COMPROMISE AGREEMENT

This Compromise Agreement is made and entered into this 19th

day of April, 2023 by and between:

__________________, 35 years of age, female, married,

Filipino, and a resident of Sitio Kinabutan, Barangay Rizal,
Surigao City, hereinafter referred to as the FIRST PARTY.

_________________, 46 years of age, male, married,

Filipino, and a resident of Purok 7, Barangay Honrado, San
Francisco, Surigao del Norte, hereinafter referred to as the
SECOND PARTY.

WITNESSETH:

WHEREAS, on April 17, 2023 around 3:05 in the afternoon a

vehicular accident has transpired along Km-2, National Highway,
Barangay Luna, Surigao City near Gateway Hotel.

WHEREAS, a one-unit Gray Suzuki Ertiga Wagon Utility Vehicle

bearing plate number ________________under Certificate of
Registration with Number ________________and LTO Official Receipt
with Number __________________ dated 11/13/2020 registered to
and was driven By ________________, the herein FIRST PARTY was
accidentally hit from behind causing a rear end collision by a Yellow
PUV Tricycle with body number_____________, with no Certificate of
Registration and no LTO Official Receipt presented and was driven
by________________, the herein SECOND PARTY.

WHEREAS, as a result of the said accident, the left side tail light
of the above – mentioned vehicle herein driven by the FIRST PARTY
was broken.

WHEREAS, the herein parties desire to buy peace and wish to

avoid a protracted litigation in this case.

NOW THEREFORE, in consideration of the foregoing and the

further covenants hereinafter set forth, the parties agree as follows:

1. The SECOND PARTY undertakes either to buy a new tail light

and replace what has been damage or just pay the price of Php
7,894.00 with a shipping fee of Php 524.00 and with a total amount of
Php 8,418.00 in favor of the FIRST PARTY.

 2. The FIRST PARTY shall give the SECOND PARTY not more
than ten (10) days from the signing of this agreement on April 19,2023
to comply with the first condition, otherwise, the FIRST PARTY shall
initiate or commence any legal actions available against the SECOND
PARTY

3. Upon the compliance of the first condition, the herein parties or

their assigns hereby waive, renounce and forever quitclaim all their
respective claims and counterclaims subject of the instant action as
well as those that may arise therefrom, in connection therewith or in
relation thereto.

4. The foregoing covenants are not contrary to law, morals, or

public policy and the parties bind themselves to comply strictly with
their undertakings.
