1. In the present petition, the grievance of the petitioners is that

keeping in view the revised result, the selection to the post of clerk has

already been made keeping in mind the decision of this Court in CWP-

15672-2021 titled as Amit Kumar and others Vs. State of Haryana and

others and the petitioners who have now come in merit, have been given

appointment but they are entitled for appointment from the day when the

candidates lower in merit have been given the appointment with all

consequential benefits as the petitioners were not at fault at any given

point of time.

2. Learned counsel for the petitioners further submits that once

the petitioners are higher in merit, they are to be given the appointment

with retrospective effect with all consequential benefits including the

seniority.

3. Notice of motion.

4. Mr. Pankaj Middha, Addl. AG, Haryana accepts notice on

behalf of State and submits that the petitioners have directly approached

this Court without even raising a grievance with the respondents qua the

prejudice as mentioned in the present petition and in case, the

petitioners approach the authorities concerned raising the grievance as

raised in the present petition, the same will be considered in accordance

with law and appropriate order will be passed within a period of 8

weeks of the receipt of the copy of any such claim.

5. Faced with this situation, learned counsel for the petitioners

submits that the present petition may kindly be disposed of having been

not pressed any further with liberty to the petitioners to file appropriate

claim before the authorities concerned at this stage.

6. Ordered accordingly.
