● Status of Case : Rape with Homicide Dismissed by Makati City Prosecutor’s Office
due to “Lack of probable cause”.

Findings/ Minutes:
● Inconclusive statement was release to the media about the incident, saying that they have
already “solved” Dacera’s “rape-slay” case, despite some other missing details and conflicting
reports regarding the matter
● Inconclusive Autopsy report due to the victim was already embalmed prior to the autopsy.

● Medico legal report says cause of death is ‘Natural’ due to ruptured aortic aneurysm

● "Irregular and inaccurate" submission of a report and death certificate regarding victim’s death

● The Investigator together with his colleagues went to the Funeral Parlor and performed a
hasty examination in the victim’s cadaver, thus, findings of the investigation give a reason to
the relative to believe that foul play is present.
● Political intervention affects the process of investigation, like the cash reward offered by former
Sen. Manny Pacquiao for the information related to the death of the victim.
● Friends and family members of the victim gave interviews to the media, which led to more
rumors and speculations about the case.
● Prematurely releasing a report that is incomplete and inconclusive. Grossly concluding that the
case was already “Solved” without providing clear evidence and being able to take into custody
all the persons involved.

Specific Case Recommendation:


● In-depth investigation of the case,including the victim, witnesses and evidence present, should
have been conducted first prior to releasing information and statements to the media.
● Special Operating Procedure during the conduct of investigation and gathering of pieces of
evidence at the crime scene must be properly observed

Observed Best Practices:

● Prompt Investigator’s response on the case/scene.


● Hotel Management cooperated with the investigating team by providing copies of CCTV with
certifications as supporting evidence.
● The Investigator observed the requirements of Custodial Investigation that suspect/s were
assisted by their counsel during extracting sworn statements, which helped the dismissal of
counter-complaints for illegal detention, arbitrary detention, unlawful arrest, perjury, grave
coercion, libel, slander, and cyber libel against the victim’s mother, cousin and the First
Responders due to lack of evidence.
