"ELECTRONICS AND COMMUNICATIONS ENGINEERING ACT OF THE PHILIPPINES",

The Electronics and Communications Engineering Act of the Philippines or the R.A. 9292 is an act
created to guide Electronics Engineers, Electronics Technicians, Professional Electronics Engineers, its
Accredited Professional Organization and other related fields and connected personals under this act. It is
signed into law by former President Gloria Macapagal-Arroyo, Approved by the senate president Hon.
Franklin M. Drillon, Speaker of the House of Representative Hon. Jose De Venecia Jr. passed on February 2,
2004 and signed into law by the President of the Philippines last April 17,2004. The R.A. 9292 Contains 43
Sections created for effective guidance and understanding of the law.

Article I GENERAL PROVISION

Section 1 Short Title


This Act shall be known as the "Electronics Engineering Law of 2004".

Section 2 Statement of Policy


This Act is created to support and sustain the development, to uphold competent , virtuous and
productive Professional Electronics Engineers, Electronics Engineers and Electronics Technicians for the
nourishment of the standard and world-class engineers, using honest, credible and regulatory
examinations, programs and activities.

Section 3 Definition of Terms

Electronics - branch of science that deals with the study of flow and control of electrons \
(electricity) and the study of their behavior and effects in vacuums, gases, and semiconductors, and with
devices using such electrons.

Professional Electronics Engineer – A person who is qualified and a duly licensed/registered


Professional Electronics Engineer with affix PECE.

Electronics Engineer – A person who is qualified and a duly licensed/registered Electronics Engineer
with affix ECE.

Electronics Technician – A person who is qualified and a duly licensed/registered Electronics


Technician with affix ECT.

Electronics and Communications Engineer - A person who is qualified and a duly licensed/registered
Electronics and Communications Engineer under Act No. 5734.

Computer – A device that can processing/ accept data and commands/programs to acquire result.

Information and Communication Technology – acquiring, processing, transformation, storage and


transmission of data using electronic devices.

Communications – Process of sending and receiving data and information using electronic devices
or non-wired methodologies.
Telecommunications – Transmission of data and information via electronic devices or non-wired
methodologies.

Broadcast, Broadcasting – Transmitting of audio, video, text, image or message via reception
through wired or non-wired means.

Industrial Plant – an establishment where manufacturing, production or any other endeavors


occurs through electronic machineries and/or equipment.

Commercial Establishment – Include offices, hotels, motels hospitals, condominiums, stores,


apartments, supermarket etc. where business takes place.

Consulting Service – A service where technical expertise and professional supervision is offered for
business, school, or personal gain.

Accredited Professional Organization – the integrated and accredited national organization for
Professional Electronics Engineers, Electronics Engineers, and Electronics Technicians.

Electronics Technician (ECT)

Section 5 Nature and Scope of Practice of Electronics Engineering and Electronics Technician Professions.

A.) The scope of practice for Electronics Engineers encompasses a wide range of activities related
to applying engineering principles to electronics. Research, design, manufacture, testing,
maintenance, and management of electronic systems, technologies, and components are
included in this. It includes topics from a range of industries, such as communications,
information technology, electronics production, healthcare technology, and more. Activities
connected to electrical engineering education and training are also included in this scope.
B.) Research, design, and management of electronic systems are just a few of the many duties that
professional electronic engineers might perform in their line of work. In accordance with the
applicable legislation, they also have the exclusive ability to approve and authenticate any
designs, drawings, permits, specifications, reports, or other technical documentation linked to
electronics that they directly develop or oversee.
C.) The installation, use, upkeep, and repair of electronic devices and systems are under the
purview of different non-engineering duties performed by electronics technicians. This includes
work done in a variety of places, including on land, on boats, on airplanes, in factories, and in
retail shops. The curriculum and licensing exams for electronics technicians include technical
disciplines that are taught and trained by electronics technicians.

Article II PROFESSIONAL REGULATORY BOARD OF ELECTRONICS ENGINEERING

Section 6 Composition of Board


The Professional Regulatory Board of Electronics Engineering is under the Professional Regulatory
Commission, it is composed of Chairman and 2 members appointed by the President of the Philippines,
from 5 nominees submitted by the Accredited Professional Organization in accordance with the rules and
policy set.

Section 7 Power and Function of the Board

- To Administer/implement provision of this act;

- Administer oaths;

- Adopt an official seal of the board;

- Issue, suspend or revoke Certificates of Registration in accordance with the rules and regulations
within due process;

- Maintain a roster of Professional Electronic Engineers, Electronic Engineers and Electronic


Technicians;

- Issue, suspend or cancel special permits;

- Prescribe, amend or revise requirements;

- Adopt a program and grant registration;

- Study, examine and recommend with the curricula and facilities of school, colleges or universities.
Realigning and revising for the betterment in the field of academics to produce competitive and world-class
electronics engineers

- Administer Code of Ethics and promulgate rules and regulations on the scope of practice;

- Delegate hearing and investigation within the field, and promulgate resolutions, orders and/or
decisions;

- Create action plan and reports for annual in the beginning and end of fiscal year.

Section 8 Qualifications of Board Members

The applicant should be a citizen and a resident of the Philippines for atleast 5 consecutive years.
Having a Good moral character and integrity. The applicant should be a Holder of a Valid Certificate of
Registration and a valid Professional Identification Card duly registered PECE in the Philippines, with a good
standing from the APO. Shouldn’t be connected in any universities, schools , or colleges and must not have
been convicted.

Section 9 Term of Office


The board member shall hold office for 3 years from date of appointment or until their successor
shall be appointed. The member may be re-appointed more than once not exceed 6 years.

Section 10 Compensation and Allowance of the Board

The allowance stated under the General Appropriation Act.

Section 11 Removal of Board Members

The President of the Philippines may suspend or remove any member of the Board with reasonable
and duly neglectful act.

Section 12 Custodian of Board Records, Secretariat and Support Services.

All records of Engineers under this field, including examinations, applications, administrative cases
and records within professional field are kept by the Commission. The commission will designate a Secretary
of the Board.

Article III EXAMINATION, REGISTRATION AND LICENSURE

Section 13 Licensure Examination.

Applicants applying for license as Electronics Engineers and Electronics Technicians shall undergo
licensure examination given by the Board in accordance with the provisions of Republic Act No. 8981

Section 14 Qualifications for Examinations

The applicants must be a citizen of the Philippines / or foreign countries that qualified to take the
examination as provided for Section 33 of this Act. Should have a good moral character and haven’t been
convicted in any court of law of a criminal offense. Should be a degree holder of Bachelor of Science in
Electronics and Communications Engineering or Electronics Engineering or in compliance with minimum
requirements to be prescribe by the Board.

Applicants for Electronics Technicians must be a graduate of an Associate, Technician, trade, or


vocational course in Electronics. Has completed atleast the minimum Third-Year equivalent of Bachelor of
Science in Electronics and Communications Engineering or Electronics Engineering Courses.

Section 15 Scope of Examination for Electronics Engineers and Electronics Technicians.

The licensure Examination for Electronics Engineers shall consist of written test which covers
subjects prescribed by the board.

- Mathematics
- Applied Science
- Engineering Economics
- Laws and Ethics
- Electronics
- Communications
- Computers
- Information and Communications Technology

The licensure Examination for Electronics Technicians shall consist of written and/or practical test
covering subjects prescribe by the Boards and shall cover subjects specific to the practice of Electronics
Technicians.

Section 16 Ratings

The applicant must have passing 70% in all subjects provided. But if the applicant get a percentage
between 60% to 70% in one subject, he or she is eligible to take one removal exam to the subject he or she
failed. Examinees failed to receive higher than 70% in all subjects, will be considered failed the licensure
examination.

Section 17 Release of the Result of the Examination

The result of the examination shall be release within 15 days after the licensure examination.

Section 18 Qualifications and Schedule of Registration for Professional Electronics Engineer.

The Applicant must have a certificate of Registration and Professional Identification Card as
Electronic Engineer, with valid membership identification card from the APO. It also must be active in the
field with supporting certificates and 3 certifications signed by Three Professional Electronics Engineers to
provide supporting record for factual experiences.

Section 19 Issuance of the Certificate of Registration and Professional Identification Card

Identification card and issuance of Certificate of Registration to be a duly registered Professional


Electronics Engineer, Electronics Engineer and Electronics Technician will be issued by the Commission. Fees
may be charged for non-exam takers.

Section 20 Registration without Examination for Electronics Technicians


Applicants for registration as Electronics Technicians without Examination will be issued Certificate
of Registration and Professional Identification Cards as long as he or she shall present evidence or other
proof satisfactory to the board that he or she is graduate of at least a two-year Associate, Technicians, Trade
or Vocational course in Electronics Engineer or he or she completed at least the minimum third-year
equivalent of a Bachelor’s Degree of Science in Electronics and Communication Engineering or Electronics
Engineering Program. He or she should has rendered at least seven years of active service in the field of
electronics engineering. Must submit a certificate signed by 3 Professional Electronics Engineers supporting
his or her technical capability and good moral character.

Section 21 Non-issuance of a Certificate of Registration and/or Professional Identification Card for Certain
Grounds

Any applicant with any immoral or dishonorable conduct, and/or convicted with any crime shall not
receive Certification of Registration and Professional Identification Card.

Section 22 Professional Oath

All successful examinees and those who are qualified for registration without examination is
required to take a Professional Oath before any members of the Board or any person authorized by the
Commission before issuing Certificates of registration and Professional Identification Cards

Section 23 Revocation and Suspension of Certificate of Registration, Professional Identification Card and
Cancellation of Special Permits

The Board shall provide proper notice and hearing, revoke or suspend the validity and can cancel
special permits to those who do unprofessional or unethical conduct, malpractice, violation or
incompetence.

Section 24 Reinstatement, Re-issuance or Replacement of Certificate of Registration and Professional


Identification Card.

After 2 years, the board can re-instate the validity of the Certificate of Registration with reasons
deemed appropriate and sufficient. Provided he or she did not do any illegal practices of the profession or
any violation of RA 9292. New Certificate of Registration or Professional Identification Card shall be issued.

Section 25 Roster of Professional Electronics Engineers, Electronics Engineers and Electronics Technicians.
The Board must obtain information of registered Professional Electronics Engineers, Electronics
Engineers, and Electronics Technicians, it shall be updated by the APO, and shall be coordinated to the
Commission.

Section 26 Exemptions from Examination and Registration

No Examination and Registration shall be required for Foreign Professionals Electronics Engineers,
Electronics Engineers or Electronics Technicians who are no qualified Filipino Equivalent is available for
specific item of work to be rendered, where condition of scope and funding are temporary employment of
a foreign professional, an ASEAN AND APEC Engineer Registry programs or similar to international trades.

Special Permit will be granted and shall be valid only for a period of not more than Six Months and
renewable every Six Months and therefore discretion of the Board and approval of the Commission.

Article IV PRACTICE OF PROFESSIONAL ELECTRONICS ENGINEERING, ELECTRONICS ENGINEERING AND


ELECTRONICS TECHNICIANS

Section 27 Practice of the Profession

Only duly licensed Professional Electronics Engineers, Electronics Engineers and Electronics
Technicians can use the title.

Section 28 Prohibitions and Limitations on the Practice of Electronics Engineering and Electronics Technician
Profession.

The professions of electronics engineer and technician are classified as professional services, and
entry into these fields is determined by a person's unique qualifications. Firms, businesses, partnerships,
associations, or corporations are not eligible to apply for this practice's registration or license. As
Professional Electronics Engineers, Electronics Engineers, or Electronics Technicians, individuals can create
partnerships, groups, or corporations and provide services as a group. It's crucial to remember that each
participant in these partnerships or groups is still personally accountable for their own activities.

Section 29 Seal of the Professional Electronics Engineers.

All licensed Professional Electronics Engineers are required to acquire and utilize a seal of a
specified design. bearing the name, registration number, and title of the registrant, as issued by the Board.

Section 30 Code of Ethics and Code of Technical Standards of Practice


The Code of Ethics and Code of Technical Standards of Practice shall be observed and maintain by
all registered Professional Electronics Engineers, Electronics Engineers and Electronics Technician, where
the Code of Ethics and Code of Technical Standards of Practice is created and updated by the APO.

Article V SUNDRY PROVISIONS

Section 31 Professional Education (CPE) and/or Development Programs.

Professional Electronics Engineers, all registered Engineers and electronics technicians must abide
by all applicable laws and regulations. the Commission and/or the Board, the Accredited Professional
Organization, may prescribe and promulgate regulations that are already in effect as well as those that may
be.

Section 32 Integrated and Accredited Professional Organization.

There must be only one Accredited Professional Organization which governs and guides the roster
of Professional Electronics Engineers, Electronics Engineers and Electronics Technicians. The APO should
also create and provide necessary documents needed to maintain and sustain the Electronics engineering
in the Philippines.

Section 33 Foreign Reciprocity

No Foreigner shall be admitted for registration as Professional Electronics Engineer, Electronics


Engineer, and Electronics Technician with or without examination under this Act unless the Board will
instate admission in accordance with the law and citizenship.

Section 34 Positions in Government Requiring the Services of Registered and Licensed Professional
Electronics Engineers, Electronics Engineers, and Electronics Technicians.

After three years of effectivity of this Act, only Registered Professional Electronics Engineers,
Electronics Engineers and Electronics Technicians shall be positioned to any local or national government
positions, whether temporary, contractual, or permanent.

Article VI PENAL PROVISION AND ASSISTANCE OF LAW ENFORCEMENT AGENCIES

Section 35 Penal Provision


Violators may be fined from One hundred Thousand Pesos to One Millions Pesos or by
imprisonment not less than six months to more than six years.

Violations such as falsifications of documents, to use other identity or documents, to use revoked
documents, practicing the Profession without any certification of registration and Professional
Identification Card, the use of revoked stamps from a Professional Electronics Engineer, any electronic
engineers that signs or function as Professional Electronics Engineer. In addition, Acts such as Illegal wire-
tapping, cloning or any illegal acts and persons who violated this act.

Section 36 Assistance of Law Enforcement and Other Government Agencies.

Any law enforcement can and shall request the Board and/or the Commission to enforce this Act
and implement within the Code of Ethics and Standards of practice. The Board and/or the Commission
shall cooperate in any government agencies that seeks help in pursuant to the provisions of this Act.

Article VII TRANSITORY PROVISION

Section 37 Transitory Provision

Once this act signed and in effect, the current board have six months to render all works and
finish all task, after the given time, the President will appoint the first Board Members of the Electronics
Engineering.

Section 38 Vested Rights: Electronics and Communications Engineers when this law is passed

Once signed, all registered Electronics Engineers shall be issued new Certificate of Registration
and Professional Identification Card with the same license number as per their original registration.

Article VIII FINAL PROVISION

Section 39 Implementing Rules and Regulations

The implementation of this Act shall carry out fifteen days after publication through Official
Gazette and news papers of general circulation. In accordance with the approval or the Commission, the
Board, and the Accredited Professional Organization.

Section 40 Appropriations
The chairperson of the Professional Regulatory Commission shall include the commission’s
program implementation of this act.

Section 41 Separability Clause

Any changed or any provision within this act shall be considered as unconstitutional and will not
take effect.

Section 42 Repealing Clause

Republic Act NO. 5734 is hereby repealed.

Section 43 Effectivity

This act will take effect fifteen (15) days after the official publication of the act through the official
publication Gazette and News paper of general circulation.
