A BILL
To prohibit the Administrator of the Environmental Protec-
tion Agency from finalizing, implementing, or enforcing
a proposed rule with respect to emissions from vehicles,
and for other purposes.

1 Be it enacted by the Senate and House of Representa-


2 tives of the United States of America in Congress assembled,
3 SECTION 1. SHORT TITLE.

4 This Act may be cited as the ‘‘Choice in Automobile


5 Retail Sales Act of 2023’’.

5 The Administrator of the Environmental Protection


6 Agency may not finalize, implement, or enforce the pro-
7 posed rule titled ‘‘Multi-Pollutant Emissions Standards
8 for Model Years 2027 and Later Light-Duty and Medium-
9 Duty Vehicles’’ published by the Environmental Protec-
10 tion Agency in the Federal Register on May 5, 2023 (88
11 Fed. Reg. 29184).
12 SEC. 3. ENSURING TAILPIPE REGULATIONS DO NOT LIMIT

13 THE AVAILABILITY OF NEW MOTOR VEHI-

14 CLES.

15 (a) IN GENERAL.—Section 202(a)(2) of the Clean


16 Air Act (42 U.S.C. 7521(a)(3)) is amended—
17 (1) by striking ‘‘(2) Any regulation’’ and insert-
18 ing ‘‘(2)(A) Any regulation’’; and
19 (2) by adding at the end the following:
20 ‘‘(B) Effective beginning on the date of enact-
21 ment of this subparagraph, any regulation pre-
22 scribed under paragraph (1) (and any revision there-
23 of), including any such regulation or revision pre-
24 scribed before the date of enactment of this subpara-
25 graph, shall not—

1 ‘‘(i) mandate the use of any specific tech-
2 nology; or
3 ‘‘(ii) result in limited availability of new
4 motor vehicles based on the type of new motor
5 vehicle engine in such new motor vehicles.’’.
6 (b) NECESSARY REVISIONS TO REGULATIONS.—Not
7 later than 24 months after the date of enactment of this
8 Act, the Administrator of the Environmental Protection
9 Agency shall promulgate such revisions to regulations as
10 may be necessary to conform such regulations to section
11 202(a)(2)(B) of the Clean Air Act, as added by subsection
12 (a).
