Dear Dr. Zarcedo,

As advised in your reply letter as of even date to my earlier request, I secured


this morning from your office a copy of the supposed report of the Fact-finding
Investigation Committee on the 2019 PSU Cultural Uniform Procurement headed by Dr.
Bernadette G. Gumba. I was provided a copy of a seven (7) page-document merely
entitled as "REPORT OF THE FACT-FINDING COMMITTEE ON CULTURAL UNIFORM", signed by
Dr. Bernadette G. Gumba, Ph.D. and notarized on 14 February 2022 by notary public
Atty. Ryan Jude D. Villar. After going over the said document, I found out, to my
dismay, that this is entirely different from and inconsistent with what I actually
requested and expected, that is, "a full and complete report together with the
pertinent and relevant documents supporting the findings, conclusions and
recommendations."

The said report, copy of which is attached and made an integrall part hereof as
Annex "A", is bereft with the basic structure of a fact finding investigation
report because it fails -

1. To evidence a timely and impartial institutional response;


2. To accurately document the investigation conducted ;
3. To provide the decision maker, in this case the Administrative Council (ADC) or
PSU itself, with complete facts to decide matter;
4. To ensure successful investigation,; and,
5. To best defend the investigation.

Moreover, it is partial and does not fairly ascertain the truth in the cultural
uniform procurement of 2019, worse, exonerates indivduals involved in the bidding
who failed to promote economy and efficiency and obtain the most advantageous price
for PSU.

By reason of the above, I came to you this afternoon specifically to confirm the
following: a) is the report I obtained today from your office the full and
complete report of Dr. Gumba's committee?, b) will the said report be presented to
the ADC for consideration and approval, considering that it was merely tabled last
3 January 2022 ADC meeting under "For Information" only and has not yet been
considered, deliberated upon and approved by the council?

Based on my meeting with you, your response to my queries is that the said report
was the one submitted to you by Dr. Gumba in relation to my request, therefore I
can safely say that is the "full and complete report" of Dr. Gumba's committee. You
also mentioned to me that there is no more need to present the report to ADC
because it is not its function to investigate and there is nothing more to discuss
considering that you have already acceded to my request for investigation of the
cultural uniform procurement. Besides, according to you, I am the only one
interested and very vocal on this issue. Further, you said that other ADC members
remain silent are not complaining and if anyone desires a copy of the report then
he just have to make a request. Finally, in an apparent outburst of anger due to my
questions, you dared me to just file a case against you or anybody involved in this
matter.
Sir, while the temper you have displayed is unbecoming of a gentleman and
uncharacteristic of a high official of this prestigious institution, who ought to
exercise the highest degree of propriety, decency and professionalism and uphold
the interest of our university over and above personal interest, I shall not
further bother you on this procurement issue, which by your actions and
pronouncements, you have unfortunately declared closed anyway, instead I will just
seek other legal avenues by which this controversy can finally and fairly be put to
rest.
