WHETHER the concerned administrative authorities being the respondents hereof, more particularly the Respondent No. 3 hereof miserably failed to initiate appropriate step in terms of its statutory obligation to protect the life and property of the Petitioner hereof without any apt and cogent reasons thereof. I. WHETHER the concerned Commissioner, being the Presiding officer of the Maintenance ttibunal formed in terms of the statutory provision of the Maintenance and Welfare of Parents and Senior Citizen Act 2007 failed to take cognizance of the complaint dated 17.2.2021 of the Petitioner. i. vu. tt WHETHER the concerned Police Personnel being the Respondents hereof, more particularly the Respondent No. 5 hereof miserably failed to discharge its statutory obligation in terms of Police Act 1861 as well as Police Regulation Calcutta 1968, by initiating appropriate steps in terms of their administrative capacity to bring the offenders, being the private Respondents hereof, more particularly the Respondent Nos. 6 & 7 hereof under the surveillance of judiciary in terms of complaint dated 17.2.2021 of the Petitioner in order to protect the fundamental rights of the Petitioner. WHETHER the impugned acts and actions of the concerned Police Personnel being the Respondents hereof, more particularly the Respondent No. 4 hereof tantamount to the gross violation of their statutory obligations in terms of the Police Regulation Calcutta 1968 as well as Police Act 1861. WHETHER the impugned acts and actions of the concemed Administrative authorities ‘being the Respondents hereof is seriously infringed the fundamental rights of the Petitioners envisaged under Articles 14,19,21 and 300A of the Constitution of India is seriously been infringed. WHETHER the impugned acts and actions of the Respondents are nothing but glaring example of abuse process of law. Radhakrishnan, Chief Justice And His Companion Justices of the said Hon’ble Court. The humble Petition on behalf of the Petitioner above named- Most Respectfully Sheweth: i. That'the Petitioner is the law abiding senior citizen of India, presently aged about 71 years, having permanent residence as mentioned in the cause title herein above. 2. That the Respondent No. 1 is the State of West Bengal. For smooth operation and to effect the functionaries of the public administration, it creates several bodies under it, amongst whom the Respondent Nos. 2,3,4 & 5 hereof are the creatures of the Statute and time to. time they have been following the relevant Rules and Regulations enacted for their operational purposes. Hence all of their actions are amenable to the writ jurisdiction, of this Hon’ble Court. The said Respondents are therefore all ‘State’, within the meaning of Article 12 of the Constitution of India, and ‘Person’ or ‘Authority’ within the meaning of Article 226 of the Constitution of India thereof. The Respondent Nos. 6 & 7 hereof has been arrayed here as necessary parties for the purpose of adjtidication of this instant case. 3. The facts of this instant case are hereby chequered and a cursory glance to the same is germane herein below. 4. That a piece and parcel of a land measuring about 4 Cottahs 15 Chittacks 27 sq. Ft. together with a 35 years old Four storied residential building standing thereon comprised within Mouza Dhakuria, J. L. No. 18, lying and situates at Plot No. 1058/1277 under Khatian No. 213 corresponding to the Premises No. 27 B, Gaighata Road( South), under ward No. 92, Police Station: Lake, Kolkata: 700031, being Assessee No. 210921200304, District : South 24 Parganas, originally belongs to one Tarunaditya Rakshit, since deceased, who happened to the Father in Law of the present Petitioner by virtue of a registered deed of sale, being No. 5917 for the year 1960 and subsequently the said. Tarunaditya Rakshit, since deceased by virtue of a registered deed of sale being No. 3350 for the year 1961 transferred 1 Cottah 11 Chittack 25 sq. Ft. to one Amal Kumar Majumder and thus the said Tarunaditya Rakshit, since deceased became the absolute owner of 3 cottah 4 chittack 2 sq. Ft. (more or less) together with 35 years old four storied residential building standing thereon, herein after referred to as ‘said property’. : 5. That the said Tarunaditya Rakshit, the father in law of the present Petitioner expired leaving behind his one son, being the Respondent No. 6 hereof, his wife, namely Smt. Kamala Rakshit, since deceased and one daughter, namely Shila Basak, since deceased, the wife of the present Petitioner and alll of the aforesaid heirs became the joint owners of the ‘said property’. Thereafter said Kamala Rakshit, the mother in law of the present Petitioner expired leaving behind her only son, being the Respondent No. 6 hereof and only married daughter, namely Shila Rakshit, since deceased. The said Shila Basak expired leaving behind her husband, being the present Petitioner and their only daughter Sudeshna Basak as her legal heirs, who entered in to the shoes of co sharers together with the Respondent No. 6 hereof of the ‘said property’. 6. That by virtue of an amicable registered deed of Partition being No, 2013 for the year 2018, took place by and between the Petitioner hereof and his married daughter Sudeshna Basak with the Respondent No. 6 hereof butted and bounded the ‘said property’ for their peaceful enjoyment and thereby seized and possessed in the respective portion of the ‘said property’ by mutating their names and thereby paying the corporation taxes in respected their respective portion of the ‘said property’. Photocopy of the said registered deed of Partition being No. 2013 for the year 2018 is annexed herewith and marked as Annexure P/1. : 7. That be it mentioned that by virtue of the aforesaid deed of Partition being No. 2013 for the year 2018, the Petitioner and his married daughter allotted with the entire first floor of the said 35 years old residential building, measuring about 1600 sq. Ft. super built up area consisting of 5 bed rooms, i living lobby, 2 kitchens, 2 toilets, 2 varandahs and entire 24 floor, measuring about 1500 sq. Ft. super built up area consisting of 3 bed rooms, 1 living cum dining space, 1 kitchen, 1 pantry, 2 toilets, 1 lobby, 2 Varendahs, morefully described in the ‘Third Schedule’ as Lot B in the aforesaid registered deed of Partition being No. 2013 for the year 2018. That save and except the aforesaid allotted portion the parties to the said partition deed have also rights to enjoy the common portion, mentioned in the ‘Fourth Schedule’ of the said Partition deed and the parties to the said Partition deed also undertook their liabilities for maintaining the ‘said property’ more specifically mentioned in the Fifth Schedule’ of the said Partition deed. 8. That the Petitioner is presently aged about 71 years and suffering from various ailments and residing alone in his allotted portion in the ‘said property’ since his married daughter is settled elsewhere and due to exigency of her job, she occasionally visit to meet her father, being the Petitioner hereof. It is needless to mention that presently both the Petitioner and the Private respondents, being the Respondent Nos. 6 & 7 hereof. 9. That the Private Respondents, being the Respondent Nos. 6 & 7 hereof taking advantage of hapless condition of the old aged ailing Petitioner hatched up a criminal conspiracy in order to grab the allotted portion of the old aged ailing Petitioner by forceful means and in pursuance the aforesaid conspiracy the said Private Respondents, being the Respondent Nos. 6 & 7 hereof started to inflict inhuman torture upon the old aged ailing Petitioner. 10, That the aforesaid miscreants, being the Respondent Nos. 6 & 7 hereof on diverse juncture by using their criminal force attempted to obtain signature on a document prepared by the said Respondent Nos. 6 & 7 hereof regarding transfer of the allotted portion of the Petitioner over the ‘said property’ and on being refused by the Petitioner, the said Respondent Nos. 6 & 7 hereof physically assaulted the Petitioner and uttered filthy languages towards him. 11, That on 30,1.2021 at about 8 A M the Private Respondent, being the Respondent No. 6 hereof along with his mother, being the Respondent No. 7 hereof rushed to the premises of the Petitioner and threatened him with dire consequences by imposed strict restriction upon him from accessing his right to the roof of the building, when on being asked by the Petitioner about the reason of such unwarranted attitude of the said Respondent Nos. 6 & 7 hereof, the said miscreants physically abused the Petitioner and the ~ Respondent No. 6 hereof strangulated the neck of the Petitioner with an intent to kill him. However it was the grace of god that somehow the Petitioner able to get rid from the clutch of the aforesaid miscreants, being the Respondent nos. 6 & 7 hereof but thereafter the Petitioner become victimise of physical and mental iorture on regular basis inflicted by the aforesaid miscreants, being the Respondent nos. 6 & 7 hereof. 12, That after the aforesaid date of incident the situation became aggravated day by day and thereby the aforesaid miscreants, being the Respondent nos. 6 & 7 hereof restricted the movement of the Petitioner in the common passages as mentioned in the Fourth Schedule’ of the said Partition deed and practically confined him in his premises in order to pressurised him to bow down before the unethical demands of the aforesaid miscreants, being the Respondent nos, 6 & 7 hereof regarding transfer of the allotted portion of the Petitioner over the ‘said property’ in favour of the aforesaid miscreants. 13. That due to the aforesaid criminating activities of aforesaid miscreants, being the Respondent nos. 6 & 7 hereof the situation now reach to an extreme that the life and property of the old aged ailing Petitioner is at stake which warrants immediate interference of the concerned administrative authorities, being the Respondents hereof. 14, That the Petitioner finding no other alternative made a written representation dated 17.2.2021 with the concerned Presiding Officer, being the Respondent No. 3 hereof and also with the other Respondents, more particularly the Respondent No. 5 hereof interalia expressing his apprehension of his life and property due to the hooliganism activities of the aforesaid miscreants, being the Respondent Nos. 6 & 7 hereof and thereby sought for appropriate protection from the concerned Administrative Authorities, being the Respondents hereof, more particularly the Respondent No. 6 hereof in terms of the relevant provisions envisaged under the Maintenance and Welfare of Parents and Senior Citizen Act 2007 , forthwith without any further delay. Photocopies of the said letter dated 17.2.2021 along with postal receipts are annexed herewith and collectively marked as Annexure P/2. 15, That the hapless Petitioner with utter surprised noticed that the concerned Administrative authorities, being the Respondents hereof, more particularly the Respondent Nos. 3 and 5 hereof inspite of receiving the complaint dated 17.2.2021 of the Petitioner did nothing in discharge of their statutory obligations to protect the fundamental rights of the old aged ailing hapless Petitioner. The aforesaid impugned acts and actions are nothing but glaring example of deliberate failure’ on, the part of the concerned Police Personnel, being the Respondents hereof, more particularly the Respondent Nos. 3 & 5 hereof to discharge their statutory obligations in terms of the relevant provisions envisaged under the Police Act 1861 as well as Police Regulation Calcutta 1968. 16. That the Petitioner submits that traditional norms and values of the Indian society laid stress on providing care for the elderly but due to withering of the joint family system, a large nurhber of elderly, alike Petitioner hereof are not being look after by their family, rather their fundamental rights to lives and properties are under tremendous threat and the Act, being the Maintenance and Welfare of Parents and Senior Citizen Act 2007 , is being introduced by the legislature only to protect the fundamental rights as well as welfare of parents and the Senior Citizen of India. 17, The aforesaid reluctant attitude of the concerned Administrative authorities being the Respondents hereof, more particularly the Respondent Nos, 3 & 5 hereof is tantamount to the gross inaction on the part of the concerned administrative authorities to protect the fundamental rights of the Petitioners envisaged under Article 14,19,21 & 300 A of the Constitution of India by bringing the offender under the surveillance of judiciary, which warrants interference of this Hon’ble Court in its writ jurisdiction by issuing an appropriate writ or writs in the nature of mandamus and/or any other writ or writs like in nature do issue commanding the Respondents more particularly the Respondent Nos. 3 & 5 hereof to initiate’appropriate steps in response of the representation dated 17.2.2021 of the Petitioner hereof and to protect the fundamental rights of the Petitioner in terms of the Maintenance and Welfare of Parents and Senior Citizen Act 2007 , forthwith without any further delay. 18, That the aforesaid inaction of the concerned administrative authorities being the’ respondents hereof, warrants interference of this Hon’ble Court in its writ jurisdiction by issuing a writ and/or writs in the nature mandamus do issue commanding the Respondents, more particularly the Respondent No. 4 hereof to restrain the private Respondents hereof, more particularly the Respondent Nos. 6 & 7 hereof from inflicting any sorts of physical and mental tortures upon the Petitioner forthwith without any further delay. 10 19. That being aggrieved by, and dissatisfied with the impugned acts and actions of the respondents, more particularly the Respondent Nos. 3 & 5 hereof, who failed to discharge its statutory obligation in terms of the relevant provisions of the Maintenance and Welfare of Parents and Senior Citizen Act 2007, your Pétitioner begs to prefer this application under Article 226 of the Constitution of India on the following amongst others: I. tl. Grounds FOR THAT the concerned administrative authorities being the respondents hereof, more particularly the Respondent No. 3 hereof miserably failed to initiate appropriate step in terms of its statutory obligation to protect the life and property of the Petitioner hereof without any apt and cogent reasons thereof. FOR THAT the concerned Commissioner, being the Presiding officer of the Maintenance tribunal formed in terms of the statutory provision of the Maintenance and Welfare of Parents and Senior Citizen Act 2007 failed to take cognizance of the complaint dated 17.2,2021 of the Petitioner. FOR THAT the concérned Police Personnel being the Respondents hereof, more particularly the Respondent No. 5 hereof miserably failed to discharge its statutory obligation in terms of Police Act 1861 as well as Police Regulation Caleutta 1968, by initiating appropriate steps in terms of their administrative capacity to bring the offenders, being the private Respondents hereof, more particularly the Respondent Nos. 6 .& 7 hereof under the surveillance of judiciary in terms Vi. VIL. Vill. ld of complaint dated 17.2.2021 of the Petitioner in order to protect the fundamental rights of the Petitioner. FOR THAT the impugned acts and actions of the concerned Police Personnel being the Respondents hereof, more particularly the Respondent No. 4 hereo! tantamount to the gross violation of their statutory obligations in terms of the Police Regulation Calcutta 1968 as well as Police Act 1861. FOR THAT the impugned acts and actioas of the concerned Administrative authorities being the Respondents hereof is seriously infringed the fundamental rights of the Petitioners envisaged under Articles 14,19,21 and 300A of the Constitution of India is seriously been infringed. FOR THAT the impugned acts and actions of the Respondents are nothing but glaring example of abuse process of law. FOR THAT the concerned Commissioner, being the Presiding officer of the Maintenance tribunal ought to have provided adequate protection to the'life and property of the Petitioner following the Rule 21 of the West Bengal Maintenance and Welfare of Parents and Senior Citizen Rules 2008, in response of the complaint dated 17.2.2021 forthwith without any further delay. FOR THAT the concerned District Magistrate, being the Respondent No. 2 hereof is under statutory obligation to make an enquiry and to direct the concerned Po‘ice Personnel, being the Respondents hereof, more particularly the Respondent No. 5 hereof to provide adequate protection to the old aged ailing Petitioner (Senior Citizen) in response of his complaint dated 17.2.2021 in terms of the Maintenance and Welfare of Parents and Senior Citizen Act 2007 forthwith without any further delay. IX. FOR THAT the concerned Commissioner; being the Presiding officer of the Maintenance tribunal ought to have initiate proceedings against the offender being the private Respondents hereof, more particularly the Respondent Nos. 6 & 7 hereof in terms of the relevant provisions of the Maintenance and Welfare of Parents anc Senior Citizen Act 2007 and thereby secure the protection of the Petitioner so that the old aged ailing hapless Petitioner can spent his rest of his life peacefully. 20. That the Petitioner states and submits that until and unless order as prayed for herein is passed the Petitioner will suffer from irreparable loss and injury. 21, That the Petitioner states that Petitioner has not moved before any Court of Law on the self same cause of action. 22. That the Petitioner states that there is no other alternative remedy available to the Petitioner other than to move this instant Writ Petition. 23. That this Application is made bonafide for the ends of justice. Under the aforesaid facts and circumstances set forth herein above, Your Petitioner most humbly prays that Your Lordship would graciously be pleased to issue: a. A writ of and/or writs in the nature of Mandamus do issue commanding _—the Respondents, more particularly the Respondent No. 3 hereof and its men, agents and subordinates and each one of them to show cause as to why the Respondent No.’ 3 should not be directed to initiate appropriate steps in terms of its administrative capacity initiate appropriate proceedings in terms of the relevant provisions envisaged under the relevant provisions of the Maintenance and Welfare of Parents and Senior Citizen Act 2007 in response of the complaint dated 17.2.2021 of the Petitioner forthwith without any further delay; b. A further writ of and/or writs in the nature of Mandamus do issue commanding the Respondents, 14 more particularly the Respondent Nos. 3& 5 hereof and its men, agents and subordinates and each one of them to show cause as to why the Respondent Nos. 3 & 5 hereof should not be directed to initiate appropriate steps in terms of its administrative capacity to ensure the protection of the life and properties of the Petitioner from the clutch of the Private Respondents hereof, more particularly the Respondent Nos. 6 & 7 hereof forthwith without any further delay; c. A writ of and/or writs in the nature of Prohibition do issue commanding the Respondents, more particularly the private Respondents hereof, more particularly the Respondent Nos. 6 & 7 hereof and its men, agents and subordinates and each one of them to show cause as to why they should not be restrained from restraining the Petitioner 15 from his free movement in the common passages of the ‘said property’ more particularly mentioned in the Fourth Schedule” of thé registered Partition deed by forcible means, forthwith without any further delay; d. A writ of and/or in the nature of Certiorari do issue commanding the Respondents and their men, agents and subordinates and each one of them to transmit the entire Record pertaining to this instant case to this Hon’ble Court forthwith without any further delay for satisfying the same and after being satisfied do the conscionable justice to the Parties that may be administered; e Rule NISI_ in terms of prayers(a), (b), (c) & (a) herein above; £ An interim order by directing the Respondent No. 3 16 hereof to initiate appropriate steps in terms of its administrative capacity in response of the complaint dated 17.2.2021 of the Petitioner by taking cognizance of the offences committed by the Private Respondents being the Respondent Nos, 6 & 7 hereof and to give adequate protection to the Petitioner to protect his life and property in terms of the relevant provisions envisaged under Maintenance and Welfare of Parents and Senior Citizen Act 2007 , forthwith without any further delay; A further interim order by directing the concerned Police Personnel, being the Respondents hereof, more particularly the Respondent No. 5 hereof to initiate appropriate step in terms of the complaint dated 17.2.2021 of _the Petitioner to bring the offenders, being the Respondent Nos. 6 & 7 hereof under the surveillance of judiciary forthwith without any further delay; h. Ad- Interim order in terms of prayers (f) & (g) above; i, And/or pass such further order or orders as Your Lordships may deem fit and proper. For this he has tortured me both physically and mentally. It is pertinent to mention that the said person viz. Parichay Rakshit along with his mother viz, Sudipta Rakshit has been continuously trying to impose their ill-motive upon me to seize my property, and for this they force me every day by using slang language and also inflict torture upon me. Due to this I am deeply concerned about my safety and security in my own house Iam very much afraid due to their brutal activity and in this regard I filed this complaint being a Senior Citizen for safety, security, protection of my life and property from Parichay @ Sunny and his mother Suditpa Rakshit. I stated that a registered amicable: partition deed was made on 22.06.2018 in between Parag Rakshit and myself and my daughter namely Sudeshna Basak at District Sub-Registrar (I) at South-24- Parganas and as per the said registered deed I along with my daughter are the absolute owner of 1* floor measuring about 1600: sq.ft. and 2>¢ floor measuring about 1500 sq.ft. of 27B, Gariahat Road (South), Kolkata -700031, Police Station-Lake, Ward No.92 within the K.M.C.
