Considering request of your firm received vide letter no. AEP/PSPCL/2021- 22/27 dated 01.10.21 regarding non receipt of material, CDP was again _fevised due to COVID-19 (2™ Wave) Force Majure condition vide this office memo no 5019 dated 22.12.21. Ths COP -as per améndment 2 was to deliver the material in 16 lots instead of 7 with CDP’ range from 07.08.20 to 08.01.22. Itwas again conveyed by this office vide memo no, 346 dt. 21.01.2022 that final CDP of PO placed upon your firm has expired on 08.01.2022 but no transformer has been supplied till date and the supplies be expedited immediately or action against your firm shall be initiated. Final 21 days’ notice was served upon your firm vide this office letter dated 09.03.22 which was followed by another 21 days’ notice vide this office letter dated 24.11.22 under “Negligence & Default" Clause No. 04 of the P.O. to complete the supply of 2500 no, DTs. “Negligence & Default" clause no, 04 of the PO is reproduced as below: "In case of any: negligence on the part of a Supplier/Contractor to execute the Purchase-order/Contract with due diligence and expedition and to comply with any reasonable orders, pertaining to any contravention to the provisions of the Purchase-order/Contract, given in writing by the purchaser, the purchaser may give a 21 days-notice in wniting to the Supplier/Contractor to make good the failure/neglecticontravention. In the event the Supplier/Contractor fails to comply with the notice within a timeframe considered to be reasonable by the purchaser, the business dealings shall be suspended /terminated with the firm by the purchaser for a minimum period of three years or in extreme cases, the firm shail be blacklisted forever by the purchaser. Apart from the suspensionftermination of business dealings/blacklisting of the supplier/contractor, the purchaser shall also forfeit the security & other pending payments of the Purchase Order/ Contract against whichxvii) xviil) x00) xxi) the supplier has defaulted, in addition to PEMD/ EMD lying with the concerned organization. No response to any of the above notices was received from you. As a last opportunity to Show Cause for non-compliance of Contract.cum P:O. obligations, you were called for personal hearing in the chamber of CE/MM, PSPCL, Head Office, The Mall, Patiala on 01.06.2023, vide this office memo no. 2089 dt. 15.05.23. It was also conveyed in the notice that if you do not appear for the personal hearing, action regarding suspension of business dealing, forfeiture of security etc. and blacklisting of your firm shall be taken under negligence and default clause of the PO without any further communication in this regard. You neither tumed up for personal hearing nor submitted any written reply in reference to this office notice. It is also pertinent to mention here that as per security clause of the Purchase order your firm had to furnish Bank Guarantee (BG) as per within one month from the date of issue of PO. However despite of various communications/ reminders sent by this office vide memo no, 2837 dt, 23.09.2020, 700 at 02.03.2021, 786 dt. 08.03.2021, 1888 dt. 20.05.2021, 3552 dt. 04.08.2021 and 4854 dt. 09.11.2021, your firm failed to furnish requisite BG in lieu of Security amount to this office. Instead your firm kept stressing upon that the amount of BG may be deducted from the running bill to be raised against supplied material. it was conveyed by this office time and again that the security amount is to be deposited in the form of BG only as per PO, so the request regarding deduction cannot be-accepted and security amount in the form of BG be given.
