1 . Introduction

1.1.1 Dewan Bandaraya Kota Kinabalu

Kota Kinabalu City Hall (DBKK) is the local government that


administers the City of Kota Kinabalu, Sabah. The council serves to
provide municipal services to the residents.

It is also responsible for public health and sanitation, waste


management and disposal, urban planning, environmental protection and
control, economic and social development, traffic management and
general maintenance of urban infrastructure . DBKK is also a local
government.

1.1 About Local Goverrnment

Local government in Malaysia is the lowest level of government in a


system of government in Malaysia. It has the power to impose limited
taxes such as gate tax . In addition these government agencies can enforce
by-laws (or by-laws) on residents who are within their administrative
areas .

Usually the highest official in local government is called the mayor of


the city , while the Yang di-Pertua Majlis or President of the municipality
and also the district councils .

3.0 Dewan Bandaraya Kota Kinabalu ( DBKK ) History

On 2 February 2000 , Kota Kinabalu was declared as the sixth city in


Malaysia . It covers an area of 350.70 square Kilometers with a
population of over 437,500 people . The population consists of all major
races and more than 30 ethnic groups in the state of Sabah . Kota
Kinabalu was established on 2 February 2000 through the city enactment
kk 1996 .

After it was gazetted and approved by the Sabah state assembly on


November 1996. All administrative matters and the role of the KK
Municipal Council was taken over by the Kota Kinabalu City Hall .The
administrative area of DBKK includes the city center, suburbs,
countryside and the sea as well as islands.

This administrative area is divided into several categories, namely:

- An area of 108.90 square kilometers or 31.1% of the total


administrative area.
- The area of operation is divided into zones, namely Kota Kinabalu,
Tanjung Aru/Kepayan, Nountun, Inanam, Kuala Inanam, Menggatal
Utara, Kuala Menggatal and Telipok.

Kota Kinabalu City Hall is administered and headed by a mayor


appointed by T.Y.T who is the President of the State of Sabah and
assisted by a director general and two Deputy Directors General who
each lead the operational sector and the corporate sector .

5.0 Scope and Task

Duties of local authorities by category:

5.1 Environment

- Maintenance and improvement of environmental areas under their


jurisdiction, covering services such as cleaning, collection and disposal of
solid waste, proper drainage and construction as well as area
beautification programs.

5.2 The Public

- Slaughterhouses, services, veterinary, transportation, burial grounds and


even crematoriums.

- Manage sanitation systems and solid waste, clean ditches and roads,
maintain the entire environment in the area.

- Licensing of sales stalls, small traders, shopkeepers and business


operators who can outwardly disturb public order is also the
responsibility of the local authority.

6.0 Main Function Dewan Bandaraya Kota Kinabalu ( DBKK )

Kota Kinabalu City Hall has an important role to develop and develop
its administrative area through the following functions such as Maintain
cleanliness by providing services such as garbage disposal, sewerage,
cleaning of drains, drains and grass cutting .

DBKK also Provide and maintain public facilities for the convenience
of residents such as roads, resorts , ditches, street lights, car parks, public
markets and other facilities .

In addition, provide and maintain the beauty of the city and


recreational facilities such as parks, beaches, sidewalks and road dividers,
tourist attractions and resorts .

In fact , DBKK also plans and implements development in an orderly


manner in accordance with the Town and Country Planning Ordinance
1950 and the Building By-Laws 1951 through the study of building
development plans and the control of illegal buildings .

DBKK also handles, monitors, monitors and controls public health


examinations through law enforcement and approving business licenses,
hawker licenses and so on .

Accordingly, it also invests in profitable development projects to


supplement financial resources .

7.0 General purpose of Dewan Bandaraya Kota Kinabalu ( DBKK )

General purpose of kota kinabalu municipal council like help achieve


the Vision Mission Objectives and Functions of DBKK . After that , Plan
and coordinate research activities at the departmental and organizational
level of DBKK . Besides that , Cultivating Innovation and Creativity in
DBKK services and Coordinate the implementation of Local Agenda 21
(LA21) .

8.0 Administrative Management Function

The administrative management function of the Kota Kinabalu municipal


council consists of

8.1 Administration Division

8.1.1 To manage and coordinate the affairs of the rural administration,


suburbs and archipelago of Kota Kinabalu .

8.1.2 Coordinate the planning, implementation, monitoring and tracking


of the implementation of development policies and programs/projects
brought in the meeting of the District Development Action Committee .

8.1.3 Updating the Village Profile Application System under the Kota
Kinabalu district administration .

8.1.4 Coordinate recommendations and certify recommendations for the


appointment, extension and termination of the post of Adat Head (District
Head, Native Head, Deputy Native Head, Village Head, Chinese
Community Head) .

8.1.5 Coordinate, implement and monitor the management of the Village


Development and Security Committee (JPKK) and the Urban Community
Committee (JKDB) .

8.1.6 Assist in coordinating district disaster management such as PKOB,


PPS and assistance .

8.1.7 Process the confirmation of water and electricity supply
applications for gazette villages .

8.1.8 Process and submit complaints to the relevant Division/Unit for


action .

To achieve the Mission and Vision of DBKK, the Legal Department has
been divided into six (6) divisions, namely:

9.1 Litigation Division :

- Make civil claims in the Subordinate Courts against unpaid debts


against individuals, Companies or the like based on existing legal
provisions.

- Responsible for ensuring that all arrears of CHKK revenue are paid by
creditors based on existing legal provisions.

- Attend meetings/discussions related to CHKK revenue collection .

9.2 Prosecution Division

- Provide advice related to public complaints involving violations of any


By-Laws, Ordinances, Enactments and Acts adopted by Kota Kinabalu
City Hall .

- Prepare and make Charge Sheets and summons on cases of violations


under the By-Laws of Kota Kinabalu City Hall, Ordinances, Enactments
and Acts enforced by DBKK.

- Prepare and prosecute any party who has violated the By-Laws of Kota
Kinabalu City Hall, Ordinances, Enactments and Acts enforced by Kota
Kinabalu City Hall .

9.3 Drafting and advice division

- Review and make amendments to any By-Laws of Kota Kinabalu City


Hall .

- According to current needs or based on management decisions in line


with the public interest.

- Review and draft By-Laws according to current needs or based on


management decisions in line with the public interest.
Perform duties as directed from time to time.

9.4 Part of the agreement

- Make detailed research on a project or activity from a legal aspect
before a project or activity is carried out.

- Prepare Agreements or review agreements involving Kota Kinabalu


City Hall with any party to ensure the rights and interests of Kota
Kinabalu City Hall are safeguarded.

- Provide advice to the Mayor and internal departments of DBKK on


contracts/agreements involving the needs of DBKK.

- Perform duties as directed from time to time

9.5 Administration Division

- Manage and coordinate if there is any damage in the office space of the
Legal Department and then ensure repairs are done.

- Manage and coordinate updating the files in the Legal Department by


entering letters and information into the relevant files as well as the latest
to prepare the file folio neatly and orderly. This includes looking after
and monitoring failed movements in the Legal Department as well as files
from other departments assigned to this department.

- Record and update the personal files of each staff of the Legal
Department including leave, sick leave, courses and other related matters.
- Operate/coordinate office equipment or items in accordance with
established disposal procedures .

-Identify, order and control office equipment needs and manage office
equipment, keys and other related items.

- Arranging official vehicles for officers performing official duties


outside the office.

- Manage and coordinate the Manual of Working Procedures (MPK) and


failed desks (FM) as well as the monthly report of each staff before being
sent to the Director of the Legal Department for review and confirmation.

9.6 Section court

this court is divided into two, such as ;

 Magistrate Court

- Arranging case hearings and liaising with Kota Kinabalu Court Officers
in all Court matters to facilitate the smooth running of Court sittings.

- Prepare a list before the Court sits.

- Provide Statistics for Civil Cases and Departmental Summons Cases to


be submitted to the Kota Kinabalu Magistrate's Court.

- Manage and update the files in the City Magistrate's Court


Division/District Native Court by inserting the latest letters and
information into the relevant files as well as prepare the file folio neatly
and orderly.

- Handle the disposal of dockets to the City Magistrate's Court.

 District Native Court

- Coordinate the registration of cases in the District Native Court.

- Register cases and open a docket for each new case and manage all the
registration process.

- Record the decision sentence into the register book.

- Arrange court case schedule and discuss/liaise with the Director of the
Legal Department in all court matters.

- Prepare monthly reports and submit to the Director of the Legal


Department.

10.0 Sector - Sector of Dewan Bandaraya Kota Kinabalu ( DBKK )

10.1 Operation Sectors

Operation Sectors of DBKK like a Department of Enforment . It’s


responsible for enforcing applicable laws and controlling the security of
buildings and property of the city Kota Kinabalu .

Thus , Landscape department . Landscape department has 4


department which is Landscape Plan Approval Process and Development
Plan , OC Support and Site Hardware , Landscape management and
maintenance , Management and Maintenance of Public Parks , then
Management and Maintenance of “ Hardscape ” and Children’s play
Equipment .

Licensing Department . It’s process and produce business licenses


which include hawker and small trader license , premise license ,
advertising licenses . Implement revenue collection through license fees ,
Market Stall Rental and DBKL Hawker Center . Besides that , Implement
the enforcement of compliance with license conditions on licenses issued
by the department .

Solid Waste Management Department . It’s make policies or laws .


As monitor project implementation , perform daily operations ( solid
waste collection and public cleaning ) . Then , enforce the law under the
provisions if the City Enactment .

10.1.1 Planning and Development Sector

City Planning Department the one of planning and development
sector . That plan and control development in accordance with the
requirements of the planning scheme , existing policies and guidelines .
Processing land application and land lease extension applications . Also
provide planning layout plan and planning guideliners .

Engineering Department . It divide to 3 units such as


Development Planning and Control . Its processing engineering plans
( earthworks , drainage system and sewerage system ) and civil works
plan . Manage the public complaints regarding related engineering or
infrastructure issues and process applications for Certificate of
Completion for Infrastructure or Civil , structural and M&E Works in a
developments project . After that , Asset / Infrastructure Development
and Maintance . Its coordinate and monitor the implementation of
infrastructure development and maintenance projects under the
supervision of the department budget , including building and related
CHKK assets . Its also manage and maintain DBKK official vehicles
based on the circular letter in force . Lastly , Coordinate and control the
use of the department budget , including allocation sources from the
States and Federal Governments, for development and maintenance
programs .

Continuosly , Administration and Management . Improve and review


according to current needs and the suitability of the Missions , Vision ,
Objectives , Function and Client’s Charter of the department including
assignment and placement of members of members in all parts of the
department and manage the record center and storage of all relevant
official documents .

10.1.2 Department of Community Walfare

Departmen of community walfare divided into 4 units . The first is


Administration Division , that is manage and coordinate the affairs of the
rural administration and archipelago of Kota Kinabalu . Then , process
the confirmation of water and eletricity supply applications for villagers .

Secondly , Development Division . It’s coordinate the preparation of


scope , specifications and list of quantities as well as drawings and details
of the project . It’s also coordinate site visits before , during and after
including inspection cisits by allocating agencies and preparation of site
visit reports and coordinate the preparation of complete and updated
project implementation performance reports including sick project
implementation reports .

Thirdly , Poverty Eradication division . Its coordinate , implement and


monitor urban and rural poverty eradication programs , coordinate the
screening and verification of applications for the new E-kasih register in
Kota Kinabalu district with community leaders and other agencies and
coordinate the E-kasih registration and verification process , including
implementing the E-kasih announcement program through briefing
sessions and car .

Lastly , Regional Level Secteratiat . Its about District Adat Chief


Appointment Screening Committee with the role of recommending the
appointment , extension and termination of Adat Chief , Ditricts Trustee
Committee with the role of coordinating and approving new lot
applications and change of nominee of reserve village land lots and
District Poverty Eradication Focus Group Committee with the role of

acting as a working group and leading to the achievement of poverty
eradications goals .

10.1.3 Department of transport and traffics

This about plan , design , build and maintain public transport facilities
, collaborates with the relevant agencies in planning bus service routers in
the city and conduct road audits for road safety and defection of
improvements that need to be implemented .

10.1.4 Building Control Department

This department about building plan processing , building and


structure control , Certificate of Occupancy ( OC ) Processing and
Enforcement of relevant laws . monitor the facilities and
infrastrusture of tourist hotspots inside and outsides the city and provide
and intensity efforts to promote the City of Kota Kinabalu .

10.1.5 Department of Architects and Special Project

Implement special development projects of DBKK , plan and


impement the Design of Buildings and Public Facilities projects within
the City Area . Identify , monitor and take action on dilapidated , derelict
and dirty buildings

10.2 Management Services Sector

10.2.1 Department of Human Resource Development .

Ensuring that the operations of this department will be at a more


advanced level going forward by introducing better concepts . Then ,
ensure the implementation of policies and issues related to staffing ,
salaries , remunareration , pensions , remuneration and disciple .

10.2.2 Department of Corporate Affairs

Coordinate the requirements and protocol of DBKK , cordinate the


supply of votes and inventory and implementary offical events of DBKK
and assist in the coordination of official events as the State , National and
international .

10.2.3 Legal Department

Legal Department divided into 4 units . The one of legal department


is Litigation Division . That povide advice on matters related to civil
claims to the relevant internal departments of DBKK . Provide summons
and related documents for civil claims to the Court .

Then , Prosecution Division . Its obtain and coordinate the execution


of Court Orders such as Closing Orders . Its provide advice related to
public complaints involving violations of any By-Laws , Ordinances ,
Enactments and Act adopted by Kota Kinabalu City Hall .

Continously , Draft and Advice Section . Thats about review and
make amendements to any By-Laws of Kota Kinabalu City Hall based on
the decision of the management in accordance with the public interest .

Lastly , Part of The Agreement . Its make detailed research on a

DBKK on contracts/agreements involving the needs of DBKK .

10.2.4 Department of Information Technology

Oversee the implementation of the Organization’s Information


Technology Policy . Then , its provide the organizations infrastructure
and also provide computer hardware and equipment to all departments in
the organization .

10.2.5 Department of Research and Innovation

Plan and coordinate research activities at the departmental and


organizational level of DBKK . This department help achieve the Vision ,
Mision Objectives and Functions of DBKK and also cultivating
innovation and creativity in DBKK services .

10.2.6 Department of Data Management and Digitization

Center of the DBKK database . Its develop DBKK’s digital records


management system . And it also develop a digital data reception and
storage system .

Its coordinate Public Complaints , coordinate announcements or


publicity and its plan and coordinate working visits .

10.3 Financial Management Sector

10.3.1 Evaluation Department

Evaluation department divided into 2 units. The first is Property


Valuation Division. This unit responsible for preparing the Annual Rate
Order for Kota Kinabalu City Hall and finding alternative sources of
income that exist on optimal land use.

Next is Valuation Operations Management Division. This unit


function as responsible for ensuring that work activities in the Evaluation
Department run smoothly. Secondly, responsible for producing/printing
official forms/documents used by the Valuation Department.

10.3.2 Property Management Department

Property Management Department was created for To ensure the


Systematic and effective Property Management of Kota Kinabalu City
Hall in accordance with the provisions in section 49, Local Government
Ordinance 1960 and Kota Kinabalu City Enactment 1996.

10.3.4 Department Of Finance And Budget

This department plays a role in collect all revenue, deposits and other
reasonable payments and are banked and accounted. Secondly, oversee
and fully control the Annual Budget and conducting Financial
Management And Accounts.

Through that objectives , people must know that Dewan Bandaraya


Kota Kinabalu ( DBKK ) has many function with any department like
operations sector and management services sector DBKK . Dewan
Bandaraya Kota Kinabalu also make easier to all people in Sabah with
main function like improve the quality of life of city dwellers through the
provision and control of beneficial facilities and others .
