STATEMENT OF JURISDICTION

The Hon’ble Supreme Court of Windia has the jurisdiction in this matter under Article 136 of
the Constitution of Windia which reads as follows:
“136. Special Leave to appeal by the Supreme Court
(1) Notwithstanding anything in this Chapter, the Supreme Court may, in its discretion, grant
special leave to appeal from any judgment, decree, determination, sentence or order in any
cause or matter passed or made by any court or tribunal in the territory of India
(2) Nothing in clause (1) shall apply to any judgment, determination, sentence or order passed
or made by any court or tribunal constituted by or under any law relating to the Armed Forces”1
The matter is before the Hon’ble Chief Justice and his Hon’ble companions of Supreme Court
and has been listed for the first hearing.
The memorandum for the Appellant in the case of STEPHANIE V. STATE sets forth the
Facts, Contentions and Arguments in the present case.

STATEMENT OF FACTS

It is most respectfully showeth:


1. That on 23.10.2000, A matrimonial knot was tied between Jones and Stephanie in the city
named Shipla. A baby boy with special needs was born within 2 years of Marriage. Jones was
not able to cope up with stress because of increased financial demands and he got addicted to
alcohol. There were constant quarrels and arguments between the couple.
2. That on 02.01.2003, Jones came home with heavy consumption of alcohol and after
arguments with Stephanie, he started beating her and left her with bruises on leg and left cheek.
She confessed everything to her in laws and parents who promised financial aid and Jones
vowed to quit drinking.
4. That the Couple was leading a happy life until December 2005 as Jones again got addicted
to alcohol and there were physical quarrels and arguments between the couple. On 05.01.2006
Stephanie decided to tell everything to her parents but was stopped by Jones as he threatened
her that he will kill the child. She was also raped by him.
5. That on 21.03.2006, Jones came home drunk and started beating her and it continued till
11:00 pm and after that he slept. Stephanie couldn’t sleep and on 22.03.2006 at about 4 am, she
took iron rod in her hand and inflicted injuries on head and vital part of Jones and he died on
spot. After that at 6:30 am she went to room and inflicted a hit on head of child who died on
spot and she sat in drawing room holding iron rod in hand. Around 8:00 am Maid came and after
seeing everything she called the police and Stephanie was arrested.
6. The Trial Court convicted Stephanie for culpable homicide not amounting to murder with
imprisonment for 10 years as she acted under sudden and grave provocation. However, Shipla
High Court convicted Stephanie for murder and awarded life imprisonment. Aggrieved by the
order of High Court, Stephanie has filed an appeal before the Hon’ble Apex Court.
