DEFENDANT, through the undersigned Counsel, pursuant to the Judicial Affidavit Rule
(Supreme Court’s A.M. No. 12-8-8-SC), respectfully submits the Judicial Affidavit of DINO
GARCIA, to serve as his direct testimony and its purpose are as follows:

PURPOSES:
1. To specifically denies the material allegations in the complaint and prove that there is
a Contract of lease between him and the complainant;
2. To identify the documents and the signature; and
3. To prove other related matters.

JUDICIAL AFFIDAVIT
(Direct Testimony of Dino Garcia)

I Dino Garcia, of legal age, single, Filipino and with residence and postal address at Purok 1,
Pantay Fatima, Vigan City, Ilocos, after having been sworn to according to law, hereby depose
and say THAT:

I am executing this Judicial Affidavit in relation to the above-captioned case and that I was
interviewed by Atty. Ignacius C. Tablada and Atty. Phrexilyn D. Pajarillo at their law office,
TABLADA & PAJARILLO LAW OFFICES located at Natayag Building, Tamag, Vigan City,
Ilocos Sur

I am fully aware that I have answered the questions under oath and that my answers are of my
own personal knowledge and information. Without being coached or coerced, I have voluntarily
and freely answered the questioned propounded to me;

JUDICIAL AFFIDAVIT PROPER

1. Q: Do you swear to tell the truth and nothing but the truth?

A: Yes, I do.

2. Q: Are you aware that you may face criminal liability for false testimony of
perjury if you will not tell the truth?

A: Yes, I am.

3. Q: Please state your name, age and other personal circumstances, Madam
witness

A: I am Dino Garcia, of legal age, single, Filipino and with residence and
postal address at Purok 1, Pantay Fatima, Vigan City, Ilocos

4. Q: Since when are you living at Purok 1, Pantay Fatia, Vigan City?

A: Since, 2010, sir.

5. Q: Why are you present here today?

A: I came to your office to execute my Judicial Affidavit in the allegations of

Consuelo Dela Cruz which was filed before MTC-Vigan Branch for FORCIBLE
ENTRY docketed as Civil Case No. 1234567

6. Q: How do you know the complainant, Consuelo Dela Cruz?

 A: She is my lessor, ma’am.

7. Q: In the complaint of Consuelo, she claims, among other things, that you
occupied her property found at Purok 1, Pantay Fatima, Vigan City, Ilocos
without her permission?

A: When we occupied the property it was based on the premise that we have a
lease agreement

8. Q: Do you know Corazon Dela Cruz?

A:Yes, ma’am. She is the sister as well as attorney-in-fact of Consuelo Dela

Cruz

9. Q: How do you know that Corazon DELA CRUZ is the attorney-in-fact of

Consuelo Dela Cruz?

A:She is the one who signed our Contract of lease ma’am and she is equipped
with the SPECIAL POWER OF ATTORNEY signed by Corazon ma’am.

10. Q: Do you have a Lease Contract?

A: Yes, ma’am.

11. Q: For how many years is you lease contract?

A: For Five years, ma’am, starting January 1, 2020

12. Q: How much did you pay for your rentals

A: I paid ONE HUNDRED TWENTY THOUSAND (PHP 120,000) for the

first year ma’am and also deposited an amount of SIXTY THOUSAND (PHP
60,000) for this year 2021.
 13. Q: I have no more questions to ask you Miss Witness, are you willing to sign
your affidavit to attest to the truthfulness of the allegations herein.

A: Yes, Ma’am

That we personally conducted the foregoing examination to the witness-affiant Dino
Garcia at our office TABLADA and PAJARILLO LAW OFFICES;
That we faithfully recorded and translated into English language the questions asked of
him and the corresponding answers that he in response to the questions asked;
Neither we nor any other person or persons coached or coerced this witness-affiant
regarding the answers given by him.
