This anticipatory bail application has been filed on behalf
of accused Smt. Farra Qureshi, in Cr. No. 189/2021, P.S.
Dalanwala, Dehradun, u/s 3/4/6/7/8 Immoral Traffic
(Prevention) Act.
2. As per the applicant, she is innocent and falsely
implicated in the case. That accused has been implicated in
this case on the disclosure statement of co­accused. She is
having license of the Spa and it is a registered Spa. She has not
arrested on the spot and she was not present on the spot. Role
of the accused is not defined. All co­accused persons has
already been enlarged on bail. Applicant/accused has small
children and there is no one to take care of them and the
offense is triable by the Magistrate. That accused will
cooperate in the investigation. Accused is having no criminal
history and she is not convicted previously. She is ready to
furnish satisfactory sureties. Thus she may released on bail.
3. Application is supported with an affidavit of accused,
where it is stated that this is the first bail application on behalf
of accused and no other bail application is pending or rejected
by any other Court including the High Court.
4. Prosecution has opposed the bail application and filed
the report. Investigation officer of the case where it is stated
that applicant is the owner of the said Spa in which immoral
trafficking was found and it is also stated that accused flee
away at the time of raid and there is every likely hood that
applicant may flee away.
5. I have heard the ld. Cousel for the applicant Sri. Yaspal
Singh Pundir and ld. D.G.C. (Criminal), Sri G.P. Raturi and
also perused the police papers.
6. As per the F.I.R. the raid was conducted by the police on
some secret information at Angel Spa situated at Rajpur road,
2nd floor, city central complex on 21.08.2021 with the
association of two independent witness of the NGO. During
this raid it was found that this Spa is involved in prostitution
and certain customers with some girls, who were involved in
sexual activities, were arrested on spot. During the course of
investigation the name of the present accused came into light
and F.I.R. was registered on the basis of raid report, as case
crime number 189 of 2021, under section 3/4/6/7/8 of
Immoral Traffic (Prevention) Act, 1956.
7. Applicant is the owner of this Spa, which was being used
as a brothel and accusation of under section 6 of Immoral
Traffic (Prevention) Act attracts a penalty of minimum seven
years imprisonment which may be for life imprisonment.
Therefore the allegations against the accused are of serious
nature. Looking into the nature and gravity of the accusation,
it is not a fit case where anticipatory bail should be granted.
Therefore anticipatory bail application of the accused is liable
to be rejected.

8. Anticipatory bail application of the accused Smt. Farra
Qureshi with reference to crime no. 189/2021, U/s 3/4/6/7/8
Immoral Traffic (Prevention) Act, 1956, P.S. Dalanwala,
Dehradun is hereby rejected.
9. Interim order dated 10.09.2021 comes to an end.
