REPUBLIC OF THE PHILIPPINES Department of Human Settlements and Urban Development Kogawaran ng Pananahanang Pantao at Pogpapaunlad ng Kalunsuran MEMORANDUM CIRCULAR NO. 2°! 004 Series of 2021 To : ALL REGIONAL DIRECTORS ALL OFFICERS-IN-CHARGE ALL CONCERNED FROM : THE SECRETARY SUBJECT : AUTHORIZING THE USE OF VIDEOCONFERENCING TECHNOLOGY AND OTHER ONLINE OR ELECTRONIC MEANS IN THE CONDUCT OF PUBLIC HEARINGS AND CONSULTATIONS ON THE DRAFT COMPREHENSIVE LAND USE PLAN (CLUP) AND ZONING ORDINANCE (ZO) Legal Basis The Department of Human Settlements and Urban Development created under RA 11201 is empowered under Chapter III, 2(e) to formulate and prescribe land use planning and zoning standards and regulations for the guidance of cities and municipalities in the formulation of their respective Comprehensive Land Use Plans and Zoning Ordinances. Rationale The DHSUD shall support and observe the rules and guidelines of the IATF to ensure preparedness and efficient goverment response to assess, monitor, contain, control, and prevent the spread of Covid-19 in the country. On the other hand, as a measure to control the pandemic, the Civil Service Commission (CSC) issued Memorandum Circular (MC) No. 10, Series of 2020 entitled “Revised Interim Guidelines for Alternative Work Arrangements and Support Mechanisms for Workers in the Government During the Period of State of National Emergency Due to COVID-19 Pandemic,” that allows all government agencies to use videoconferencing/ teleconferencing in the conduct of meetings to minimize face to face interaction and ensure the health and safety of government personnel and the public. This circular will amend Housing and Land Use Regulatory Board Resolution No. 908 Series of 2013 that approved the 2013 Enhanced Comprehensive Land Use Plan Guidebook Volume 1. Specifically revised is Step 9 of the 12-Step CLUP Planning Process. 1 Paget Aatorzng and Proving Aemave Moen the Conc of Pubic Hearing and Corsa onthe Draft Comprehensive Land Use Pan and Zoning Ordnance of Local Goverment Units General Objectives The DHSUD shall continue to support, encourage and strengthen stakeholders’ and community participation in crafting the local government units’ development and Comprehensive Land Use Plans. 1. To enable stakeholders, both from the LGU and those based outside the city of municipality, with interest in the Comprehensive Land Use Plan, to participate in the consultation or public hearing to be conducted by the local government 2. To protect and prevent the transmission of Covid-19 and other highly transmittable or infectious diseases to the participants during the consultations or public hearings Guidelines The following guidelines shall be observed in the use of alternative modes in the conduct of consultations or public hearing for the draft CLUP and Zoning Ordinance. Section 1. Use of Video Conferencing Technology and other Online or electronic Means in the Conduct of Public Hearings or Consultations on the draft CLUP and Zoning Ordinance Step 9 of the 12-Step CLUP process provided under CLUP Guidebook Volume 1 is amended where the use of video conferencing and other on line or electronic means as alternative mode in the conduct of public hearings and consultations is hereby allowed. Section 2. Combination of Face-to-Face and Video Conferencing or Remote Means in the Conduct of Public Hearing and Consultations for CLUPs and Zoning Ordinances A combination of face-to-face and video conferencing in the conduct of CLUP public hearings and consultations may be allowed subject to the following: There shall be no over crowding Participants shall observe or follow social or physical distancing Observance of the allowed percentage capacity limit of the venue Secure clearance or permission from the LGU counterpart of the Inter- ‘Agency Task Force for Emerging Infectious Diseases (IATF) v. Observanee or follow other conditions or requirements of concerned entities to prevent the spread of any infectious disease Section 3. Submission of Proof of the Conduct of Public Hearing and Consultations As proof of the conduct of public hearing, cities and municipalities concerned shall submit the following: Page 2: Authorizing and Providing Aemative Mode inthe Conduct of Pubic Hearing and Consultations on the Draft Comprehensive Land Use Plan and Zoning Ordinance of Lacal Government Units i. Sample of Notice of Public Hearing ii. Sample of letter invitation to attend or join the public hearing iii, List of invitees iv. Participants’ attendance v. _ Minutes of the public hearing vi. Certification from the Sangguniang Secretary that the public hearings were conducted Section 4. Submission of Position Papers, Comments and Recommendations ‘on the Draft CLUP and Zoning Ordinance Participants who joined the public hearing or consultation through video conferencing or other remote means shall be allowed to submit their written comments, recommendations or position papers within seven (7) days from the date of actual public hearing, Submission of comments, recommendations or position papers through electronic mail shall be allowed. Section 5. Dissemination and Communication All DHSUD Regional Offices are directed to communicate this circular to all local government units within your jurisdiction, NGAs at the regional level and other relevant development partners and stakeholders for information and guidance. Section 6. Effectivity This guideline shall take effect immediately after certified copies hereof are furnished the Office of the National Administrative Register of the University of the Philippines Law Center pursuant to Executive Order No. 292 otherwise known as the Administrative Code of 1987.
