The Respondent named above most humbly submit as under:
1 That, the present application is filed for recovery of arrears
of Rs. 1,68,000/-. It is submitted that the Non-applicant does not have any source of income and hence does not have any resources to pay the accrued arrears of maintenance as claimed by the Petitioner. 2 It is further submitted that the Respondent has an old age mother to maintain which requires regular expenses on medical treatment, the Respondent is not in a position to meet those expenses as well. It is submitted that the respondent is surviving with great hardships on the stipend of Rs. 8,000/- being received from his institution where the respondent is pursuing Ph.D which itself is insufficient for survival of Respondent. Further, the Respondent is unable to find any employment due to ongoing situation of pandemic and the consequential lockdown imposed by the State and other local authorities. 3 Thus, the Respondent therefore most humbly prays to this Hon’ble court to grant time to the Respondent to pay the pending arrears in the interest of justice and equity.
