It is submitted that Anendsure-A14 and A15 orders have been passed in blatant violation of the guidelines laid down as per Annexure-A1 and A2 whereby it has been laid down that the husband and wife shall be posted in the same station mandatorily. Therefore, in accordance with the said orders the respondents are legally bound to give a transfer and posting to the applicant's husband to AMS CIAL Kochi where there are 3 posts lying vacant. Therefore, the action of the 3” respondent in transferring the applicant , that to in her absence, is absolutely illegal, arbitrary, unfair, —_unreasonable, discriminatory and violative of Article 14 of the Constitution of India. Elvin Peter P.J. and K.R. Ganesh, Advocates, St. Benedict Road (West End), Cochin- 18, and that of the Respondents is as shown above. 1. DETAILS OF APPLICATION. 1. Particulars of the order against which the application Is made: The above Original Application has been filed against Annexure-A14 and A15. Being aggrieved, the applicant is filing this Original Application before this Hon’ble Tribunal. 2. Tril The applicant declares that the subject matter of the case is within the jurisdiction of this Hon’ble Tribunal. 3. Limitation: ‘The applicant further declares that the application is within the limitation period prescribed in Section 21 of the Administrative Tribunals Act, 1985. 4 = EF leadii it here below: 1, The applicant entered service as Scientific Assistant in the India Meteorological Department, Chennai Region in the year 2019 and she was posted as Scientific Assistant In the office of the Aeronautical Meteorological Station functioning in the Cochin International Airport, Nedumbassery. It is submitted that there are 4 sanctioned posts of Scientific Assistant in the Aeronautical Meteorological Station at the International Airport. The applicant is the only Scientific Assistant presently working and 3 posts of Scientific Assistant sanctioned in the office are lying vacant. 2. The applicant's husband, Sri, Midhun C., is also employed as Scientific Assistant In the India Meteorological Department and is working at Regional Meteorological Centre, Chennai at Nungambakkam. The applicant's husband was posted as scientific Assistant in the above office in Chennai in the year 2019 on his first appointment and presently he has completed more than four and a half years of service in the said station. In accordance with the transfer policy followed by the Meteorological Department laid down by the Department of Personnel and Training, the minimum tenure of service in a station prescribed is 3 years. The above tenure of service in a station has been laid down by the Department of Personnel and Training in OM dated 02.07.2015. Thus, the applicant's husband has completed the minimum tenure of service and as on today has completed four and half years of service in the same station and hence, he is entitled to be considered for transfer to other stations. 3. The Department of Personnel and Training, considering the utmost importance attached to the enhancement of women’s status in all walks of life and to enable them to lead @ normal life as also to ensure the education and welfare of the children, laid down the guidelines for transfer as per OM No. 28034/7/86-Estt.(A) dated 3.04.1986 and thereafter it was reiterated by issuing OM No. 28034/2/97-Estt.(A) dated 12.06.1997. in the above orders, it was laid down by the Department of Personnel and Training that the husband and wife, who are in Government Service, shall be posted in the ‘same station and thereafter, the Department of Personnel and Training issued order dated 23.08.2004 directing all the ministries and departments and Central Government departments to follow the above guidelines directing to post the husband and wife in the same station in letter and spirit, Thereafter, the Department of Personnel and Training, considering the importance of enhancing women’s status in all walks of life and to ensure the education and welfare of the children, considered the question as to whether the guidelines issued In OM dated 03.04.1986 and 12.06.1987 directing that the husband and wife shall be posted in the same station could be made mandatory, issued OM dated 30.09.2009 directing that the directions issued in the earlier Oms referred to above directing the husband and wife to be posted in the same station shall be made mandatory. True copy of the OM F. No, 28034/9/2009-Estt.(A) dated 30.09.2009 Is produced herewith and marked as Annexure A1, In Annexure Al order, in paragraph 2, it has been lald down as follows: "2. In the Context of the need to make concerted efforts to increase representation of women in Central Government Jobs, these guidelines have been reviewed to see whether the instructions could be made mandatory. It has been decided that when both spouses are in same Central Service or working in same Deptt. and if posts are available, they may mandatorily be posted at the same station.” In paragraph 4, the guidelines issued applicable to the applicants herein reads as follows: “4(ili). Where the spouses belong to the same Central Service” - The Cadre controlling authority may post the spouses to the same station.” Annexure Ai was thereafter again reiterated by the Department of Personnel and Trainingby issuing OM dated 24.11.2022. True copy of the OM No. DOPT-1669289899529 dated 24.11.2022 is produced herewith and marked as Annexure A2. In Annexure A2 order as well, the Department of Personnel and Training has laid down that the direction Issued in Annexure Al to post husband and wife in the same station has to be followed mandatorily. 4. From the facts stated above, it is clear that the applicant and the applicant's husband, Sri. Midhun C, are both working as Scientific Assistant in the same central service namely, the Meteorological Department of India, Further, at Present, in the office of the Meteorological Department in the CIAL, where the applicant is working, there are 3 posts of Sclentific Assistant lying vacant. Hence, in the light of Annexures Al and A2 orders issued by the Department of Personnel and Training directing that the husband and wife working in the same central service shall be mandatorily Posted in the same station and considering the fact that there are 3 vacant posts of Scientific Assistant in the Meteorological Department at CIAL, the applicant's husband, Sri. Midhun C., submitted a representation dated 11.07.2022 before the 3% respondent requesting to give a transfer to the applicant's husband, Sri, Midhun. C., as Scientific Assistant to the office of the Meteorological Department at CIAL. True copy of the said representation dated 11.07.2022 is produced herewith and marked as Annexure-A3, Though Annexure-A3 representation was submitted as early as 11.07.2022, no action was taken on the same and no orders were passed, In the above circumstances, the applicant submitted a representation dated 19.08.2022 before the 3“ respondent requesting to give a transfer and posting to the applicant's husband, Sri. Midhun C. to Aeronautical Meteorological Station at CIAL. True copy of the said representation dated 19.08.2022 submitted by the applicant before the 3” respondent is produced herewith and marked as Annexure- Ad, In Annexure-A4 representation, the applicant pointed out that the both the parents of the applicants were having health problems and that they are under the care and custody of the applicant and further, the applicant also submitted that the applicant is the only Scientific Assistant in the present station and therefore, even for genuine reasons, the applicant could mot avail any leave. Annexure A4 representation was forwarded by the Officer-in- Charge of the applicant as per her communication No. 102/GA-03/Pers. dated 23.08.2022. True copy of the said communication dated 23.08.2022 is Produced herewith and marked as Annexure-A5. Even Annexure-A4 did not evince any response from the 3” respondent. 5. In paragraph 6 of Annexure-Al, it Is laid down that representations for redressal of grievance for non-compliance of the guidelines issued in Annexures A1 and A2 shall be submitted before the higher authority. In the above circumstances, the applicant's husband, Sri. Midhun C, submitted a representation dated 15.12.2022 before the 1* respondent requesting to give a transfer and posting to the applicant's husband to Kochi, where the applicant is working in accordance with the guidelines issued in Annexures-A1 and A2. Along with the said representation, the applicant's the AMS at CIAL. Further in the Kochi RS/RW, though there are 5 sanctioned posts of Scientific Assistant, 3 posts of Scientific Assistants are lying vacant. In Trivandrum Meteorological Centre, the sanctioned strength of Scientific Assistant is 28, out of the above atleast 10 posts of Scientific Assistant are lying vacant. Hence, it is clear that the applicant's husband was in fact entitled for a transfer and posting in the light of Annexure Al and A2 mandatorily to one of the posts of Scientific Assistant lying vacant at AMS CIAL or in accordance with the guidelines of transfer, he was entitled to be given a transfer and posting to elther Kochi RS/RW or to Trivandrum MC to one of the vacant posts as he had already completed more than four and half years of service in Chennai. After receipt of the applications submitted pursuant to Annexure A7 and A8, the 2™ respondent issued order dated 13.04.2023 effecting transfer in the Department. True copy of the Order No. A-22041/01/22-E(2)/SG dated 13.04.2023 issued by the 2" respondent Is produced herewith and marked as Annexure-A10. As per Annexure-A10 order, as many as 33 Scientific Assistants working in the Department were given transfer and posting to the stations opted by them. However, the applicant's husband alone was not given a transfer and posting. It can be further seen from Annexure A10 that the 3 vacant posts of Scientific Assistant at Kochi RS/RW and 10 vacant posts of Scientific Assistants at Trivandrum MS were also left unfilled and no transfer and postings were given as per Annexure A10 to the above vacant posts. In the above circumstances, the applicant’s husband, Sri. Midhun C, submitted a representation before the 1% 10 respondent again requesting for a transfer and posting to AMS CIAL, Kochi. True copy of the said representation dated 28.04.2023 Is produced herewith and marked as Annexure- ALL. Since no orders were passed on Annexure A11, the applicant submitted a representation dated 03.06.2023 to the Secretary, Department of Personnel and Training. True copy of the said representation dated 03.06.2023 is produced herewith and marked as Annexure-A12, As per Annexure A12 representation, the applicant highlighted the hardships and difficulties suffered by the applicant for non-considering the request of the applicant's husband to the same station before the Secretary, Department of Personnel and Training. On receipt of Annexure-A12 representation, the Secretary, Department of Personnel and Training as per his communication dated 19.06.2023 forwarded Annexure A12 representation to the 1* respondent. True copy of the communication dated 19.06.2023 of the Secretary, Department of Personnel and Training forwarding Annexure A12 representation to the 1* respondent is produced herewith and marked as Annexure-A13, It is understood that on Feceipt of Annexure A12 representation, the 1% respondent had sought for explanation from the 3" respondent as to why the applicant’s husband Is not given a transfer to the station Where the applicant is working in the light of Annexures At and A2 mandatory directions issued by the Department of Personnel and Training. 7. Immediately on receipt of the above query raised by the 1* respondent, the 3 respondent got infuriated by the query 10 respondent again requesting for a transfer and posting to AMS CIAL, Kochi. True copy of the said representation dated 28.04.2023 is produced herewith and marked as Annexure- All. Since no orders were passed on Annexure Ali, the applicant submitted a representation dated 03.06.2023 to the Secretary, Department of Personnel and Training. True copy of the seid representation dated 03.06.2023 is produced herewith and marked as Annexure-A12. AS per annexure A12 representation, the applicant highlighted the hardships and difficulties suffered by the applicant for non-considering the request of the applicant's husband to the same station before the Secretary, Department of Personnel and Training. On receipt of Annexure-Ai2 representation, the Secretary, Department of Personnel and Training as per his communication dated 19.06.2023 forwarded Annexure A12 representation to the 1% respondent. True copy of the communication dated 19.06.2023 of the Secretary, Department of Personnel and Training forwarding Annexure A12 representation to the 1 respondent is produced herewith and marked as Annexure-A13, It is understood that on receipt of Annexure A12 representation, the 1% respondent had sought for explanation from the 3" respondent as to why the applicant's husband Is not given a transfer to the station where the applicant is working in the light of Annexures Ai and A2 mandatory directions issued by the Department of Personnel and Training. 7. Immediately on receipt of the above query raised by the 1* respondent, the 3" respondent got infuriated by the query u raised by the 1* respondent on the representation submitted by the applicant and immediately issued an order dated 06.09.2023 transferring the applicant with immediate effect from AMS CIAL, Kochi to Regional Meteorological Centre, Chennai. True copy of the order No. ---/A-22014/III/2023- Esst. dated 06.09.2023 transferring the applicant from AMS CIAL Kochi to RMC Chennai issued by the Administrative Officer on behalf of the 3" respondent is produced herewith and marked as Annexure-A14, In Annexure-A14 order, it is stated that the applicant will not be eligible for any TA/DA which is normally granted to an employee on his transfer in ‘ the Department. Annexure A14 order was transmitted to the AMS CIAL Kochi by email and it was not served to the applicant. Immediately on receipt of Annexure A14, on the specific directions Issued by the 3" respondent, the officer in charge at AMS CIAL, Kochi relieved the applicant on 08.09.2023. True copy of the Order No. 110/GA-03/ADMN (P-T) dated 08.09.2023 relieving the applicant is produced herewith and marked as Annexure-A15. Immediately on receipt of Annexures A14 and A15, the applicant submitted a representation dated 09.092023 before the 2" respondent pointing out the illegality in transferring the applicant and requesting to retaining the applicant at AMS CIAL, Kochi. True copy of the sald representation dated 09.09.2023 is produced herewith and marked as Annexure -A16. It is submitted that the applicant has been on medical leave from 02.09.2023 and Annexure-AiS, order has been Issued relieving the applicant in her absence. It is trite that relieving an officer should be in the presence of the said relieved officer. Thus, it can be seen that though the applicant's husband had been submitting representations since 11.07.2022 more than 1 and half years back, seeking for a transfer to the station where the applicant is working which has been directed to be granted mandatorily in Annexures A1 and A2 orders and though the applicant and the applicant's husband had been running from pillar to post for such a transfer, the same was not considered and no orders were passed till date and the 3” respondent has turned a nelson’s eye on all the above representations submitted, both by the applicant and the applicant's husband. However, the moment a query as raised from the office of the 1* respondent on receipt of Annexure 12 representation submitted by the applicant, hot haste was shown by the 3 respondent in immediately issuing an order of transfer transferring the applicant from AMS CIAL, Kochi to RMC, Chennai. It can be seen from the foot of Annexure A14 that the file to transfer the applicant originated on 23.06.2023 and the relevance of the said date is that it was on 19.06.2023, Annexure A12 representation submitted by the applicant was forwarded to the 1* respondent as per Annexure A13 communication from the Office of the Department of Personnel and Training. Thus, It is clear that Annexure Al4 order transferring the applicant from AMS CIAL, Kochi to RMC, Chennai is absolutely illegal, manifestly arbitrary, unfair, unreasonable, discriminatory and vitiated by malafides, malice in law and the said orderis the result of colourable exercise of power and consequentially, Annexures- A14 and A15 orders are liable to be set aside for the following among other: 1B 5. Grounds for relief with legal provisions, if any: A. From the facts stated above, it is clear that as per Annexures Ai and A2 orders, it has been laid down that the husband and wife shall be posted in the same station mandatorily and the above orders have been issued by the Department of Personnel and Training with a laudable Purpose of enhancement of women’s status in all walks of life and to enable them to lead a normal life as also to ensure the education and welfare of the children. Thus, in accordance with Annexures Al and A2 orders, the respondents are legally bound to give a transfer and posting to the applicant's husband, Sri, Midhun C., to AMS CIAL, Kochi where there are 3 posts lying vacant. Requesting for such a transfer, the applicant's husband and the applicant have been knocking all doors and have been running from pillar to post for the last more than one and a half years. However, no orders were issued by the respondents. It was In the above circumstances, as laid down in Annexure Ai and A2 orders, providing that for non-consideration or non-implementation of the directions in Annexures Ai and A2, the aggrieved party will be entitled to file a representation, the applicant submitted Annexure A12 representation. It is understood that a query was raised from the office of the 1% respondent on the receipt of Annexure A12 seeking clarification from the office of the 3™ respondent. Infuriated by the above, in blatant violation of Annexures A1 and A2 orders, the 3% respondent has transferred the applicant as per Annexure 14 order to Chennai. Hence, it is clear that Annexure Ai4 order Issued by the 3 respondent transferring the applicant is one issued on extraneous considerations, vitiated by malafides, malice in law and the sane is.also the result of colourable exercise of power, Annexure A14 order is absolutely illegal, arbitrary, unfair, unreasonable, discriminatory and violative of Article 14 of the Constitution of India and consequently, Annexure A15 order, relieving the applicant Is also illegal and both Annexures A14 and A15 are liable to be set aside. . A general transfer was effected in the department on the basis of Annexures A7 and A8 as per A10 order on 13.04.2023. Even for general transfer, the applicant’s husband submitted his application for transfer to the post of Scientific Assistant lying vacant in AMS, CIAL, Kochi, Kochi RS/RW and in the Trivandrum MC. It Is submitted that while issuing Annexure A10 transfer order, the 15 Posts of Scientific Assistant lying vacant in Kerala are still left unfilled and the applicant’s husband was even then not given a transferThus the general transfer order has already been effected in the Department in April 2023 and therefore, Annexure A14 order issued by the 3% respondent transferring the applicant Is not in the exigencies of service or in any administrative interest of the Department, but the same is vitiated by nothing but malafides. As per Annexure A14 order, the applicant alone has been transferred without any reason elther 15 administrative or any other reason. Hence, it is clear that Annexure A14 order is absolutely illegal, arbitrary, unfair, unreasonable, discriminatory and violative of Article 14 of the Constitution of India and is therefore, liable to be set aside. - From the facts stated above, it is clear that, out of the 4 sanctioned posts of Scientific Assistant In the office of the Aeronautical Meteorological Station, Kochi, only one post held by the applicant was filled up and the other 3 posts were left vacant. Now, by the transfer of the applicant, all the 4 posts in the AMS, CIAL, Kochi is lying vacant and no other person has been posted in the said office. The Presence of a Scientific Assistant In the AMS CIAL, Kochiin the air traffic control tower is absolutely necessary for the safety of the air passengers both domestic and international travelling in the aircrafts during take-off and landing in the CIAL. Thus, leaving all the posts of Scientific Assistant available in the AMS, CIAL, Kochi vacant in the Air Traffic Control Tower in the airport is not merely against Public interest but the same will make breathtaking inroads Into the safety of the air passengers. Thus, It Is clear that Annexure Al4 order is not one merely issued in any administrative exigency, but the same would militate against the very safety of the air passengers and the sald order is Is absolutely illegal, arbitrary, unfair, unreasonable, discriminatory and violative of Article 14 of the Constitution of India and is therefore, liable to be set aside. 6. 7.) 16 Details of the remedies exhausted: The applicant declares that she had availed of all the remedies available to her under the relevant service rules etc. Matters not previously filed or pending with any other Court: The applicant further declares that she has not Previously filed any application, writ petition or suit regarding the matter in respect of which this application has been made before any Court or any other authority or any other Bench of the Tribunal nor any such application, writ petition or suit is pending before any of them, Relief(s) sought: In view of the facts and for the reasons stated in Paragraphs above, the applicant most humbly prays that this Hon’ble Tribunal be pleased to:~ Call for the records leading to Annexures-A14 and A1S5 orders and set aside the same; Declare that Annexure A14 order Is vitiated by malafides, malice in law and an abuse of power and is therefore, is absolutely illegal, arbitrary, unfair, 7 unreasonable, discriminatory and violative of Article 14 of the Constitution of India; ili, Issue a direction to respondents 1 to 3 to allow the applicant to continue as Scientific Assistant at RMS, CIAL, Kochi. iv. To grant such other reliefs as this Hon'ble Court deems fit in the interest of justice. 9. iterim relief if any: This Hon’ble Tribunal may be pleased to issue an interim order directing the respondents 1 to 3 to allow the applicant to continue as Scientific Assistant at RMS, CIAL, Kochi keeping Annexures-Al4 and A15 in abeyance, pending disposal of the Original Application. 10. It has been decided that when both spouses are in same Central Service or Working in same Deptt. and if posts are available, they may mandatorily be posted at the same station) Yt is also necessary to make the provisions at Paras 3(iv) and (vi) of the O.M. dated 3.4.86 stronger as it is not always necessary that the service to which the spouse with longer service belongs has adequate number of posts and posting to the nearest station by either of the Department may become necessary. 3. On the basis of the 6” CPC Report, Govt. servants have already been allowed the facility of Child Gare Leave which is admissible til the children attain 18 years of age. On similar lines, provisions of O.M. dated 12.6.97 | have been amended. : 4. Now the situation has become more difficult for me as I cannot avail even the permissible leaves due to acute staff shortage at CIAL Kochi. I am the only S.A. posted at my office. We are performing roster duties since our offices are working round the clock. Because of staff shortage I had to perform extra duties and cannot even take a day leave. Our family life is seriously affected because of this. I was expecting his transfer to my station so that we both can manage our family. Hiis office has more staff and my office is running on acute staff shortage. My Director also informed the department about this but no action was taken. Since we are working in the same department and in the same cadre, we are eligible for the mandatory posting at the same station as per the DOPT order referred to above, We are disappointed a lot because of stalling the eligible transfer.
