We may charge interest at a rate not exceeding the rate of interest charged

Consequences of missing payments If you miss a payment, we may terminate the Agreement (after service of
any notice required by law) and commence action to recover the outstanding

may take legal action to recover the debt outstanding. We may apply for a
County Court Judgment, which we may seek to enforce in a number of ways
including but not limited to your bankruptcy or a charging order over your
home, which may result in your home being repossessed.
4. Other important legal aspects

Right of Withdrawal You have the right to withdraw from the Agreement within 14 days without
giving any reason. The withdrawal period will start from the day after the
latest of:

1. Where we sign the Agreement before you, and, therefore, the

2. Where you sign the Agreement before us, and, therefore, the

the Agreement has been made, and, in either case, will end 14 days later.

Early repayment. You have the right to repay the credit early at any time in full or partially. If
you do make a partial settlement, we will re-schedule your future payments
to reduce your monthly payments from the next payment date (unless a
payment has already been requested from your bank in respect of the
payment due on the next payment date, in which case the payments will be
reduced from the next payment date after that). Any part settlement will be
used to clear arrears and associated charges before reducing future
payments.

Consultation with a Credit Reference Agency If we decide not to proceed with the Agreement on the basis of information
received from a credit reference agency, we will inform you of that fact and
how to contact the credit reference agency for details.

Right to a draft credit agreement Unless we have declined a proposal for credit from you, you have the right
to request a copy of the agreement free of charge, prior to the conclusion of
it.

What could happen to adversely affect you

(less any rebate required by law). We may take legal action to recover the debt outstanding.

What if you do not make your payments on their due date?


We will contact you as soon as we can to let you know you have missed a payment, and to discuss how
the payment can be made. We will also charge fees as detailed in the Pre-Contract Information and the
Agreement, which means that the amount of your overall debt to us will increase. If you fail to then
bring the agreement up to date, we will issue a Notice of Default, proceed to terminate the Agreement
and then cancel the Policy. The insurance company will then pay any refund of Premium directly to us
and we will have the right to pursue you for any shortfall. This could then lead to legal action and our
commencing action to recover the amount then due to us.

Your right to withdraw from the Agreement


If you wish to withdraw from the Agreement, you can do so within the first 14 days from:

1. Where we sign the Agreement before you, and, therefore, the Agreement is made when you
sign it, the day on which you sign it; or
2. Where you sign the Agreement before us, and, therefore, the Agreement is made when we sign
it, the day on which we advise you that the Agreement has been made,

If you do wish to withdraw, you will need to pay the credit and interest accrued from the date the credit
was provided to the date of repaying it to us, without delay and not later than 30 calendar days after
giving notice of withdrawal (the "Settlement"). The daily interest is 15.00%. If you fail to pay us the
Settlement within the 30 day period, we will have the right to request immediate payment of it.

terminating the Agreement and making the balance outstanding immediately payable (less
any statutory rebate). We may take legal action to recover the debt outstanding. We may
also report your conduct of the account to credit reference agencies, which may make it
difficult for you to obtain credit in the future.

become payable before it is applied in making early repayment.

Ombudsman Scheme You have the right to complain to the Financial Ombudsman Service where you are a

Interest for late payment We may charge interest at a rate not exceeding the rate of interest charged under the
Agreement, on all sums overdue under the Agreement. We will charge interest from the due
date for the payment until the payment is received in cleared funds. Interest is calculated on
a daily basis, and is payable on demand.

Missing payment warning If an amount equal to, or more than, two monthly instalments becomes overdue for payment,
we will serve a default notice on you, requiring you to bring payment up to date within a
period specified in the notice, and, if you fail to do so, we may give you a further notice,
terminating the Agreement and making the balance outstanding immediately payable (less
any statutory rebate). We may take legal action to recover the debt outstanding. We may
also report your conduct of the account to credit reference agencies, which may make it
difficult for you to obtain credit in the future.

Right of Withdrawal You have the right to withdraw from the Agreement within 14 days without giving any reason.
The withdrawal period will start:
(i) Where we sign the Agreement before you, and, therefore, the Agreement is made when
you sign it, on the day on which you sign it; or
(ii) Where you sign the Agreement before us, and, therefore, the Agreement is made when
we sign it, on the day on which we advise you that the Agreement has been made, and, in
either case, will end 14 days later.

TERMS AND CONDITIONS
1. Creditor's Obligation
The Creditor agrees to advance to the Customer the Amount of Credit to assist the Customer to pay the
Premium subject to compliance with this Agreement by the Customer. The Customer acknowledges and agrees
that the Creditor may make the payment of the Amount of Credit to the Broker on behalf of the Customer and
that the Broker is authorised to supply the Creditor with a copy of the policy or policies financed under the
Agreement.

2. Payment
In consideration of the Creditor advancing the Amount of Credit, the Customer:
2.1 Shall punctually pay to the Creditor (without previous demand) the total amount payable by the
instalments and on the dates set out in the Schedule.
2.2 The time of payment of each and every instalment shall be of the essence of this Agreement. Each
instalment in the amount shown in the Schedule includes an administration fee of an amount equal to the
Administration Fees (as shown in this Agreement) divided by the number of instalments payable under this
Agreement.
2.3 All payments under this Agreement shall be made to the address of the Creditor for payment shown in the
Schedule or at such other address as the Creditor will notify to the Customer. Payments despatched by post
shall be at the risk of the Customer.

3. Acceleration of Payments
3.1 If any of the following events occur;
3.1.1 an amount equal to, or more than, one monthly instalment has become overdue for payment under this
Agreement and the Customer has failed to comply with a default notice served on the Customer by the
Creditor, requiring the Customer to bring payment up to date within the period of at least 14 days specified in
the notice; or
3.1.2 the Customer provides incomplete or materially inaccurate or misleading facts or information in
connection with this Agreement, whether to the Creditor or to the Broker acting in negotiations for this
Agreement;
3.1.3 a bankruptcy petition is presented against the Customer or the Customer has a bankruptcy order or an
Interim order made against him under the Insolvency Act for the time being in force or (in Scotland) becomes
bankrupt or is sequestrated;
3.1.4 where the Customer is a firm, the firm is dissolved or a bankruptcy petition is presented against any
partner in the firm;
3.1.5 the Customer makes an arrangement or composition with or for the benefit of his (or where the
Customer is a firm its) creditors;
3.1.6 the Customer commits any breach of the terms and conditions (whether express or implied) of this
Agreement;
3.1.7 any attachment order is made against the Customer or any distress diligence execution or other legal
process is levied on any property of the Customer;
3.1.8 the Policy or any part thereof is cancelled or terminated or cover is withdrawn for whatever reason; then
the Creditor shall be entitled to require payment of the Total Amount Payable, less any payments already
received and less a rebate calculated in accordance with the Consumer Credit (Early Settlement) Regulations
2004 or any statutory or mandatory regulatory provision which replaces or supplements those regulations.

4. The Policy
4.1 Except as permitted by this Agreement the Customer will not cancel the Policy or do anything to vitiate it
and will comply with all directions and orders or requirements of the insurance company which issued the
Policy to keep the Policy in full force and effect.
4.2 In the event that a cover note or cover notes have been issued in contemplation of the issue of a Policy
then the Customer will do all acts matters and things necessary to complete the issue of the Policy prior to the
Creditor advancing the Amount of Credit to the Customer's Broker.
4.3 In the event that the Customer shall become entitled to a premium rebate or refund or other monies under
the Policy whether by reason of cancellation or termination or in the event of a claim becoming payable then
such monies shall be payable to the Creditor to the extent necessary to make any payment then due under this
Agreement and the Customer agrees to notify the Creditor of any such event
4.4 The Customer hereby irrevocably and unconditionally authorises the Creditor to cancel the Policy upon the
default by the Customer of any of the terms and conditions of this Agreement. On cancellation of the Policy by
the Creditor pursuant to this authority the Customer hereby irrevocably and unconditionally authorises the
insurance company which has issued the Policy to pay any refund of Premium directly to the Creditor at its
above written Address. The Customer acknowledges and agrees that the cancellation of the Policy will be
without prejudice to the Creditor's right to recover any loss or deficiency form the Customer.
4.5 In this Agreement:
‘Insurer' means the insurance company, which is to issue or has issued the Policy
'Policy' means the insurance policy or policies the premium in respect of which is financed by this Agreement
and includes any cover note or cover notes issued in respect of the Policy 'Premium' means the annual
premium or premiums payable in respect of the Policy
'Broker' means the insurance broker or intermediary who has arranged for the Policy to be issued.

5. Notices and Services


5.1 Any notice or other information required or permitted to be given by either party under this Agreement
shall be deemed to have been validly given if served personally upon that party or if sent by first class pre-paid
post to the address of that party as stated overleaf or to his last known address.
5.2 Any notice or other information sent by first class pre-paid post shall be deemed to have been received by
the other party within 48 hours after the date of posting.

6. Acceptance
This agreement shall be deemed to have been made on the date when in is signed by the Creditor.

7. General
Where two or more persons are stated to be the Customer, each of those persons shall be jointly and
severally liable for the performance of the obligations of the Customer set out in this Agreement.

The Creditor (“We”) will share your personal information and may add to your record with credit reference
agencies (CRA's). We will use your data to perform credit and identity checks on you, supply details of this
Agreement you have with us, any payments you make under it and any default or failure to keep to its terms.
These records will continue to be shared with CRA’s, and may be supplied to other organisations by the CRA’s,
while you have a relationship with us and may be used and searched by us and them to:
(1) verify the accuracy of the data you have provided to us, assess your creditworthiness and whether you can
afford to take the product;
(2) consider applications for credit and credit related services, such as insurance, for you and for any
associated persons;
(3) trace debtors, recover debts, prevent or detect money laundering and fraud, and to manage your
account(s).
CRAs may supply to us both public (including the electoral register) and shared credit, financial situation and
financial history information and fraud prevention information. When CRAs receive a search from us they will
place a search footprint on your credit file that may be seen by other lenders. The identities of the CRA’s, and
the ways in which they use and share personal information, are explained in more detail
at www.callcredit.co.uk/crain, www.equifax.co.uk/crain, www.experian.co.uk/crain. It is important that you
provide us with accurate information. We may check your details with fraud prevention agencies and if you
provide false or inaccurate information, or we suspect fraud, this information may be recorded. Fraud
prevention agency records will be shared with other organisations to help make decisions on credit, motor,
household, life or other insurance proposals or claims for you and members of your household. We will use
personal information about you which we acquire in connection with any application you make to us, or any
agreement you enter into with us, to manage your agreement and for statistical or market research purposes.
We may disclose the information that we hold about you to Associated Premium Funding Limited and other
agents for the purposes of recovering any debt that you owe us and, where necessary, tracing you. If we
propose to transfer, charge or assign, or agree to transfer or assign, our rights under your agreement to a
third party or if we employ a third party to manage any aspect of your agreement, we will pass relevant
information about you to such third parties. Any assignee of such rights or third party manager may hold your
information and use it in the same ways as we may, as described above. Your data may also be used for other
purposes for which you give your specific permission or, in very limited circumstances, when required by law or
where otherwise permitted under the Data Protection Act 2018. Your personal data may be retained
indefinitely after the duration of the contract. Where a quote does not progress to a contract, and we have no
other contract(s) with you, we will keep your data for a period of 18 months. In the case of complaints, claims
or legal disputes, or where required for legal or regulatory purposes we may retain your data for longer. Please

Granite Finance is a lender which provides finance through your insurance broker to allow you to spread the cost of
your insurance premium by monthly instalments instead of having to pay upfront for your premium in one lump sum.

How will your name show on my bank statement?
Payment collections on the account will be made with a reference “Acorn Insurance & Financial Service Ltd”.
I’ve received a Welcome Pack from you, what do I do now?
Please take time to read everything carefully, checking that all details are correct including direct debit details, the
amounts due and the date of collection. Please note we will communicate to you by email, so it’s really important that
you ensure we hold the correct contact information for you, so please take a moment to ensure that your email
address is correct and please keep us informed of any changes to your contact details. If you identify anything that is
incorrect, or would like to change anything, please contact us as soon as possible at
generalenquiries@acorninsure.co.uk so that we can rectify these.

Please note that any payment date request will move your payment date forward. If you are wishing to change your
upcoming payment date then, to ensure we can accommodate this, your request must be submitted 7 working days
prior to your current direct debit date in order for it to be amended in time for collection.

How to request to change my contact details?

confirmation once complete.
Should you wish to make a change to your address held on file or request something not mentioned above then

I have missed a payment; will I be charged a fee?
We do hope you will be able to make your payments on time, but If you do miss a payment then a £25.00
administration fee will be applicable, and this will be added to the arrears amount due.
I have missed a payment, what happens now? Will this affect my insurance?
If for any reason your direct debit is unsuccessful, we will notify you by letter or email. We would always
encourage you to contact us at generalenquiries@acorninsure.co.uk as soon as possible if you are
experiencing any financial difficulties.
You will then need to take urgent action to ensure the arrears are paid to prevent your insurance policy
being cancelled.
We will not try to take a missed payment again by direct debit, so it’s important to avoid cancellation of your
insurance policy that you get in contact with us, or use the link below to make your payment.

To make things as easy as possible for you there are two ways to do this:

We will always inform you of the timeframe for you to clear your missed payment, but if you do not make a
payment before the deadline passes, then unfortunately we will have no alternative than to regrettably
cancel your insurance policy.

We will write to you via email or letter to inform you that your finance agreement has been terminated and
your insurance policy has been cancelled as a result of the missing payment.

We do sincerely hope that your insurance will not be cancelled due to non-payment of your instalments and
therefore request that you please contact our team if you are having any difficulties in making the payment
by email at generalenquiries@acorninsure.co.uk.

What will happen if my policy is cancelled?

In the event of cancellation, you may be due a refund from your insurer. The refund relates to the remaining
period of insurance that has been unused.

Should there remain a shortfall between the finance agreement settlement figure and the refund due from
your insurer then your insurance provider will contact you to collect this amount.

Please be aware that, if a claim has been made resulting in costs to the insurer, then no refund as a result of
a cancelled policy would be due. Therefore, any remaining balance on your finance agreement will become
payable in full.

Can I pay my arrears using a third parties debit / credit card?


If you wish to settle your arrears using a card other than your own, then we can only accept it via our online payment
portal at https://portal.acorninsure.co.uk/ as mentioned above. Please note that only a payment received within
the deadline set and for the full arrears balance will keep your finance agreement and your insurance policy active.
Anything less will not prevent the cancellation of your cover, therefore if you cannot pay the full arrears, you must
contact us at generalenquiries@acorninsure.co.uk before the date has passed to discuss alternative options where
possible.
I am struggling to make my payments, what should I do?
We care about our customers and are here to help. We understand that there are times where financial difficulties

Yes. We want to be flexible to meet our customers’ needs so you can settle your finance agreement at any stage

I want to make a complaint. How can I do this?
Our customers are at the heart of everything we do, and it is our goal to provide a high level of service to our
customers always.
However, we recognise that things can go wrong occasionally and if this occurs we are committed to resolving matters
promptly and fairly.
If you wish to register a complaint, please contact us and we will try to put things right as quickly as possible. You can
