regarding recent budget proposals on taxation of salary income. FBR has stated
that the story contains some incorrect or misleading content; therefore FBR would
like to issue a clarification in this regard.
FBR has clarified that withdrawal of exemption & reduced rates should not be
confused with imposition of new taxes. It is very clearly and candidly informed
that the present budget proposals do not contain any new item for taxation of
pensions or major components of salary as initially discussed. Omission of
Clause (39) of Part I of Second Schedule to the Income Tax Ordinance, 2001 is
only of technical nature. This clause provided exemption to re-imbursement of
expenditure incurred by employee on behalf of the employer organization. This
type of transaction cannot form part of the salary in any circumstances. The
omission has been made only because there were some interpretations of the
courts that were not in accordance with the actual purpose of this clause. The
clause has accordingly been omitted to avoid multiple interpretations or
confusions. The figures of revenue generation of Rs.1.82 billion reported by the

FBR has further clarified that no tax has been imposed on pensions, gratuity
funds payments, leave prior to retirement (LPR), commutation of pension and
other allied benefits. However, profit on debt or markup component on provident
fund has been proposed to be taxed @ 10% as a separate block of income only if
such markup exceeds Rs.500, 000 in a tax year. FBR firmly believes that this
change will not result in any significant burden on taxpayers. Similarly, exemption
to reimbursement of medical expenditure has been proposed to be omitted as a
streamlining measure because there were complaints of fake claims of exemption
on this account. Slight changes on account of traveling allowance of newspapers
employees, free supply of food or other perquisites etc. and salary of seafarers
that was wholly exempt have been proposed for rationalization of salary tax
Tax rate on capital market transactions has been lowered from 15% to 12.5%
in order to encourage ordinary people to invest their savings in the stock market
tradable securities. This change will result in enhanced savings and investment in
an activity that will lead to industrial expansion and economic growth. Needless to
highlight, an enhanced confidence in stock market ultimately translates into
new companies joining the field. The incentive has been offered for promoting
sustainable and inclusive economic growth.
Ministry of Finance and FBR are always open to positive critique for making
changes if any required in the proposals, however, take a strong exception to

ٹیکس تجاویز سے متعلقہ اخبار ی خبر شائع ہونے پر وضاحت جاری کی ہے ۔ ایف بی آرنے کہا ہے کہ
اخباری خبر میں کچھ گمراہ کن اور غلط معلومات درج ہیں اسی لئے ان کی درستگی کی جارہی ہے۔
ایف بی آرنے وضاحت میں کہا ہے کہ چھوٹ کو واپسی اور کم شرح کو نئے ٹیکس عائد ہونا نہ سمجھا
جائے۔ یہ بات پہلے ہی بہت وضاحت سے بیان کی جا چکی ہے کہ ٹیکس تجاویز میں پینشن اور تنخواہ پر
کوئی ٹیکس نہیں عائد کیا گیا۔ انکم ٹیکس آرڈینینس 2001کے دوسرے شیڈول کے حصہ اول کی شق 19کو
صرف تکنیکی نوعیت پر حذف کیا گیا ہے۔ اس شق کے تحت ادارے کی طرف سے مالزم کو خرچے کی
واپسی پر چھوٹ دی گئی تھی۔ اس طرح کی ٹرانزیکشن کسی بھی طرح تنخواہ کا حصہ نہیں ہو سکتی ۔ اس
شق کو حذف کر نے کی وجہ یہ تھی کہ کورٹس کی طرف سے اس شق کی تشریح اس طرح کی جارہی تھی
جو کہ سراسر اس شق کے عائد ہونے کی وجہ نہ تھی۔ اس شق کو ہٹا کر مختلف تشریحات سے جان چھڑا لی
گئی ہے جس سے مسائل پیدا ہو رہے تھے۔ اس حوالے سے خبر میں شائع کردہ 1.82ارب روپے کے
ریونیو حصول اعدادوشمار بالکل گمراہ کن اور بے بنیا د ہیں۔
ایف بی آر نے وضاحت میں کہا ہے کہ پینشن ،گریجٹی فنڈز کی ادائیگی ،ایل پی آر ،پینشن کی
کمیوٹیشن اور دوسرے فوائد پر کسی بھی قسم کا کوئی ٹیکس تجویزنہیں کیا گیا تاہم پراویڈنٹ فنڈ پر مارک
اپ 10فیصد شرح کے حساب سے ٹیکس تجویز کیا گیا ہے اور وہ بھی صرف اس صورت میں جب مارک
اپ کسی بھی ایک ٹیکس سال میں پانچ الکھ سے تجاوز کر جائے۔ ایف بی آرنے کہا ہے کہ اس تبدیلی سے
ٹیکس گزاروں پر کوئی خاطر خواہ ٹیکس بوجھ نہیں پڑے گا۔ اس طرح میڈیکل اخراجات واپسی پر چھوٹ کو
ختم کرنے کی تجویز ہے کیونکہ بہت سے جعلی چھوٹ حاصل کرنےکے کیسز سامنے آئیں ہیں۔ اخباری
مالزمین کے سفری االؤنسز ،مفت خوراک اور دوسری اشیاء کی فراہمی اور بحریہ سے منسلک مالزمین کی
تنخواہ جس کو مکمل چھوٹ حاصل تھی ،کو ٹیکس رجیم میں شامل کرنے پر معمولی تبدیلیوں کو ریونیو
اضافہ حاصل کرنے کی کوشش نہ سمجھا جائے۔
کیپیٹل مارکیٹ ٹرانزیکشنز پر ٹیکس شرح کو 15فیصد سے کم کر کے 12.5فیصد کر دیا گیا ہےتا کہ
عام آدمی سٹاک مارکیٹ تجارت میں اپنی بچت کی سرمایہ کاری کر سکے۔ اس تبدیلی سے بچت اور سرمایہ
کاری میں اضافہ ممکن ہو گا جس سے صنعتی بڑھاؤ اور معاشی نمو میں اضافہ ہو گا۔ سٹاک مارکیٹ میں
اعتماد کی وجہ سے نئی اور موجودہ کمپنیوں کے IPOsکی طرف سے فنڈز میں اضافہ ممکن ہو گا۔ اس
سہولت کو اس لئے فراہم کیا جا رہا ہے تا کہ معاشی نمو میں اضافہ ہو۔

وزارت خزانہ اور ایف بی آر ہمیشہ ہی مثبت تنقید کو خوش آمدید کہتا ہے تا کہ تجاویز کو بہتر بنایا جا
سکے۔ لیکن گمراہ کن اور بے بنیاد خبریں شائع کر کے عوام کو پریشان کرنا کسی بھی طرح صحافت کے
سنہری اصولوں کے مطابق نہیں ہے۔
