1. If the bidder is a Micro or Small Enterprise as per latest definitions under MSME rules, the bidder shall be
exempted from the requirement of "Bidder Turnover" criteria and "Experience Criteria" subject to meeting of
quality and technical specifications. If the bidder is OEM of the offered products, it would be exempted from the
"OEM Average Turnover" criteria also subject to meeting of quality and technical specifications. In case any
bidder is seeking exemption from Turnover / Experience Criteria, the supporting documents to prove his eligibility
for exemption must be uploaded for evaluation by the buyer.
2. If the bidder is a Startup, the bidder shall be exempted from the requirement of "Bidder Turnover" criteria and
"Experience Criteria" subject to their meeting of quality and technical specifications. If the bidder is OEM of the
offered products, it would be exempted from the "OEM Average Turnover" criteria also subject to meeting of
quality and technical specifications. In case any bidder is seeking exemption from Turnover / Experience Criteria,
the supporting documents to prove his eligibility for exemption must be uploaded for evaluation by the buyer.
3. The minimum average annual financial turnover of the bidder during the last three years, ending on 31st
March of the previous financial year, should be as indicated above in the bid document. Documentary evidence in
the form of certified Audited Balance Sheets of relevant periods or a certificate from the Chartered Accountant /
Cost Accountant indicating the turnover details for the relevant period shall be uploaded with the bid. In case the
date of constitution / incorporation of the bidder is less than 3-year-old, the average turnover in respect of the
completed financial years after the date of constitution shall be taken into account for this criteria.
4. Years of Past Experience required: The bidder must have experience for number of years as indicated above in
bid document (ending month of March prior to the bid opening) of providing similar type of services to any
Central / State Govt Organization / PSU / Public Listed Company. Copies of relevant contracts / orders to be

uploaded along with bid in support of having provided services during each of the Financial year.
5. Estimated Bid Value indicated above is being declared solely for the purpose of guidance on EMD amount and
for determining the Eligibility Criteria related to Turn Over, Past Performance and Project / Past Experience etc.
This has no relevance or bearing on the price to be quoted by the bidders and is also not going to have any
impact on bid participation. Also this is not going to be used as a criteria in determining reasonableness of
quoted prices which would be determined by the buyer based on its own assessment of reasonableness and
based on competitive prices received in Bid / RA process.

Buyer Added Bid Specific Terms and Conditions/ े ता ारा जोड़ गई बड क वशेष शत
1. Generic
OPTION CLAUSE: The buyer can increase or decrease the contract quantity or contract duration up to 25
percent at the time of issue of the contract. However, once the contract is issued, contract quantity or
contract duration can only be increased up to 25 percent. Bidders are bound to accept the revised
quantity or duration
2. Generic
Bidder financial standing: The bidder should not be under liquidation, court receivership or similar
proceedings, should not be bankrupt. Bidder to upload undertaking to this effect with bid.
AVAILABILITY OF OFFICE OF SERVICE PROVIDER: An office of the Service Provider must be located in the
state of Consignee. DOCUMENTARY EVIDENCE TO BE SUBMITTED.
Escalation Matrix For Service Support : Bidder/OEM must provide Escalation Matrix of Telephone Numbers
for Service Support.
5. Certificates
Bidder's offer is liable to be rejected if they don't upload any of the certificates / documents sought in the
Bid document, ATC and Corrigendum if any.

3. Only Sellers, who have fulfilled the eligibility criteria in Technical Evaluation, will be evaluated
further for Financial Evaluation.
4. Bidder should collect all the data of candidate (name, address, number, Aadhar no, cast certif
icate etc for min 1.5 candidates then enrol so dropout of trainee can be cover).
5. Self-Certified, Infrastructure Layout design with measurement & Lab equipment minimum req
uired as per Training Aids etc. locally available with the Seller. (at District location of the BUYER)

9. Experience Certificate.
The beneficiary of this Project will be ST candidate both boys and girls in age group of 18 to 55 yea
rs. The ST candidate will be selected by the Training agency from the Scheduled Caste Areas of Gujarat.
The Training agency will have full freedom to select any trainee. For this purpose, it can follow any
selection procedure like short-listing trainees from a long list, organizing road shows, interviews or opting f
or a short course to assess the aptitude of trainees. Allow all candidate should be register on E-SHRAM por
tal or Employment office.

a) The Bidder may propose training program in POP CORN MAKEING in which he has required intrinsic stre
ngth and can ensure fulfillment of the service delivery criteria.
b) The minimum period of course for the training program should be ( 30 days 100 HOURS) and the basic q
ualification for the trainee is not here.
c) Training Kits to trainees, including Bag, Books, Stationaries, etc. has to be provided by Bidder (Training A
gency) along with training.
d) Bidder (TrainingAgency) has to start the training within 10 days from the date of issue of the work order b
y the buyer and finish the same within the prescribed time frame and intimate the buyer in form of Attenda
nce of Trainees, Photographs Video-cd, Feedbacks, Row materials issue registeretc as provided by Buyer.
e) The modules may include soft skills like knowledge of spoken & written English language, personality dev
elopment, motivation, Computer literacy, etc. If required, a special foundation course for women trainees c
an also be implemented in order to ensure 30% participation of women candidate is preferable, tie up ban
k credit under existing self-employment programs and follow up of every trainee for 3 months after comple
tion of training course.
g) All physical facilities like classroom, equipment/instrument, etc. will be provided by Training agency. Thes
e facilities must be as per industry standards.
h) Training curriculum / content, methodology and training plan (both theory and practical) to be as per a re
cognized syllabus according to life skill empower portal design by GCVT.
i) The qualifications and experience of trainers/knowledge experts should be according standards of GCVT.
j) In case if the training agency gets their trained ST Candidate assessed from any of the Sector Skill Counci
l
The ST Candidates have to be trained in TAPI District (NIZAR TALUKA) Location only. The training agency
can arrange for the Boarding facilities for the eligible trainees over the duration of their training program /
module.
a) The Training Agency will have to adapt to the following service performance requirement: The ST Candida
te should be able to recover all the investments made on him/ her as part of the skill up gradation training
within 12 months of completion of training partial 20 remaining payment if required.
b) The Training agency will ensure employment of trained ST Candidates Allow all candidate should be regis
ter on E-SHRAM portal or Employment office.
i) The Bidder shall appoint, an authorize person not lower than the rank of Manager as “Co-Ordinator
-Bidder” to co-ordinate with the Buyer in all matters related to Bidder for the successful implement
ation and operation of the project and to be responsible for all necessary exchange of information
at any point of time.
ii) The Bidder shall provide all assistance to the BUYER representative/s as they may reasonably requi
re for the performance of their duties and services.
iii) The Bidder shall provide to the BUYER reports on a regular basis during the Implementation Period

and the Contract Period as per the “Monitoring Framework”.
iv) The Bidder shall appoint, supervise, monitor and control the activities of suppliers under their resp
ective agreements as may be necessary.
v) The Bidder shall be responsible for all statutory obligations/ liabilities like Salary in DBT form etc.

a) Grant in a timely manner all such approvals, permissions and authorizations which the Bidder may require
or is obliged to seek from in connection with implementation of the project and the performance of the Bid
der obligations.
b) BUYER shall release the funds in a timely manner, after satisfying itself of all the project related, statutory
and accounting aspects, so as to enable the Training Agency to satisfactorily implement the project and pe
rform its obligations.
c) The BUYER will have the right to cancel the contract without any prior intimation if any violation or any ch
ange in the procedure or any change applied by financial authority.
a) BUYER will conduct inspection of Infrastructural setup by the Bidder in the presence of a committee of ex
perts or institution nominated by the BUYER. The Acceptance Test must be completed by the Bidder to the
satisfaction of the Committee of experts or institution within a time specified level.
b) All the material purchased compulsory on GEM PORTAL by a bidder in the presence of a Committee of exp
erts or institution nominated by the BUYER.
The BUYER will have the right to cancel the contract without any prior intimation if the Bidder com
mits breach of any or allconditions of the contract. Breach of Contract includes the following:
a) It is found that the schedule of implementation of the project is not being adhered to.
b) The Bidder stops work and such stoppage has not been authorized by the BUYER.
c) The Bidder may become bankrupt or goes into liquidation other than for project or amalgamation.
d) The BUYER gives notice to correct a particular defect/irregularity and the Bidder fails to correct
The ownership of the database as and when created in the course of the execution of the work und
er this contract during the contract period without any liability will be automatically vested with the BUYER
. None of the physical facility and manpower created under this contract shall be transferred to BUYER.

ARTICLE - 10: DETAILS TO BE KEPT CONFIDENTIAL
1) The Bidder shall treat the details of the contract as private and confidential, save in so far as may
be necessary for the purposes thereof, and shall not publish or disclose the same or any particular
s thereof in any trade or technical paper or elsewhere without the previous consent in writing of th
e BUYER. If any dispute arises as to the necessity of any publication or disclosure for the purpose
of the Contract the same shall be referred to the BUYER whose decision shall be final.
2) The Bidder or his representative should neither disclose the data of project nor sell the data or us
e it for commercial exploitation or research work without the written permission of the BUYER.
The Bidder shall not transfer the Contract to anybody except with the prior permission of the BUYE
R.
1) SELLER has to provide all bill and document as per provided guideline separately andcompulsory
purchased from GEM.
2) MUSTER ROLL of trainee as well trainer
3) PHOTOS and VEDIO-CD of during training and tools/kits distribution.
4) Raw-material and all tools’ bills register on issue register and should produce over GEM only.
5) Rent agreement and proof of owner is only viable for payment of requisition.
6) Notary has been producing compulsory before training for bidder and after completion of training
with the consent oftrainee.
7) Completion certificate should be given at the time of completion of training.
8) As per institution or committee bifurcation will pay partymay verybase on performance.
7. Generic
The buyer organization is an institution eligible for concessional rates of GST as notified by the
Government of India. The services for which bids have been invited fall under classification of GST
concession and the conditions for eligibility of concession are met by the institution. A certificate to this
effect will be issued by Buyer to the Seller after award of the Contract. Sellers are requested to submit
their bids after accounting for the Concessional rate of GST.

Disclaimer/अ वीकरण
The additional terms and conditions have been incorporated by the Buyer after approval of the Competent
Authority in Buyer Organization, whereby Buyer organization is solely responsible for the impact of these clauses
on the bidding process, its outcome, and consequences thereof including any eccentricity / restriction arising in
the bidding process due to these ATCs and due to modification of technical specifications and / or terms and
conditions governing the bid. Any clause(s) incorporated by the Buyer regarding following shall be treated as

null and void and would not be considered as part of bid:-
1. Definition of Class I and Class II suppliers in the bid not in line with the extant Order / Office Memorandum
issued by DPIIT in this regard.
2. Seeking EMD submission from bidder(s), including via Additional Terms & Conditions, in contravention to
exemption provided to such sellers under GeM GTC.
3. Publishing Custom / BOQ bids for items for which regular GeM categories are available without any
Category item bunched with it.
4. Creating BoQ bid for single item.
5. Mentioning specific Brand or Make or Model or Manufacturer or Dealer name.
6. Mandating submission of documents in physical form as a pre-requisite to qualify bidders.
7. Floating / creation of work contracts as Custom Bids in Services.
8. Seeking sample with bid or approval of samples during bid evaluation process.
9. Mandating foreign / international certifications even in case of existence of Indian Standards without
specifying equivalent Indian Certification / standards.
10. Seeking experience from specific organization / department / institute only or from foreign / export
experience.
11. Creating bid for items from irrelevant categories.
12. Incorporating any clause against the MSME policy and Preference to Make in India Policy.
13. Reference of conditions published on any external site or reference to external documents/clauses.
14. Asking for any Tender fee / Bid Participation fee / Auction fee in case of Bids / Forward Auction, as the
case may be.
Further, if any seller has any objection/grievance against these additional clauses or otherwise on any aspect of
this bid, they can raise their representation against the same by using the Representation window provided in
the bid details field in Seller dashboard after logging in as a seller within 4 days of bid publication on GeM. Buyer
is duty bound to reply to all such representations and would not be allowed to open bids if he fails to reply to
such representations.
This Bid is governed by the General Terms and Conditions/सामा य िनयम और शत, conditons stipulated in Bid and
Service Level Agreement specific to this Service as provided in the Marketplace. However in case if any condition
specified in General Terms and Conditions/सामा य िनयम और शत is contradicted by the conditions stipulated in
Service Level Agreement, then it will over ride the conditions in the General Terms and Conditions.
In terms of GeM GTC clause 26 regarding Restrictions on procurement from a bidder of a country which shares a land border with India, any bidder from a country which
shares a land border with India will be eligible to bid in this tender only if the bidder is registered with the Competent Authority. While participating in bid, Bidder has to
undertake compliance of this and any false declaration and non-compliance of this would be a ground for immediate termination of the contract and further legal action
in accordance with the laws./ जेम क सामा य शत के खंड 26 के संदभ म भारत के साथ भूिम सीमा साझा करने वाले दे श के बडर से खर द
पर ितबंध के संबंध म भारत के साथ भूिम सीमा साझा करने वाले दे श का कोई भी बडर इस िन वदा म बड दे ने के िलए तभी पा होगा
जब वह बड दे ने वाला स म ािधकार के पास पंजीकृ त हो। बड म भाग लेते समय बडर को इसका अनुपालन करना होगा और कोई भी
गलत घोषणा कए जाने व इसका अनुपालन न करने पर अनुबंध को त काल समा करने और कानून के अनुसार आगे क कानूनी कारवाई
का आधार होगा।
