Acebedo Optical Co. vs. Court of Appeals

In this case, it has shown that police power in state was compromised against the
petitioner as the petitioner regain an issuance of license for its business, optical shop.
The petitioner lost his prior license on July 19, 1989 upon the legal deliberation of case
that was being filed against the petitioner by the private respondent Samahan ng
Optometrist sa Pilipinas (SOPI). Their complaint was considered as it shown the
violation of the petitioner to the condition set to its prior business permit.

The petitioner sought a reinsurance of permit to engage in business wherein it does not
provide any practices of optometry. The reinsurance of permit was then granted with the
decision of Court of Appeals and the respondent City Mayor as the petitioner qualified in
submitting a valid certificate of registration as optometrist, from the Board of Examiners
in Optometry.

In this case it has shown the impact of police power and the power of taxation. The
appellees sought the justification of the passed Ordinance No. 4760 by the Municipal
Board of Manila. The verdict justified that such ordinance is valid and it can be
exercised through police power. Such ordinance, can mandate right and just taxation.
