URL is www.ypicrew.com (the "Site"). You can print these Terms, or store them
in your computer for future reference. By using the Site, you are indicating your
acceptance to be bound by these Terms. The terms "You" and "User" as used
herein refer to all individuals accessing the Site.

 (b) You must not submit any material such as general information, facts,
comments, opinions, ideas or publications ("Material") which is
defamatory, offensive, menacing, hateful or obscene to the Site or
which in our judgment may cause nuisance, annoyance, damage or
offense, inconvenience to us or any other person or which is illegal. We
may remove or edit such Material from the Site at any time without
notice to, or consent by you.

(c) You must agree to not submit false or inaccurate biographical

information or information which is not your own accurate CV.

(d) By submitting any Material to us you acknowledge and consent that we

may copy, modify, distribute or create a derivative work from the
Material in any manner that we shall determine. You also waive any
moral rights to the Material for the purpose of its publication on the
Site. You will indemnify us if any third party takes action against us in
relation to the Material.

(e) In completing the registration process, you must provide us with

current and accurate information as prompted by the registration form.
You will be required to choose a password. You are solely responsible
for maintaining the confidentiality of the password or account and for
any and all activities that occur under your account. You agree to notify
us immediately of any unauthorized use of your account or any other
breach of security. We will not be liable for any loss that you may incur
as a result of someone else using your password or account, either with

Policy and disclosing this to prospective employers and clients in
connection with the recruitment process. Many potential employers are
based outside the European Economic Area (“EEA”) so their processing
of your personal information will involve a transfer of data outside the
EEA. In the event of a potential job opportunity with a recruiter based

(b) You are solely responsible for any information uploaded by you to the
Site. You are responsible for ensuring that all information supplied by
you is true, accurate, up to date and not misleading or likely to mislead.

(c) You authorise us to contact your referees listed on your CV or on the

registration form.

(d) You understand that there are no guarantees of employment.

(e) You understand that we are not responsible for any travel expenses
that might occur prior, during or after your interviews and job
acceptance.

(f) You understand that YPI Crew is not responsible for your employer’s
actions i.e. crew cut back, change of yacht ownership, change of
cruising areas, shipyard period or any other changes.

(g) You will inform us immediately of any interviews obtained as a result of

us submitting your CV to one of our clients and you will inform us
immediately of any job offers received and accepted as a result of our
submitting your CV to one of our clients.

(h) You understand that YPI Crew cannot guarantee the accuracy,
exhaustiveness, validity or the up-to-date nature of the information
provided by third parties and clients.

(i) You understand that YPI Crew is not your employer. You must apply
judgment, prudence and common sense when evaluating a potential
employer or any information provided by them.

6. Use of personal information

We will only use your personal information as set out in our Privacy Policy

7. Dealing with third parties

The Site may provide, or third parties may provide, links to other websites
or resources, promotions of advertisers and merchants. As we have no
control over such sites or third-party resources, you acknowledge that we
are not responsible for the availability of such external sites or third-party
resources, do not endorse and are not liable for any content, advertising,
products, services or other materials on or available from such sites or third-
party resources.

for candidates to post CV’s. You acknowledge and agree that you are
solely responsible for the form, content and accuracy of any CV or
Material contained therein placed by you on the Site.

(b) So far as permitted by law, and except in respect of death or personal

injury arising from negligence, we exclude any liability for loss or
damage of any kind resulting from the use of the Site (including the
reliance upon any information contained on it).

(c) We shall not under any circumstances be liable for any special or
consequential damages that result from the use of, or the liability to
use, the Materials in this Site, even if we or a representative of ours has
been advised of the possibility of such damages.

 12. General Information

(a) If any of them are held by a court of law to be illegal or otherwise

unenforceable by the laws of any state or country, then to the extent
that such term(s) is/are illegal or unenforceable, they shall be deleted
from these Terms and the remaining Terms shall survive and remain in
full force and effect.

(b) Any failure by us to exercise or enforce any right or provision of the

Terms shall not constitute a waiver of such right or provision.

(c) These Terms and the relationship between you and us shall be
governed by French laws and the French courts shall have exclusive
jurisdiction over any dispute, however we reserve the right to take legal
action in any competent court of jurisdiction.

13. These Terms are also available in French language and you acknowledge
the fact that the opportunity has been given to you to read them in French.
