AFFIDAVIT OF ARREST

I, SPO3 Lycel L. Lozada, of a legal age, Filipino, Single and a member of

Philippine National Police, presently assigned at Iba Police Station, Zambales, do
hereby dispose and state:

01. On or about 7:00 o’clock in the morning of November 19, 2023, a

Confidential Informant (CI) who was tasked to monitor the illegal drugs
activity of Brian C. Ursua, arrived at our office and inform SPO4 Miguel
Marcellana that he was able to set a deal with Brian C. Ursua. That the CI
further informed that Brian C. Ursua transacts to buyers of shabu with a
minimum order of worth of One Thousand Pesos.

02. Upon receiving said information, SPO4 Miguel Marcellana immediately

inform our Chief of Police PSI RICARDO LOPEZ who then instructed to
form a team and plan for the conduct of possible police buy bust operation
against Brian C. Ursua based on the information received from our CI;

03. On or about 12:00 o’clock in the afternoon of the same date SPO4 Miguel
Marcellana formed the team and conduct initial briefing based on the
detailed information given by the CI;

04. During the initial briefing, I SPO3 (Lycel L. Lozada) was designated as the
arresting officer while PO1 Aj Sangalang will act as poseur buyer. After
which our Team Leader handed to PO1 Aj Sangalang one (1) piece genuine
one thousand peso marked bill.

05. On or about 2:00 o’clock in the afternoon of the same date, the team
proceeded to Purok 2, Bagong Kalsada, Palanginan in front of the
Torcadilla’s Store for the conduct of possible anti-illegal drug buy bust
operation;

06. SPO4 Miguel Marcillana instructed us (SPO3 Lycel Lozada, PO1 Aj

Sangalang) to proceed to the designated area of transaction which is in
 Palanginan Iba, Zambales and we positioned ourselves strategically within
the area of transaction. After minutes of waiting, SPO3 Lycel Lozada noticed
the several motor vehicles passing along the street and suddenly the Brian
Ursua wearing black T-shirt was walking towards PO1 Aj Sangalang while or
the Poseur Buyer. PO1 Aj Sangalang was using a motorcycle and they meet
halfway in front of the grey gate. Aj Sangalang immediately introduced
himself as a as a buyer of Shabu. A conversation ensued between them
( PO1 Aj Sangalang and Brian Ursua) after which Brian Ursua immediately
asked for the payment as he Brian Ursua open his bag and handed to PO1
Aj Sangalang one (1) pieces heat sealed transparent plastic shachet
containing white crystaline substance suspected to be Methamphetamine
Hydrochloride known as "Shabu" and in return (PO1 Aj Sangalang) gave the
one (1) thousand pesos as the buy bust money consisting one (1) piece
genuine one thousand pesos marked bill. Upon confirming that the content
of the plastic sachet is indeed shabu, immediately he (PO1 Aj Sangalang)
gave the pre arange signal which is heading towards the vehicle. I,(SPO4
Lycel Lozada) and the rest of the team immediately drove over where Brian
Ursua was heading and blocked him from escaping using our L300 vehicle
and identified ourselves as a Police. I,(SPO4 Lycel Lozada) immediately
held and frisked Brian Ursua and conducted body search, recovered from
his direct control and possession the one (1) thousand buy bust marked
money, one (1) unit of IPhone 6s mobile phone and the three (3) pieces heat
sealed transparent plastic sachet containing White crystaline substance and
money in different denominations amounts to Five (5) Hundred pesos (Php
500.00).
07. Brian Ursua was inform of his violation in selling and possessing of dangerous drugs and
thereafter I, (SPO4 Lycel Lozada) appraised him of his constitutional rights but he opted to
remain silent. The team together with the arrested suspect immediately proceeds to Iba
Municipal Police Station for the conduct of marking, inventory and documentation of
confidcated pieces of evidence. The arrested person was identified as BRIAN URSUA, 20
years old , single, jobless and a resident of Barangay Dampay Palauig, Zambales the
inventory of the pieces of evidence were dine in the presence of the arrested person
(BRIAN URSUA) as witnessed by Hon. Lucifer Gwapito, Chairman of Barangay Palanginan
Iba, Zambales and Atty. Diego Romualdez a representative from the Department of Justice
(DOJ). No representative from the media witnessed the inventory despite earnest efforts
made in requesting their presence.
08. The confiscated suspected shabu were immediately forwarded to Provincial Crime
Laboratory Office based at Police Provincial Office Iba, Zambales.
09. I am executing this affidavit freely and voluntarily as I attest to the truthfulness and
veracity of the wbove mentioned facts.
