APPLICATION FOR PROBATION

Comes now the undersigned applicant, assisted by the

undersigned counsel, hereby apply for probation under the
provisions of Republic Act 10707 amending Presidential Decree
No. 968, as amended, and declare that:

1. On 25 October 2023, applicant was found guilty of the

lesser crime of Slight Physical Injuries in Criminal Case
No. 2711B and was sentenced to suffer the straight
penalty of twenty (20) days of arresto menor.

2. Before judgment becomes final and executory, the

accused intends to avail the post-judgment remedies
available to him. Hence, this submission;

3. Applicant Jomar Panum, is a male, 23, single and a

resident of Sitio Pintor, Brgy. Balatasan, Bulalacao,
Oriental Mindoro, as evidenced by a Certificate of
Residency issued by the Punong Barangay of Barangay
Balatasan, Bulalacao, Oriental Mindoro, copy of which is
herein attached as Annex “A”;

4. The applicant has no prior conviction nor other pending

case as evidenced by a Certification issued by the 3rd
Municipal Circuit Trial Court of Mansalay-Bulalacao,
Mansalay, Oriental Mindoro, having jurisdiction over his
residence, copy of which is herein attached as Annex “B”;
 5. That he has not yet begun to serve the term of
imprisonment imposed upon him as he is out on bail and
that this application was made within the period to appeal
after the promulgation of judgment. The accused hereby
signifies his desire to not appeal the same judgment;

6. That the sentence which he is supposed to serve does not

exceed six (6) years;

7. That the crime of which he was convicted of is not an

offense against national security;

8. That he has not been previously convicted by final

judgment of any offense with a penalty of more than six
(6) months and one (1) day and/or a fine of more than
One Thousand Pesos (P 1,000.00);

9. That he has never been on probation under the provisions

of Republic Act 10707 or Presidential Decree No. 968, as
amended;

10. That in resolving this application for probation, it is

respectfully prayed of this Honorable Court to consider the
foregoing circumstances in favor of the applicant.

WHEREFORE, premises considered, it is most respectfully

prayed of this Honorable Court that the accused be allowed to
apply for probation.

Other reliefs just and equitable under the premises are

likewise prayed for.
