Preliminary Objections:
1. That the partition is liable to be effected by equal share (KABJA TOD KE)
with equal value of the land to each share holder.
2. That land abutting passage/phirni/road be allotted to parties as per their
share.
On Merits:
1. Para 1 of the application is correct that the suit land is joint between the
replying respondents as well as applicants.
2. Para 2 of the application is correct.
3. Para 2 of the application is absolutely incorrect and hence denied. It is
absolutely incorrect that respondents put the matter pending with one
pretext with other. It is asserted that the suit land is liable to be
partitioned by equal share (KABJA TOD KE) with equal value of the
land to each share holder.
It is therefore prayed that the partition may kindly be effected by equal share
(KABJA TOD KE) with equal value of the land to each share holder and equal
frontage as per share of the parties and passages be drawn from the common pool.
