JUDICIAL AFFIDAVIT
I MYRENE GANZON ESTARES, of legal age, Filipino citizen,
married, and a resident of 183 Lopez Jaena Street, Jaro, Iloilo City,
Philippines, personally appearing before Atty. Mel Phildrich D. Ganuhay
who conducted this examination at Third Floor, Tibiao Bakery Building,
Jalandoni St., corner Ma. Clara Avenue, Iloilo City, after having sworn,
hereby answer the following questions that were propounded in hiligaynon a
language known and understood by the witness:

1.) Question (Q): Can you please explain why are you here at our law office
today?

Answer(A): I am here to give my testimony in this case.

Translation: (Q): Pwede mo ma explecar kung ngaa ari ka di subong

sa amon nga law office?

(A): Ari ako di subong para mag hatag sang akon testimonya sa kaso.

2.) (Q): What do you have to say concerning this case?

(A) : I was the one who discovered the destruction of the fence of the
plaintiffs and the sudden construction of the concrete wall by Eufemia
Salcedo.

Translation: (Q): Anu ang ma hambal mo parte sa kaso nga ni?

 (A): Ako ang naka diskubre sang pag guba sang kudal sang mga naga
akusar kag sang pag patindog sang concreto nga pader ni Eufemia
Salcedo.

3.) (Q): When did this incident happened?

(A): It happened on 20 July 2021.

Translation: (Q): Sang san o and insidente nga ni natabo?

(A): Natabo ini sang ika 20 sang hulyo tuig 2021.

4.) (Q): You mentioned that you discovered the destruction of the fence, and
the sudden construction of the concrete wall, how do you know that it
was Eufemia who caused the erection of the concrete wall?

(A) : Because, she was the one supervising the destruction of the old fence
and the construction of the concrete walls.

Translation: (Q): Gin hambal mo nga ikaw ang naka diskubre sang
pag guba sang kudal kag sang gulpi nga pag patindog sang concreto nga
pader, paano mo na hambal nga si Eufemia ang nag pa tindog sang
concreto nga pader?

(A): Tungod sya ang naga bantay sang pag guba sang daan nga kudal
kag sang pag patindog sang concreto nga pader.

5.) (Q): You mentioned that Eufemia caused the construction of the concrete
wall, did the plaintiffs protested the construction of the concrete wall
over the property?

(A): Yes, the plaintiffs protested the construction of the concrete wall, in
fact the matter was even reported before the barangay captain.

Translation: (Q): Gin hambal mo nga si Eufemia ang nag patindog

sang pader, wala bala nag reklamo ang mga tag-iya sang pag patindog
niya sang pader sa ila duta?

(A): Huo, Nag reklamo ang mga tag-iya sang pag patindog sang
concreto nga pader sa ila duta, sa tuod lg gane gin report pa ina sa
barangay kapitan.

6. ) (Q): After the protest, did Eufemia still continued the construction of the
wall despite the protest of the plaintiffs?

(A) : Yes, she continued with the construction of the wall despite the protest
of the plaintiffs.

 Translation: (Q): Pag ka tapos sang ila protesta, gin padayon bala ni
Eufemia ang pag patindog sang pader biskan nag protesta na ang mga
tag-reklamo?

(A): Huo, gin padayon gyapon ang pag patindog sang pader biskan nag
protesta ang mga tag-reklamo.

7.) (Q): You mentioned that the matter was reported before the barangay
captain, how did you come up with this information?

(A) : Yes the matter was reported before the Barangay captain, I came up
with the said information because I am one of the witnesses before the
barangay of the said incident as indicated in the Barangay record.

Translation: (Q): Gin hambal mo nga gin report ini sa Barangay

Kapitan, Paanu mo nabal an nga ini nga impormasyon?

(A) : Huo gin report ini sa Barangay Kapitan, Nabal an ko ang impormasyon
nga ni tungod isa ko sa mga “witnesses” sa barangay sang incidente nga ini,
amuh na ang naka sulat sa barangay record.

8.) (Q): I am showing you a copy of the barangay record, is this the
document that you refer to?

(A) : Yes, that I am referring to that document.

Translation: (Q): Gina pakita ko sa imo ang kopya sang barangay

record, amu bla ini ang dokumento nga gina tumod mo?

(A): Huo, amu ina ang gina tumod ko.

Manifestation of counsel: We request the Honorable Court that this

Barangay report be marked as Exhibit “E”.

9.) (Q): Do you have any more to add?

(A): None at the moment.

Translation: (Q): May e dugang ka pa?

(A): Wala na sa subong.

10.) (Q): Do you confirm the allegations you made herein?

(A): Yes.

Translation: (Q): Gina conpermar mo ang mga alegasyon nga gin

himu mo diri?

 (A): Huo.

11.) (Q): In answering the questions herein, do you swear to the truth
thereof, and are you fully conscious that you are under oath, and may face
` criminal liability for false testimony or perjury?

(A): Yes, I swear to the truth hereof, and that I affirm that I am fully
conscious that I am under oath and may face criminal liability for false
testimony or perjury

Translation: (Q): Sa pag sabat mo sang mga pamangkot diri, gina

sumpaan mo bala ang kamatuuran sini kag kabalo ka bala nga pwede ka
mapasakaan sang kaso nga criminal para sa pag binutig ?

(A): Huo, gina sumpaan ko ang kamatuuran sini, kag kabalo ako nga
pwede ako mapasakaan sang kaso nga criminal para sa pag binutig.

citizen, single and with postal address at Third Floor, Tibiao Bakery Bldg.,
Jalandoni Street, Corner Ma. Clara Avenue, Iloilo City, Philippines, after
having sworn hereby state that:

1.) I was the lawyer who conducted and supervised the examination of
MYRENE GANZON ESTARES in relation to her judicial affidavit in the
above - captioned case;

2.) I faithfully recorded or caused to be recorded the questions I asked Mrs.

Estares and the corresponding answers she gave me;

3.) Neither I nor any other person present coached Mrs. Estares regarding
her answers;

4.) I swear to the truth hereof, and that I affirm that I am fully conscious that
I am under oath, and may face disciplinary action, including disbarment, for
false attestation.
