Member States..
 3. Since 1993, Irish Sugar also offered rebates to certain wholesalers and food
retailers that were dependent on increases in their purchases of Irish Sugar’s own
Siucra brand.
Submission of Commission:
1. Irish Sugar had 95% share of the sugar market in Ireland.
2. Irish Sugar abused its position by restricting competition from imports of sugar
from other Member States, sugar packers and industrial customers.
3. Irish Sugar discriminated against customers that supplied only the Irish market.
4. Irish Sugar's sugar rebates distorted the common sugar regime.
5. Irish Sugar caused difficulty for small competitors to gain a foothold (gia nhập) in
the market.
Decision:
1. Abuses of a dominant position by the European Court of Justice for a long time.
Fine:
1. In 1997, the Commission imposed a fine of 8.8 million on Irish Sugar plc, a
subsidiary of the Greencore Group.
