COMPANY POLICY
PUBLIC HOLIDAY

SAMPLE 1 (observe all PH)

Purpose This policy defines and explains the Company’s observation and policy on public
holidays. Employees shall use this policy to reference the Company’s prevailing
practices on public holidays.
Scope Applicable to all permanent and contract employees employed by the Company,
including foreign workers and expatriate employees.

Contents

1.0. The Company observes all public holidays gazetted by the Federal and State governments.

2.0. Should any of the said gazetted public holiday fall on a rest day or another public holiday,
the working day following the rest day or the other public holiday immediately shall be a
paid holiday in substitution of the first mentioned public holiday

3.0. Should any public holidays fall on an off day, there shall be no replacement for the said
public holiday.

4.0. Should a public holiday fall on the day when an employee is on paid maternity leave or
paternity leave, the Company will not grant the employee another day off or pay in place of
the public holiday as the wages paid include the public holiday pay.

5.0. Should a public holiday fall on the day when an employee is on unpaid leave, the Company
will not grant the employee another day off or pay in place of the public holiday.

6.0. Employees shall not be entitled to holiday pay if they are absent from work without approval
from their immediate superior or without reasonable excuses on a working day immediately
before or after the public holiday or replacement public holiday.

7.0. Should a public holiday be declared under Section 8 or Section 9 of the Holidays Act 1951,
the Company may replace the said public holiday by granting another day as a paid public
holiday in substitution. The Company shall decide on such replacement within seven (7)
days after the government announces the said public holiday. Unless informed otherwise,
employees shall be required to work as usual on the said public holiday.

8.0. Public holiday during a business trip

8.1. Should a public holiday fall on a working day at home state during a business trip,
and it is not a public holiday at the intended location of the business trip, the
Company shall grant the affected employee any other day as a paid public holiday
in substitution for the said public holiday.

8.2. Should a public holiday be declared at the intended location of a business trip and
it is a public holiday in the home state during a business trip, such a public holiday
will not be replaced.

8.3. Should a public holiday be declared at the intended location of the business trip
while the employee is travelling to the said location and it is not a public holiday at
the home state, the employee shall notify the Company immediately and make
necessary arrangements to return to their home state within the earliest possible
timeframe. The loss of working hours/day(s) due to this situation shall be deemed a
business trip leave.

9.0. Subsections 60D(3) and 60D(4) of the Employment Act 1955 shall apply to those eligible
for work done on a public holiday or a replacement public holiday.

10.0. Employees who work on a public holiday and are not eligible under subsections 60D(3) and
60D(4) of the Employment Act 1955 shall be replaced with paid leave in replacement
thereof.

11.0. The Company shall, at its sole discretion, decide on exceptional cases and shall not be
taken as a precedent for future events/cases.

12.0. The Company reserves the right to amend this policy from time to time and shall notify all
employees when such an amendment has been made and approved by the Management.

13.0. Should this policy be translated into other languages, the English version shall be
authoritative in case of any dispute or confusion.

holidays. Employees shall use this policy to reference the Company’s prevailing
practices on public holidays.
Scope Applicable to all permanent and contract employees employed by the Company,
including foreign workers and expatriate employees.

1.0. The Company observes eleven (11) of the gazetted public holidays gazetted by the
Federal and State governments;

2.0. The Company may change the selected public holiday(s) except for the mandatory public
holidays at its sole discretion. Employees shall be notified of such changes at the
beginning of the calendar year.

3.0. Should any of the said gazetted public holiday fall on a rest day or another public holiday,

paid holiday in substitution of the first mentioned public holiday

8.0. Should a public holiday(s) be declared under Section 8 of the Holidays Act 1951, the
Company may replace the said public holiday by granting another day as a paid public
holiday in substitution. The Company shall decide on such replacement within seven (7)
days after the government announces the said public holiday. Unless informed otherwise,
employees shall be required to work as usual on the said public holiday.

9.0. The company does not observe any public holiday(s) declared under section 9 of the
Holidays Act 1951. Such public holiday(s) shall be a normal working day. Employees shall
be required to work as usual on the said public holiday unless the company informs
otherwise.

10.0. Business trip on a public holiday observed by the company

10.1. Should a public holiday fall on a working day at home state during a business trip,
and it is not a public holiday at the intended location of the business trip, the
Company shall grant the affected employee any other day as a paid public holiday
in substitution for the said public holiday.

10.2. Should a public holiday be declared at the intended location of a business trip and
it is a public holiday in the home state during a business trip, such a public holiday
will not be replaced.

10.3. Should a public holiday be declared at the intended location of the business trip
while the employee is travelling to the said location and it is not a public holiday at
the home state, the employee shall notify the Company immediately and make
necessary arrangements to return to their home state within the earliest possible
timeframe. Due to this situation, the loss of working hours/day(s) shall be deemed
a business trip leave.

10.4. Should any public holiday(s) not observed by the company fall during the business
trip (as stated in clauses 9.1, 9.2 and 9.3), the company shall decide at its discretion
and inform the affected employees.

11.0. Subsections 60D(3) and 60D(4) of the Employment Act 1955 shall apply to those eligible
for work done on a public holiday observed by the company including any replacement
public holiday.

12.0. Employees who work on a public holiday observed by the company and are not eligible
under subsections 60D(3) and 60D(4) of the Employment Act 1955 shall be replaced with
paid leave in replacement thereof.
