The humble application on behalf of the
petitioner named above:--------- Most Respectfully Sheweth:-------------- 1. That the Petitioner has filed this case for grant of maintenance to herself and her daughter. 2. That the opposite party is trying to delay the disposal of this case in order to avoid paying maintenance. 3. That after arguments by both sides on 31-01-2018 this case was posted for order. But later on by an application by O.P. this was reopened and final arguments were herd again. 4. That on direction of this Hon’ble Court the employer of 5. That the petitioner has filed application for interim maintenance on 09-2-2017 but no maintenance has been awarded till date. 6. That by an order dated 01-09-2016 this Hon’ble Court directed the Opposite Party to file documents pertaining to his income and assets. 7. That on 24-01-2018 the O.P. filed evasive reply to the abovementioned. In his reply evasive, false and fabricated information was filed by the O.P. The O.P. has deliberately concealed his real income in order to avoid paying maintenance to the petitioner and her daughter. 8. That the petitioner is facing acute hardship in maintaining herself and her daughter. An award of maintenance from Opposite Party only can save herself and her daughter from destitution. The petitioner’s father is suffering from cancer and he is unable to support the petitioner. Medical certificate pertaining to the ailment is attached herewith. The petitioner is attending her ailing father in Bangalore. 9. That in view of the circumstances mentioned above it is submitted most humbly that the petitioner and her daughter be awarded interim maintenance at earliest till the final disposal of this case. It is, therefore, prayed that Your Honour may graciously be pleased to allow this petition and direct the opposite party to pay at least Rs.80,000(rupees eighty thousand) per month as interim maintenance to the petitioner and her daughter from the date of filing of this application till its decision on merits. ; AND It is prayed further that the opposite party be directed to pay litigation expenses to the petitioner pertaining to the present case and other related cases arising from this matrimonial discord.
