The Plaintiff bank most respectfully showeth:

1. That the above captioned matter is pending

adjudication before this Hon'ble Court and the same is

fixed for today itself.

2. That this Hon'ble Court was pleased to issue the notice

of above captioned matter to the Defendants at the

addresses which is mentioned in the Memo of Parties

iled on behalf of the plaintiff bank but the notice

issued to the Defendant No.3 received back unserved.

3. That it is most respectfully submitted that the Plaintiff

has only address of the Defendant No.3, which are

mentioned in the Memo of Parties filed on behalf of the

plaintiff in the present case. It is further submitted

 that the addresses mentioned in the Memo of Partiees

are correct last known address of the Defendant No.3

as per records maintained by the plaintiff bank and no

other address is available with the plaintiff bank.

4. That in the facts and circumstances mentioned above

it becomes necessary that the Defendant No.3 be

served througha substituted service by way of

publication in local newspaper.

5. That in view of the above mentioned it is most

respectfully prayed to this Hon'ble court that the

Defendant No.3 may kindly be served by way of

publication in local newspaper "Vir Arjun" and the

notice of publication may kindly be given dasti, in the

interest of Law and Justice.

It is prayed accordingly
