THE APPOINTMENT OF CONTRACTOR FOR CONSTRUCTION OF EARTHWORKS AND

INFRASTRUCTURE WORKS FOR KEDAH RUBBER CITY (KRC) PHASE 1 (PACKAGE 1) AT LOT PT 2192,
MUKIM PADANG TERAP KIRI, DAERAH PADANG TERAP, KEDAH DARUL AMAN

1.9 The Contract comprised the construction, completion and maintenane of the works and except
in so far as the Contract otherwise provides, the provision of all labour, materials, constructional
plants, temporary works and everything whether of a temporary or permanent nature required in
and for such construction, completion and maintenance so far as the necessary for providing the
same is specified in, or can reasonably be inferred from the Contract Documents.

1.10 Where descriptions of items contain a classification of length, width, size or volume with upper
and lower limits, it is to be noted that the extent of such classification is defined by a lower limit
which is exceeded and an upper limit which is not exceed (i.e. which is a maximum)

1.11 These Bills of Quantities are to be read in conjuction with the Conditions of Contract,
Specifications, Contract Drawings and Malaysian Civil Engineering Standard Method of
Measurement.

1.12 The Preambles herein shall apply to the whole of the Works regardless of the Trade Headings
under which they have been described and shall be read in conjunction with the accompanying
Bills of Quantities and shall be taken into account when pricing these Bills of Quantities.

1.13 Rates for material shall include for insurance, freight, import charges, handling and transport to
site, storage and small quantities required by the extent of the Works.

1.14 The Contractor is not to order materials from the sizes and quantities stated in the Bills of
Quantities but must take all sizes from the working drawings or as instructed from time to time.

2.0 THE CONTRACT

Generally, description in the Bills of Quantities identify only definitive permanent components
and do not state the tasks either basic or incidental required to be carried out by the Contractor,
nor do they comprehensively register all the materials and work required. The rates inserted in
the Bills of Quantities multiplied by the quantities shall be deemed to cover the full inclusive
cost of the Work and shall include for all necessary operations, termporary works, compliance
with the express requirements of the Specification and for all general liabilities, risk and
obligations set forth or implied in the documents on which the tender is based. In certain cases,
for the sake of clarity, amplification of the materials, operations and requirements to be covered
is given for specific items in the preambles and item notes and reference are made to relevant
clauses of the Specification. The omission of such amplification or reference in any particular
case shall not prejudice the provisions stated in the first paragraph above or relieve the
Contractor to satisfy himself as to have allowed all costs and expenses required in and for the
proper execution and completion of the Works described or implied in the Contract as a whole.

The costs of complying with the Conditons of Contract shall be covered by the rates quoted for
the various items in the Bills of Quantities. The rates shall also allow for the phasing
requirements of Works (if necessary) including the special arrangements in coordinating with
other contractors and the effect on the programming of the Works of all traffic and drainage
diversions (if any), and all the Contractor’s liabilities and obligations set forth or implied in the
Contract including all matters and things necessary for the proper completion of the Works.

NO ADDITONAL PAYMENT SHALL BE MADE IN RESPECT OF ANYTHING


DESCRIBED IN THE CONTRACT OR SHOWN IN THE DRAWINGS FOR
WHICH APPARENTLY NO CORRESPONDING ITEM IS GIVEN IN THE
BILLS OF QUANTITIES AND THE COST THEREOF SHALL BE DEEMED TO
