MOTION TO REMAND
COMES NOW THE STATE OF MISSISSIPPI by and through the District Attorney, and
respectfully moves this honorable Court to enter an Order of Remand in the above captioned
cause, and in support thereof would assert the following reasons, to-wit:
1. On December 21, 2020, the Defendant, Jaylein Wallace, was indicted by a Hinds
County Grand Jury for committing the crimes of Aggravated Assault in violation of § 97-3-7 of
2. On or about April 2, 2017, the Hinds County Sheriff’s Office responded to the
American Legion club, in Edwards, MS, in response to a shooting. According to police reports
there may have been a fight in the club that led to a shooting. The victim in this matter was shot
from behind, in the buttocks, back, leg, and ankle. Several different case shellings were

sole eyewitness alleges the defendant committed the shooting because he saw the defendant with
a gun. However, without adequate evidence, the State cannot in good faith proceed in this matter.
4. As such, it is in the best interest of justice that this case be remanded, as the State
remand the within cause for the reasons set forth herein until such time as adequate evidence can
