Annex 1: Information on Online Contracts


(1) This annex informs the customer about the special features of contracts that are closed online
according to Art 4 paragraph (1) of the Austrian Fern- und Auswärtsgeschäfte-Gesetz (FAGG).

(2) Essential features of the offering: The customer provides SmartBytes with a Power of Attorney to trade
virtual currencies in the name and on account of the customer according to the portfolio strategy
chosen by the customer. In the extent of this relationship, SmartBytes creates accounts in the name
and on account of the customer with its partners. The partners hold virtual currencies and carry out
the transactions. At no time does SmartBytes hold any virtual currency or any other balance of the
customer.

(3) Company information: SmartBytes GmbH, Schönbrunner Straße 131 2/1, 1050 Vienna. Registered in the
company register under the number 514983 d, the responsible commercial registry is the
Handelsgericht Wien. SmartBytes can be contacted via phone through +43 670 4026701 and via email
through info@coinpanion.com. CEO of SmartBytes is Alexander Valtingojer.

(4) Total price: The portfolio’s profit or loss results from the performance of the virtual currencies held on
the customer’s accounts. The price of these virtual currencies can rise or fall at any time and the
investment is affiliated with risks. The investment can result in a loss and even a total loss cannot be
ruled out. In addition to the portfolio performance, the customer pays fees to SmartBytes and the
partners. The current fees are listed on the SmartBytes website and in the Terms and Conditions.
Whenever the fee structure is changed, the customer is informed via his email address.

(5) No withdrawal from the contract: According to Article 11 of the Austrian Fern- und Auswärtsgeschäfte-
Gesetz (FAGG), the customer has the right to withdraw from the contract within 14 days without giving
reasons. The customer acknowledges and declares that the 14-day period of notice becomes void as
soon as he begins using the services provided by SmartBytes, as stated in Article 18 paragraph (1) of
the FAGG. Furthermore, the customer can withdraw the current Euro value of his portfolio at any time
through the website offered by SmartBytes (login through https://coinpanion.com) and that he can
terminate the contract at the end of the month. If the customer chooses to terminate the contract, the
fees accrued until the termination through use of SmartBytes’ services are payable by the customer.

(6) Warranty: SmartBytes is not liable for any losses incurred by the customer. SmartBytes clearly
emphasizes that the investment in virtual currencies is affiliated with risk and that losses can be
incurred. Even a total loss cannot be ruled out.

(7) Contract term: The contract term is indefinite. The customer can withdraw the current Euro value of
his portfolio at any time, and he can terminate the contract at the end of the month. The contract does
not include a minimum term.
