FACTS: The prisoners, another man and the deceased, were the crew of an English
yacht, which was cast away in a storm on the high seas and were compelled to put into
an open boat. The food they took with them got finished and after eight days without
food and six days without water, the prisoners planned and killed the deceased. The
deceased when killed was lying at the bottom of the boat, helpless, weak and unable to
make any resistance, and did not assent to his being killed. The prisoners and the other
man fed upon the body and blood of the boy for four days, when a passing vessel
picked them up.
HELD: The prisoners had no justification for killing the deceased and were therefore
guilty of willful murder.
