Order below Exh.19 in Cri. M.A. No.110/2017:­

Heard Ld.APP Shri.Keskar who has filed Say at

Exh.20 on 2/1/2017. Heard Ld.APP Shri.Keskar and the
I.O. who have submitted Say Exh.21 to application Exh.19
for giving interim protection for 15 days from arrest of the
applicant to enable him to file bail application before the
Hon'ble High Court and to bring interim relief but as per
submission of prosecution just after dismissal of bail
application i.e. Criminal M.A.No.110/2017 that the I.O.
had arrested the applicant and therefore the present
application Exh.19 is not tenable. The Say Exh.20 and 21
filed in writing clearly show that the applicant was arrested
by the I.O. In the circumstances Exh.19 is not tenable.

2. Today Ld.Advocate Shri.Deshmukh for applicant has

appeared and submitted that the applicant was arrested and
today produced before the Ld.Sub­ordinate Court for
remand which has fortified that the applicant is in the
custody of police. In the circumstances the application
Exh.19 has become infructuous and not tenable and
therefore could not be allowed and stands rejected.
