AFFIDAVIT OF DESISTANCE

I, IMELDA C. AZAÑA, of legal age, Filipino, and a resident of Purok 4, Barangay

Baybay, Tiwi, Albay, assisting BELEN A. CORTEZA, my daughter, a minor and living with
me at Purok 4, Barangay Baybay, Tiwi, Albay, after having been duly sworn to in accordance
with law hereby depose and state:

1. That we are the complainants against ROLLY CLUTARIO y CUYA, for Violation of
Sec. 5 (b) of RA 7610 with a Criminal Case Number T-8528 and T-8529 pending
before Family Court 3;

2. That after careful deliberation we are no longer interested in criminally and/or

civilly prosecuting the case against ROLLY CLUTARIO y CUYA;

3. That I am executing this affidavit in my own free will and volition for the purpose of
signifying my intention to refrain from further prosecuting the aforementioned
accused and hereby waive all my rights pertaining to the said incident, now and
hereafter;

4. That we have fully read the foregoing statements and the contents thereof has been
read and translated to us in Bicol dialect, which we understand and that the same
are true and correct to the best of our knowledge and belief.

IN WITNESS WHEREOF, we have hereunto set my signature this February 7, 2022 at

Tabaco City.

who is personally known to me to be the same person who caused the execution of this
affidavit and acknowledged before me that he/she voluntarily executed the same.s
