NOOR FOUNDATION

EMPLOYMENT CONTRACT

THIS CONTRACT IS MADE BETWEEN THE NOOR FOUNDATION REFERRED AS THE EMPLOYER

AND

Mr. /Mrs. /Ms.

HEREAFTER CALLED THE EMPLOYEE.

The two parties hereby agree as follows:

1. Nature of the Contract:


This contract is fulltime. The employee shall work as _____________________ of Noor Foundation at
Bosaso, Puntland, Somalia, and will carry out the duties and responsibilities specified in the terms of reference
(TOR) attached to this contract with the reference of ___________

2. Duration of the Contract:


This contract starts from ____________________ and will end on ________________. This contract will be
confirmed after satisfactory performance of probation period of Three months. Extension and or renewal of the
contract shall be possible by mutual written agreement after the overall performance of the employee measured
against expected performance as stated in the terms of reference (TOR).

3. Normal Working Hours:


The normal working time is 40 hours per week, which is ____ hours per day except weekends which is Friday or public
holidays considered under this contract are IDD -UL-FITR (2 Days) and IDD-AL-ADHA (3 Days) and other holidays
may be announced by the foundation management from time to time.

4. Duty Station:
The employee duty station is Bari Region, Somalia. In addition, the duty station may change from time to time and
from place to place based on the situation

5. Salary:
The net monthly salary of the employee is $750 as a Noor Foundation Somalia Manager

6. Summer
The summer time is 3 months (Jun, Jul and Aug), and since the schools are closed during this period the
salary will be ______

7. Severance Pay
No severance pay (no termination benefit) will be provided to the employee in case of termination of the present
contract.

8. Termination of Contract

Noor foundation is a local organization relies on its staff members for the provision of its services. In case the staff
member, in any reason, decides to terminate the present contract, he/she should give a written notice two months
prior to the date of the termination. The organization will have the right to charge one full month’s salary against
the employee if he / she fail to do so.

In any case the Noor Foundation decides to terminate the present contract; it will give a written notice to the
employee one-month prior the date of the termination.

9. Additional Contract Considerations for Termination of Contract


If Noor Foundation administration understand that it’s important the termination or cancelation of this contract
due to violation of the constitution/policy/reputation/ or conflict of interest etc. The Noor Foundation
management can do immediate termination or cancelation of this contract.

10. Noor Foundation Property


The employee agree that information obtained or learned while working on behalf of Noor Foundation is
the property of the Noor Foundation and is confidential. All reports, letters, memos, books, articles and/or
documents prepared by the employee either alone or with others, in the course of this contract with the
employer, shall be deemed to be “works made for hire” and shall be and remain the property of the
Noor Foundation.

11. Voluntary Absence and tardiness


Voluntary absence from the work by the employee shall entail the loss of all remuneration of the period of
absence. If it is more than five days, the employer shall have the right to terminate this contract with and
without reference to the employee.

12. Sick Leave


If you are unable to attend work for any reason and your absence has not previously been authorized you
must inform your Line Manager of the fact of your absence and the full reasons for it at least 5 hours before
your working time.
13. Force Majeure
If Noor Foundation activities in Puntland/Somalia are forced to cease temporarily due to political development or
civil strive or natural causes or severely deteriorating security situation or civil war or pandemic/epidemic disease,
this contract will be void immediately.

14. Arbitration
In the event of any dispute arising during the contract period, the parties enjoined in this contract will make every
effort to resolve the said dispute amicably. In the event that the parties cannot resolve the dispute amicably,
the aggrieved party will be at liberty to seek recourse under the relevant laws of Puntland, Somalia and the
constitution of Noor Foundation and the Islamic law.

15. Politics
During this contract employee must not be part of any political organization or participate in
