PRESENTATION MUNICIPAL APPRAISAL COMMITTEE

Slide 1 – Municipal Appraisal Committee


When there is a need to provide mechanism to facilitate acquisition
of private property for public use through Negotiated Sale or Expropriation
Proceedings the creation of Municipal Appraisal Committee is necessary.

In relation to the Water System Project presented last February 28, there is
a need to create the committee to ensure the needed requirement for the
purchase of the property ahead of time.

Slide 2 – Pursuant to the Provision

Under the Local Government code of the Philippines under Sec. 201
All real property, shall be appraised at the current and fair market value
prevailing in the locality where the property is situated . And must be
beneficial to the Government if acquired.

Operations

Technical Supervision, the DOF,BLGF and the Provincial Assessor, shall,


on a continuing basis, issue guidelines, rulings and opinions on matters
relating to the classification, appraisal and assessment of real property and
other issues relative thereto for the strict compliance of all local assessors.

one of the major causes of delays in the implementation of


development projects, particularly national infrastructure projects, has been

thereon which are needed for said projects, and the settlement of claims for

PROCEDURE FOR ACQUISITION OF PROPERTY

1. Acquisition Through Negotiated Sale

2. Expropriation.
If the parties fail to agree in negotiation of the sale of the land as
provided in the preceding section, the government implementing
agency/instrumentality concerned shall have authority to immediately
institute expropriation proceedings through the Office of the Solicitor
General or the Government Corporate Counsel, as the case may be.

“Technical Supervision” includes the authority of the Provincial Assessor to


review actions taken by a subordinate official to determine compliance with
existing pertinent rules and regulations regarding the appraisal and
assessment of real property.

Certification of prevailing price in the Area = the average/ existing price


at which the property has been sold in a given area in a particular time.
The price per square meter in that area.

Municipal Appraisal Committee Resolution

should make strong representations for the reconciliation and resolution of


the Appraised Value of the Property to be Acquired which is beneficial to
the government.
