COMPLAINT-AFFIDAVIT
I, ROQUE G. SENSANO, of legal age, Filipino, married, with address at Zone 5, Tamucco,
Santo Niño, Cagayan, after having been duly sworn to in accordance with law, hereby depose
and state that:

1. I am executing this Complaint-Affidavit to cause the criminal prosecution of my

legal wife ANNALIZA DURAN SENSANO, with address at Blk. 27 Lot 14 Mt. Carmel Road,
Montevista Heights, Barrio Dolores, Taytay, Rizal and her paramour FERNANDO B. AGUSTIN, a
married man who is also my brother-in-law, with address at Blk. 27 Lot 14 Mt. Carmel Road,
Montevista Heights, Barrio Dolores, Taytay, Rizal for the crime of Adultery as defined under
Article 333 of the Revised Penal Code.

2. The facts of the case are as follows.

3. On April 4, 2003, Annaliza D. Sensano and I got married. Attached herewith is a

copy of our Certificate of Marriage as Annex “A” and made an integral part of this Complaint-
Affidavit.

4. Sometime in 2021, my sister, Marilyn S. Agustin called me and my wife Annaliza

and asked if Annaliza can work as a Kasambahay in her house at Blk. 27 Lot 14 Mt. Carmel
Road, Montevista Heights, Barrio Dolores, Taytay, Rizal. Annaliza will also take care of the
youngest child of my sister.

5. My wife and I agreed because I am very close to my sister, Marilyn and we also
want to help Marilyn because she is an Overseas Filipino Worker (OFW) at Kuwait.

6. While my wife Annaliza was working as a Kasambahay and at the same time
taking care of my niece, my brother-in-law, Fernando B. Agustin, hired her as a Secretary in the
Dental Laboratory that was owned by my sister, Marilyn.

7. The Dental Laboratory was just beside the house of my sister Marilyn.

8. Since my wife Annaliza was already in Taytay, Rizal, I decided that my son, Ian
Angelo D. Sensano will study in Manila so that his mother can oversee his studies. My son Ian
will also stay in the house of my sister, Marilyn. My son Ian was enrolled at De Ocampo
Memorial College and is taking up Dental Tech.

9. My wife Annaliza was hesitant that our son will stay with her and wanted our
son to just study in Cagayan. She gave me no reason why she wanted our son to stay in
Cagayan. I found out later on that Annaliza did not want my son to stay with her because our
son will see her illicit relationship with my brother-in-law Fernando.

10. While my son was living in the house of my sister in Taytay, Rizal with her
mother, and his Uncle Fernando B. Agustin and my niece, my son noticed that my wife
Annaliza and my brother-in-law Fernando were very close to each other and they were
displaying love and affection towards each other.

 11. My son also observed that my wife Annaliza and brother-in-law Fernando were
very affectionate with each other as if they are husband and wife. They were always together,
talking to each other, going out and drinking. Their closeness was very obvious.

12. I was worried because this was not the first time that my wife Annaliza had an
affair with another man.

13. Years ago when my wife Annaliza was an Overseas Filipino Worker (OFW) at
Kuwait, she had an affair with another OFW. My sister, Marilyn, who was also an OFW in
Kuwait, was able to confirm her illicit relationship with another man. When I confronted my
wife Annaliza about her alleged affair, she admitted to me that she indeed had an affair with
another man and had sex with this man twice.

14. Before this affair with my brother-in-law, my wife Annaliza cheated on me three
times. My friends and relatives witnessed the infidelity committed by my wife. I was confident
that my wife will not do this and I trusted her. I do not have concrete proof but there was a
time that I felt betrayed.

15. I wanted to end my marriage with Annaliza but consequently, I forgave her
because she promised that she will not do it again. Also, I love my wife Annaliza and I do not
want a broken family.

16. My son also told me that he has never seen my wife Annaliza show or display the
same love and affection to me the same way that she shows love and affection to my brother-
in-law Fernando.

17. I told my son to continue to observe what my wife Annaliza and my brother-in-
law were doing.

18. My son Ian decided to buy a small video camera and install it under a table inside
the master’s bedroom so he can see if my wife was sleeping with my brother-in-law Fernando
and if they were having sexual intercourse.

19. My son could remotely access the hidden camera using his cell phone. Based on
the video footage that he was able to recover and some photos, it was confirmed that my wife
Annaliza was staying and sleeping in the master’s bedroom with my brother-in-law Fernando.
This is the same master’s bedroom which my sister Marilyn and her husband Fernando
consider as their conjugal room and the conjugal bed where they also have sex and the house
is their conjugal dwelling.

20. Since my son placed the video camera under a table beside the bed, there were
times when only the leg or the foot can be seen but I can still identify the leg or foot of my wife
Annaliza just by looking at it and the slippers that she was wearing.

21. In one video footage dated April 16, 2023, at around 9:35 p.m., it can be seen
that my wife Annaliza entered the master’s bedroom. My brother-in-law Fernando was also
inside the master’s bedroom.

22. In another video footage dated April 16, 2023, at 10:25 p.m., my wife Annaliza
entered the master’s bedroom. My niece, Kimberly S. Agustin was knocking on the door. My
brother-in-law Fernando could not open the door because Kimberly will see Annaliza. What
Annaliza did was to hide inside the master’s bathroom. When Annaliza was inside the
bathroom, that was the time when Fernando opened the door.

 23. My niece Kimberly went inside the master’s bedroom to say good bye to his
father, Fernando, because she was leaving. My niece Kimberly was accompanied by her
boyfriend who also said good bye to Fernando.

24. In another video footage dated April 30, 2023, at around 11:45 p.m., it can be
seen that my brother-in-law Fernando was lying down on the bed and my wife Annaliza was
lying right next to him. This time, the face of Fernando can be seen.

25. In another video footage dated May 1, 2023, at around 12:45 p.m., it can be
seen that Annaliza entered the master’s bedroom with only a green towel wrapped around her
body and thereafter, she turned off the light.

26. One time, my son told me that he saw Annaliza inside the master’s bedroom and
she was massaging my brother-in-law Fernando while lying down on the bed. Fernando was
not wearing a shirt. This happened at 11:30 in the evening.

27. My wife Annaliza and my son Ian share the same room at the second floor of the
house of my sister, Marilyn. However, there are times when my son will sleep in a room at the
third floor of the building which is also owned by my sister, Marilyn beside the house together
with the dental technicians who works at the dental laboratory of my sister, Marilyn and who
are stay-ins.

28. One night, my son checked if Annaliza was in their room. Annaliza was not in the
room so my son decided to go down to the ground floor to check if Annaliza was there.

29. The lights at the kitchen and sala were turned off but my son could still see his
surroundings.

30. While my son was standing beside the kitchen window, he heard some moaning
sound of sexual pleasure from the master’s bedroom. After a few minutes, a lady wearing
white came out of the master’s bedroom of my sister Marilyn and my brother-in-law
Fernando. This lady who came out of the room was my wife, Annaliza.

31. My son saw Annaliza go to the kitchen sink to spit several times and she gargled
several times too.

32. When Annaliza came out of the master’s bedroom of my sister Marilyn and my
brother-in-law Fernando, she was tip-toeing so that no one could hear her.

33. Annaliza was so worried that someone might see or hear her, she never noticed
that my son was standing right next to the kitchen sink. Annaliza probably thought that
because the lights were turned off, she did not expect anyone to be at the kitchen or sala at
that time.

34. After spitting and gargling repeatedly, Annaliza went up to her room at the
second floor.

35. My distant relative, Soledad G. Quines, also witnessed my wife Annaliza come
out of the master’s bedroom wearing only a white sando and a thin blanket that was wrapped
around her thighs. This happened around 9:30 p.m. of March 10, 2023. Only Annaliza and
Fernando were inside the room at that time.

 36. There was also a time when Fernando asked my son to buy “pulutan”.
Thereafter, my son saw Annaliza and Fernando drinking alcohol inside the master’s bedroom
and showing love and affection to each other.

37. On another occasion, my son and his classmates went to the house of my sister,
Marilyn to do a school project. They decided to stay in the room where Annaliza and my son
sleep. When Annaliza saw may son and his classmates, she told my son that they can use the
room and she will sleep in another room at the second floor of the house.

38. At around 1:00 a.m., my son decided to check on Annaliza if she was sleeping in
the other room. When he entered the room, Annaliza was not there.

39. My son decided to go down to the ground floor to check if Annaliza was there.

40. When my son was at the ground floor, he did not turn on the lights but instead,
he turned on the flash light of his cell phone. When he turned on the flash light, he saw
something at the sofa that appears to be a person covered by a blanket. My son approached
the sofa and decided to take a look at what is under the blanket. When he removed the
blanket, he did not see Annaliza and there were several pillows under the blanket and was
arranged in such a way to make it appear that a person was covered by a blanket and sleeping.
Annaliza made I appear that she was the one sleeping so that my son will not suspect her of
sleeping in the master’s bedroom with Fernando.

41. My son went to the master’s bedroom to check if Annaliza was there. He tried
opening the door knob but it was locked.

42. My son was hearing some moaning coming from the master’s bedroom so he
decided to use his cell phone to record the sound that he was hearing. His cell phone could not
record the sound because it was not loud enough.

43. So, my son decided to put his ear right beside the main door of the master’s
bedroom to check the moaning sound he was hearing.

44. When he placed his ear right next to the door, my son heard a moaning sound of
sexual pleasure like “oohhhh” “aahhhh” “yeahhh” being uttered by my wife Annaliza. My son
also heard my brother-in-law Fernando utter the same moaning sound of sexual pleasure.
Annaliza and Fernando were also saying words at each other that my son could not
understand anymore. Annaliza and Fernando were obviously having sexual intercourse.

45. My son listened to the moaning sound of sexual pleasure from Annaliza and
Fernando for more or less 20 minutes.

46. While my son was listening, he was crying. He felt disgusted, angry and
humiliated. He took a picture of himself crying and I sent the picture to my sister, Marilyn. He
also texted me and my daughter Alleiya and told us of what he was witnessing.

47. My son could not stand listening to the sexual acts of Annaliza and Fernando so
he decided to go back to his room at the second floor. The classmates of my son noticed that
he was crying and asked why he was crying.

48. At around 3:00 a.m., my son decided to check again if Annaliza was sleeping in
the other room in the second floor. This time, she was there.

 49. My son was traumatized because he heard his own mother having sexual
intercourse with his Uncle Fernando.

50. To date, my son told me that his mother Annaliza still regularly sleeps in the
master’s bedroom with my brother-in-law Fernando like they are husband and wife.

51. My son even saw my brother-in-law Fernando sleep in the room where Annaliza
sleeps because he knows that my son is no longer sleeping in that room.

52. My wife Annaliza and my brother-in-law Fernando consistently have sexual

intercourse. They usually have sexual intercourse every Tuesday and Friday. My son can hear
them every time he will stay outside the master’s bedroom.

53. I was informed by my son Ian that on May 3, 3023 at around 6:00 p.m., he saw
his mother Annaliza and my brother-in-law Fernando drinking alcohol at the dental laboratory.
They finished drinking at around 10:00 p.m. Thereafter, Annaliza went to the second floor to
take a shower and after taking a shower, Annaliza went to the master’s bedroom to sleep with
my brother-in-law Fernando. My son went to the ground floor to check on his mother. When
my son stood right beside the main door of the master’s bedroom, he heard his mother
Annaliza and my brother-in-law Fernando moaning and they were having sexual intercourse
again.

54. I was also informed by my son Ian that on May 4, 2023, at around 7:00 a.m., his
mother Annaliza entered the room where he was sleeping to get clothes. His mother Annaliza
only had a thin blanket to cover her body. Annaliza was wearing nothing other than the
blanket she used. Annaliza came from the master’s bedroom where she slept all night with my
brother-in-law Fernando.

55. From the foregoing, the crime of Adultery as defined and penalized in Article 333
of the Revised Penal Code was committed by my wife, Annaliza D. Sensano and her paramour
who is also my brother-in-law, Fernando B. Agustin.

56. The elements of the crime of Adultery are as follows:

a. That the woman is married (even if marriage is subsequently declared void);

b. That she has sexual intercourse with a man not her husband; and
c. That as regards the man with whom she has sexual intercourse, he must know
her to be married.

57. All the elements are present in this case.

58. The first element is present. Annaliza D. Sensano is a legally married woman.
Annaliza D. Sensano and I were married on April 4, 2003 as evidenced by our Certificate of
Marriage. We have three children namely Ian Angelo D. Sensano, Alleiya D. Sensano and
Alexander D. Sensano.

59. The second element is also present. Annaliza D. Sensano had sexual intercourse
with a man not her husband. Our own son, Ian Angelo D. Sensano, witnessed and heard his very
own mother Annaliza D. Sensano having sexual intercourse with my brother-in-law Fernando B.
Agustin. Based on the sworn statement executed by our son, Annaliza D. Sensano continues to
have sexual intercourse with Fernando B. Agustin and they are living together as husband and
wife in the conjugal dwelling of my sister, Marilyn S. Agustin and Fernando B. Agustin.

 60. Lastly, the third element is likewise present. The paramour of my legal wife is the
legal husband of my sister thus making the paramour my brother-in-law. Fernando B. Agustin
knows that Annaliza D. Sensano is my legal wife. We consider ourselves as a family because my
sister Marilyn is the legal wife of Fernando and Annaliza is my legal wife. Marilyn is my sister.

61. In support of my complaint, I am attaching herewith the Affidavit that was

executed by my son, Ian Angelo D. Sensano, the Affidavit that was executed by my daughter,
Alleiya D. Sensano and the Sinumpaang Salaysay of Dolores G. Quines as Annex “B”, Annex “C”
and Annex “D” respectively and made an integral part of this Complaint-Affidavit. Attached to
the Affidavit of my son Ian is the USB where all the video footages are saved.

62. From the foregoing, there is definitely a reasonable certainty of guilt on the part
of my wife Annaliza D. Sensano and her paramour and my brother-in-law-in-law, Fernando B.
Agustin that they committed the crime of Adultery under Article 333 of the Revised Penal Code.

63. I am executing this sworn statement to attest to the truth of all the foregoing
and to cause the criminal prosecution of Annaliza D. Sensano and Fernando B. Agustin for the
crime of Adultery as defined in Article 333 of the Revised Penal Code.

AFFIANTS FURTHER SAYETH NAUGHT.
