Case Assigned: Case #1- Sexting

Philosophy used for Argument: Consequentialism/Utilitarianism

I. Arguments about the issues

Sexting is the transmission of provocative images or inviting text messages with the use of a
mobile or smart phone. With the help of the philosophy chosen for the argument, sexting is
used by one to maximize pleasue, may it be with a minor or a legally aged person. With it
being popular among teens who are underaged, it may be considered as child pornography
under the eyes of the law. Sexting is more dangerous online as it may involve people pre-
tending to be someone they’re not and asking for sexual or nude photos.

A. Summary of Arguments
Sexting can be punishable under child pornography.
B. Information that supports your arguments
Child pornography refers to any representation, whether visual, audio, or written combi-
nation thereof, by electronic, mechanical, digital, optical, magnetic or any other means,
of child engaged or involved in real or simulated explicit sexual activities.

C. Evidences for your arguments

Under RA 9775 or the Anti-child pornography act, child pornography refers to the repre-
sentation of children involved in real or simulates sexual activities by visual or written.
Catfishing is also a way one can engage in sexting under a fake name and use it for plea-
sure or money by selling these pictures online.

II. Your Own Position about the Issue

Sexting is not a crime but by its means, it can be punishable by different existing laws.

A. First Point about the issue

Sexting can be identified as cyber bullying if the picture sent is revealed to a number of
people and is meant to shame another person.

1. Opinion about the first point

It is very immature and low to spread the provocative image that a person sent to
you because of pleasure. It is ridiculous to get revenge on a person after a break up
just because he or she gave you revealing pictures of them.
2. Evidences
A photoshopped picture of a girl’s head on a naked body and it was sent to different
people to shame her. This happened in St Jude Catholic School the previous week.
B. Second Point about the position
Sexting is popular to teenagers rather than adults

1. Opinion about second point

2. Evidences
