JUDICIAL AFFIDAVIT OF DAEDELUS C. LOPEZ

The examination of the above-named witness which resulted in the

execution of this judicial affidavit was conducted and/or supervised by
ATTY. ESTHER MARIE S. RINGON at the Ringon Law Office, Purok
Lusaran, Barangay Dao, Pagadian City, at 10:40 o’clock in the morning.

Purposes of the testimony. The testimony is offered to support the

plaintiff’s allegation in her complaint specifically that:

a. She is the City Assessor of Pagadian City and now reporting at

Pagadian City Assessor’s Office, City Hall Compound, Pagadian City,
Zamboanga del Sur;
b. Part of her duties is to keep records of approved documents and files
specifically Approved Subdivision Plan submitted to their office;
c. She has records of the approved subdivision plan of Lot No. 10187,
PLS-119, submitted by Helen E. Ramones et.al which was surveyed on
June 15, 1993 and eventually approved on July 19, 1993;
d. She has records of the Tax Declaration of Real Property with ARP No.
2019-003541 owned by the plaintiff, Carmencita T. Lastimado;
e. Such other matters as may be relevant to the instant case;

1. Q: Madam Witness, for the record, please state you name, age,
citizenship, and occupation.

 A: I am DAEDELUS C. LOPEZ, 51 years old, Filipino, and the City
Assessor of Pagadian City.
2. Q: You are testifying in your official capacity as City Assessor of
Pagadian City?
A: Yes, I am.
3. Q: As City Assessor, can you tell us in gist what your functions are?
A: My functions are to appraise and assess all real properties within
Pagadian City.
4. Q: You mean to say that you would have personal knowledge whether
an application or a document was submitted and filed in your office?
A: Yes. Every document related to the transfer of a real property
will pass through the Office of the City Assessor.
5. Q: Madam Witness, are you familiar with this Approved Subdivision
Plan submitted by a certain HELEN E. RAMONES to the City Assessor’s
Office?
A: Yes, I am.
6. Q: How did you know about such fact?
A: It is a pre-requisite in the issuance of a tax declaration for
taxation purposes.
I have a record of the Approved Subdivision Plan issued in the name
of Helen E. Ramones. In fact, I have with me a copy of the said Approved
Subdivision Plan.
Your Honor, we respectfully pray for the marking of the approved
Subdivsion Plan as our Exhibit J to form an integral part hereof.
7. Q: And the said document was the basis for the issuance of Tax
Declaration in her favor?
A: Yes.
8. Q: Do you have anything more to add?
A: Yes. The Office was able to issue tax declaration in the name of
Carmencita Lastimado per ARP No. 2019-003541.
Your Honor, we respectfully pray for the marking of the approved
Subdivision Plan as our Exhibit K to form an integral part hereof.

 I am executing this affidavit to attest to the veracity of the foregoing
averments. I hereby undertake that I fully understand the questions asked
of me in this affidavit, I am fully conscious that I am under oath, and that I
may face criminal liability for false testimony or perjury;

and the answers of the witness; and
